Resumo:
A histria do degredo em Portugal ganhou novas perspectivas com a
expanso martima dos sculos XV e XVI. Durante este perodo, os
indesejveis do Reino foram degredados para as novas colnias
ultramarinas. As Ordenaes do Reino, primeiramente as Afonsinas (1446),
as Manuelinas (1521), e as Filipinas (1603), apontam com clareza o controle
social estabelecido pela Coroa. No Livro 5 das Filipinas est contido o
cdigo e processo penal onde esto listados todos os delitos e seus
respectivos castigos, inclusive o degredo destinado ao Brasil. A excluso dos
elementos indesejveis foi amplamente utilizada pelas leis do Antigo Regime
como mecanismo de normatizao social e povoamento das terras recm
descobertas.
Abstract:
The history of banishment in Portugal acquired new angles with the
maritime expansion of the 15th and 16th centuries. During this time,
undesirables were banished to the new colonies across the sea. Royal
ordinances, primarily those of King Alfonso (1446), king Manuel (1521),
and King Philip (1603), clearly indicated the social control established by
the crown. In Book Five of Philippine laws is found the penal code and
process in the case of crimes where are listed infractions and their
respective punishment, including banishment to Brazil. The exclusion of
undesirable elements from the community was used by the Old Regime
both as a means of achieving social normalization and populating recently
discovered lands.
