Capital View Casino & Resort

Dear Town Board Member Mangold:

We have been reviewing the Casino Application for the Capital View Casino and Resort that was
submitted to the NYS Gaming Commission on June 30, 2014. In Exhibit VI.L, of the materials
submitted by the Applicant, they were required to disclose the names of Public Officials who
stand to receive financial compensation in connection with the Application.

You were specifically named in the Application due to one of your relatives, Brian Hart,
received Twenty Five Thousand Dollars ($25,000.00) as part of an option contract to purchase
real property and he stands to receive an additional Seventy Five Thousand Dollars ($75,000.00)
upon the eventual closing of the transaction, totaling One Hundred Thousand Dollars
($100,000.00).

Pursuant to Section 5 of Local Law Number 3 of 2013 of the Town of East Greenbush, the
Ethics Law, no town officer shall use her position to secure a financial or material benefit for
herself or a relative. In accordance therewith, we are hereby demanding that you recuse yourself
from all discussions concerning the Capital View Casino and Resort, the Planned Development
District legislation, re-zoning applications, subdivision and site plan applications, and any other
related discussions or votes concerning the Capital View Casino and Resort or matters sponsored
by the Applicant or directly related thereto.
