TheJuvenileJustice(CareandProtectionofChildren)Bill,2014wasintroducedbytheMinisterofWomenandChild
Development,ManekaGandhi,intheLokSabhaonAugust12,2014.ItrepealstheJuvenileJustice(Careand
ProtectionofChildren)Act,2000.
Objectives:TheBillseekstoachievetheobjectivesoftheUnited
NationsConventionontheRightsofChildrenasratifiedbyIndiaon
December11,1992.Itspecifiesproceduralsafeguardsincasesof
childreninconflictwithlaw.Itseekstoaddresschallengesinthe
existingActsuchasdelaysinadoptionprocesses,highpendencyof
cases,accountabilityofinstitutions,etc.TheBillfurtherseeksto
addresschildreninthe1618agegroup,inconflictwithlaw,asan
increasedincidenceofcrimescommittedbythemhavebeen
reportedoverthepastfewyears.
Coverage:TheBilldefinesachildasanyonelessthan18yearsof
age.However,aspecialprovisionhasbeeninsertedforthepossibilityoftrying1618yearoldscommittingheinous
offences,asadults.AheinousoffenceisdefinedasoneforwhichtheminimumpunishmentundertheIndianPenal
Codeissevenyears.
Generalprinciples:Theseinclude(i)principleofpresumptionofinnocenceforanychilduptotheageof18years
(ii)principleofbestinterestforalldecisionstakenregardingthechild(iii)principleofinstitutionalisationstatingthat
achildshallbeplacedininstitutionalcareasastepoflastresort,etc.
JuvenileJusticeBoards(JJBs):OneormoreJJBstobeconstituted,foreachdistrict,fordealingwithchildrenin
conflictwithlaw.JJBsarecomposedofaMetropolitanorJudicialMagistrateandtwosocialworkers,oneofwhomshall
beawoman.
PowersandresponsibilitiesoftheJJBsinclude:(i)ensuringlegalaidforachild(ii)adjudicatingand
disposingofcasesrelatedtochildreninconflictwithlaw(iii)conductingregularinspectionofadultjailstoensureno
childislodgedinsuchjailsandotherinspectionvisitsand(iv)conductinginspectionvisitsofresidentialfacilitiesfor
suchchildren.
ChildrensCourt:AChildrensCourtisaCourtestablishedundertheCommissionsforProtectionofChildRights
Act,2005oraSpecialCourtundertheProtectionofChildrenfromSexualOffencesAct,2012.Itwilltry1618yearolds
thatcommitheinousoffences,afterconfirmingthattheyarefittobetriedasadults.Itensuresthatachildinconflict
withlawissenttoaplaceofsafetyuntilheattainstheageof21years,afterwhichheistransferredtoajail.Duringthe
childsstayintheplaceofsafety,reformativeservicessuchascounselling,etc.shallbeprovided.TheCourtshallensure
periodicfollowupreportsbyDistrictChildProtectionUnits.
ChildWelfareCommittees(CWCs):StatesshallconstituteoneormoreCWCsforeachdistrictfordealingwith
childreninneedofcareandprotection.ThepowersandresponsibilitiesofaCWCinclude:(i)conductinginquiries
(ii)selectingregisteredinstitutionsfortheplacementofachildand(iii)addressingorphans,abandonedchildren,
surrenderedchildrenandsexuallyabusedchildren,etc.
SpecialJuvenilePoliceUnits(SJPU)andChildWelfarePoliceOfficers:AnSJPUwillbeestablishedineach
district,consistingofapoliceofficerandtwosocialworkers.OneChildWelfarePoliceOfficerwillbepresentinevery
policestation.
Adoption:Prospectiveadoptiveparentsmustbeconsenting.Asingleordivorcedpersoncanalsoadopt,butasingle
malecannotadoptagirlchild.Parentsmustbephysicallyfit,financiallysound,andmentallyalertandmotivatedto
adopt.RegulationsregardingadoptionshallbeframedbytheCentralAdoptionResourceAuthority.
Penalties:Anyofficial,whodoesnotreportanabandonedororphanedchildwithin24hours,isliableto
imprisonmentuptosixmonthsorfineofRs10,000orboth.Thepenaltyfornonregistrationofchildcareinstitutions

isimprisonmentuptooneyearorfineofonelakhrupees,orboth.Thepenaltyforgivingachildintoxicatingliquor,
narcoticorpsychotropicsubstancesisimprisonmentuptosevenyearsorfineofonelakhrupees,orboth.
