I have attempted to forward to President Vladimir Putin of the Russian federation an email
(see below) but I am not sure if this actually was send, this as it appears that since MH17 crashed 25
the email system is causing problems.
I am calling upon you as the president of Ukraine to ensure that matters are as much as possible
pursued in a peaceful manner.

As such I view it is important you consider my writings and place matters before the
constitutional court to have it decide what is appropriate, this as if I am correct that the Ukraine
parliament nor the Ukraine government can permit any group, not being Ukraine armed forces
nor being Ukraine police forces to carry weapons then this must be acted against.

I will first quote various details I downloaded from Ukraine websites relevant to this matter as it
indicates that you as President have the position to protect the true meaning and application of
the Ukraine constitution and cannot permit unconstitutional conduct by anyone. But before
doling so I will quote a Statement by President Vladimir Putin and I expect that President 5
Vladimir Putin will adhere to what he stated and make clear to the separatist that the rule of law
(the Ukraine constitution) governs and any dispute must be placed before the Ukraine

Situations Ministry, and Malaysian experts are already working at the site, but this is not
enough.
It is essential that a full-fledged group of experts under ICAO aegis, an appropriate 5
international commission set up for the task, be able to work at the crash site. We must do
everything possible to ensure their complete and guaranteed safety and provide them with the
humanitarian corridors they need for their work.
For its part, Russia will do everything within its power to move the conflict in eastern Ukraine
from the military phase we see today to the negotiating phase, with the parties using peaceful 10
and diplomatic means alone.

the separatist in violation to the Ukraine constitution and also in violation to the UN resolution.
Hence I expect that president Vladimir Putin shows he is a man of his word and will instruct his
armed forces to prevent any support for the separatist as it is a legal issue that must be placed
before the constitutional court and MH17 investigators must immediately be provided safe access 20

As you assured that you would provide cooperation and also agreed to the UN Resolution 35
to provide access to the crash site, I view you are morally and ethically bound to ensure
that Dutch and Australian investigators and Federal Police officers can re-enter the site by
perhaps ensuring that the separatist are holding a seize fire and so the Ukraine Government.
As I understand it you are supporting the Separatist with weapons and therefore you are ac
countable for their failure to allow investigators and federal police officers in peace and 40
safety to recover bodies and investigate the crash sites.
.
I have, so to say done my bit to pursue that the Dutch and Australian Federal Police
comply with the Ukraine constitution regardless that the Ukraine parliament had passed
legislation to allow armed Federal Police to be present. 45
And if you head the content of my 5 July 2014 correspondence then pursue what I wrote
about, that is to place matters before the courts! That I view is the decent way to address
matters.

I request you provide a copy of this correspondences also to those referred to above.
As a CONSTITUTIONALIST my first issue in regard of Ukraine is to consider the Ukraine
Constitution. I have below quoted certain part of the Ukraine constitution.
I may add that I gained great respect for the version of the Ukraine constitution but obviously in
the end if it is not applied or not adhered to then the constitution so to say is worthless. 45

Because Australian investigators and Australian Police are with their Dutch counterparts engaged
in investigations within Ukraine I view it better to express my concerns.
.
Media reports indicate that Australian Federal Police albeit not carrying weapons they are 50
permitted to do so in case of self-defence. I hold that the Ukraine Constitution prohibit any group
or forces to carry weapons and as such any law passed by the Ukraine Parliament would be null
and void (ULGTRA VIRES) unless the Ukraine parliament has placed such forces under its own
direct command and supervision as part of its police force. As such they are part of the Ukraine
federal police for purpose of protection of investigators. Failing to have this provided for may 55
make each and every Australian and Dutch Federal Police officer personally legally accountable

for any e vent that may occur involving the harm of any Ukraine citizen even if they are of the so
Called Russian backed separatist forces.
It also means that the Russian backed Separatist as well as the Russians involved in what one
may describe as an uprising are violating the Ukraine constitution.

In my view the matter should in the first place have been placed before the courts before all the
violence started, as to enforce the right of any Ukrainian to use the Russian language.

Any treaty made with Malaysia, the Netherlands, Australia, Russian Federation, etc, must always 35

To protect the sovereignty and territorial indivisibility of Ukraine, and to ensure its economic and
informational security are the most important functions of the State and a matter of concern for all the
Ukrainian people.
The defense of Ukraine and the protection of its sovereignty, territorial indivisibility and inviolability, are 5
entrusted to the Armed Forces of Ukraine.
Ensuring state security and protecting the state border of Ukraine are entrusted to the respective military
formations and law enforcement bodies of the State, whose organization and operational procedure are
determined by law.
The Armed Forces of Ukraine and other military formations shall not be used by anyone to restrict the rights 10
and freedoms of citizens or with the intent to overthrow the constitutional order, subvert the bodies of power,
or obstruct their activity.
The State ensures the social protection of citizens of Ukraine who serve in the Armed Forces of Ukraine and
in other military formations as well as of members of their families.
The creation and operation of any armed formations not envisaged by law are prohibited on the territory of 15
Ukraine.
The location of foreign military bases shall not be permitted on the territory of Ukraine.

Any conduct, such as the Russian backed Separatist conduct is unconstitutional and for this I 20
view the government of Ukraine rightful conduct should have been to apply to the court for
orders against any such semi military force. And if needed backed up with warrants against any
person who violated the court orders.
However, as I will refer to below as I understand it the Ukraine Government allowed armed
groups of people to disturb the peace and interfere with the rights of Ukrainians in the eastern 25
part of Ukraine to have and hold peaceful political assemblies, and this also as I understand it
(but do not approve of) the Russian backed separatist commenced their violent response.

I understand that there are Ukrainians fleeing to the Russian federation for that they do not desire
to be drafted in the Ukraine armed forces and so to say have to fight their own. Hence, I view the 40
Ukraine government should have made clear to citizens who are called up for military duty that
they could be placed in alternative service and not having to battle their own if this is an issue.

and I view this includes any external policed force of the Dutch and Australia. Hence so to say

Now Pravy Sector are main force against people in east Ukraine. They are not
conscripts and if they will die in battles their parents will get no compensation.
This is because they are not listed anywhere as fighting in east Ukraine because 25
they are illegal but not army batalions.
Article 111 says
The President of Ukraine may be removed from the office by the Verkhovna
Rada of Ukraine in compliance with a procedure of impeachment if he commits
treason or other crime. 30
This is violated because our previous president was removed via violent coup by
force.

In the event of an early termination of the authority of the President of Ukraine
in accordance with Articles 108, 109, 110 and 111 of this Constitution, the 35
discharge of the duties of the President of Ukraine, for the period pending the
elections and the assumption of the office by the next President of Ukraine, shall
be vested on the Prime Minister of Ukraine
This was violated because after coup in Kiev our prime minister Yatsenyuk was
not appointed to do president duties. He remained prime minister and Mr 40
Turchynov from Ukraine parliament was appointed as Acting President. First,
there is not Acting President position in constitution as you can see. Second, Mr

This was violated and was main reason how this conflict started. First decree of
our parliament after coup was to ban Russian language. After protests from east

violated as current government limit Russian language at schools.
Article 27 says
Every person shall have the inalienable right to life. No one shall be arbitrarily
deprived of life. Protection of human life shall be the duty of the State.
This is joke. Current government organised mass murders and only officially 20
more than 1000 civil people are killed. Realistically you can multiply this by 10
remembering how government lies.
We have also violations of articles 39, 15, 24, 33 and many more. I just do not

I have no knowledge about the Ukraine army having been used against a peaceful
demonstration, if this occurred then I view this would indeed be a violation of the 5
Ukraine constitution. And if other armed groups were interfering with a peaceful
demonstration not being the Ukraine armed forces then I view the Ukraine armed
forces should have been deployed and use to stop them. After all that is what I
view the Ukraine constitution guarantees. No one is above the constitution and the

Where the Ukraine constitution provides for the Prime Minister to the 15
assumption of the office of President then I view this is an automatic application.
I view this is not a very wise provision in the constitution and view it would better
to have been that say a senior judge would be the acting President, as to avoid the
political upheaval to be flowing over in to the Office of the President.
My concern is if the removal of the President complied with the provisions of 20
Article 112 of the Ukraine constitution

I do not know the actual procedure that was followed by the Ukraine Parliament,
albeit if it used the fact that the (former) President had requested the Russian 35
Federation to get involved then this I view could have constituted an act of treason
as this specifically would have violated the constitution.
I may state that I have considerable respect for the Ukraine constitution and the
Commonwealth of Australia would be better off to adopt many of its provisions,

As I indicated previously, prior to the Russian Federation purportedly annexing
Crimea, I already then wrote to Putin that I held the then proposed referendum 35
was not valid (and I quoted the Ukraine constitution) as it was not with the
authority of the president of Ukraine. As such, I am more concerned about
constitutional issues then you may hold I do.

What you did with your post was to present your views and refer to certain parts 40
of the Ukraine constitution and that is a lot better than merely making a statement,
regardless if I do or do not agree with all or any of your views.

Article 27 must be interpreted appropriately and that is that ordinary the state
(meaning Ukraine and so its armed forces or any other government authority) 45
cannot deprive a person of life, etc, however this must also be considered in the
context of other constitutional provisions. And this means that in time of armed

rebellion by anyone within Ukraine the Ukraine armed services are entitled to act,
even if this regretfully may be the loss of life of those in rebellion. And if
accidentally, but not specifically targeted, innocent citizens are also killed then
this cannot be regarded a violation of Article 27. What I view article 27 does do is
to make it compelling upon the Ukraine armed forces and any other government 5
authority to not needlessly cause the dead of any citizens where this can be
avoided.
As such, if as you mentioned in previous posting the Ukraine army killed 5 senior
citizens and this resulted without reasonable cause then those involved in the
shelling could in my view be held legally accountable. Article 27 essentially 10
demands that the Ukraine army and any government authorities will do whatever
reasonably possible to avoid the loss of life of any innocent person.
As such it is not the number of people that might be killed but that even the loss of
a single life of a citizen that eventuated needlessly is in my view a violation of the
constitution. 15
In my view the Ukraine constitution is exceptional good but in the end it all
depends upon the proper application and enforcement of the provisions.
As I stated and do wish to underline this I lack the precise details of what
eventuated within the Parliament in regard of the removal of the President and
regarding numerous other matters and my views therefore are based upon what I 20
understand to be the issues and may or may not be the same if other and further in
formation became available.

There is no doubt in my minds that if anyone else was appointed or assumed the
Office of the President in violation of Article 112 then I view such appointment, 25

Where we most part company is your concern that "we" should in any concerned
about Ukraine's Constitution or Courts system or the civil war itself or whose
nation the Crimea or East Ukraine is a part of. That is up to those people there,
and clearly (irrespective of the reasons or recent history) people have decided that 35
they are willing to fight for what they believe in. iow situation normal.
Bottom line to me? It is not my problem. It is not Australia's problem either
simply because an airliner was blown out of the sky and happened to crash in
rebel held territory in the middle of a civil war - and that due to that "normal"
airliner response has been impossible to implement. My response to all the chest 40
beating over the difficulties at the crash site then and now is "Tough luck - deal
with it." Life is regularly about dealing with not always being able to get what we

Ukraine constitution is about because it seems the Ukraine parliament has passed
special legislation to allow armed- not being soldiers- Australian and Dutch

such legal powers. Meaning, if an incident eventuates then the Australian federal
Police may discover not to b e protected and can be personally sued if something 10

The article below mazy underlined that Ukrainians living in the east had problems, and as I
understand it the Ukraine Government failed to reign in the armed groups and let them terrorize
Ukrainians in the east,. As result there were problems in Crimea and the eastern part of Ukraine.
I maintain that instead of so to say rebelling the Ukraine constitution provides for the right to 30
pursue in the courts once constitutional rights and that I view seemed to have been ignored by all
parties.

Regardless of the alleged Crimea referendum and the Russian Federation having purportedly

given the nom de guerre "Sachko Bilyi") had also become known for the farcical Right

prosecutor, snatches his tie and threatens to pull him to Maidan Square with a rope.

Muzychko was shot to death in Rivne, Ukraine, on 24 March 2014. A witness told a local
news service that a dozen men took Muzychko out of a cafe, handcuffed him, and beat him
and two bodyguards. Others said that they later heard two shots fired near the cafe.

special forces. He was captured alive and arrested but died from his wounds before 30

An Air India Dreamliner flight going from Delhi to Birmingham was in fact less than 25km
away from the Malaysian aircraft, a distance covered by a Dreamliner or Boeing 777 in 20
about 90 seconds, when the latter was hit. Because of this closeness, the Dnipropetrovsk
(local Ukrainian) air traffic controller asked the AI pilots to try and establish contact with
pilots of the Malaysian aircraft who had stopped responding to its calls.

Minutes before the crash caused by a missile strike, the AI pilots had also heard the 25
controller give the Malaysian aircraft MH17 what is called "a direct routing". This permits
an aircraft to fly straight, instead of tracking the regular route which is generally a zig-zag
track that goes from one ground-based navigation aid or way point to another. "Direct
routing saves fuel and time and is preferred by pilots. In this case, it proved fatal," said an
airline source. 30
"The AI Dreamliner was less than 25km away from the Malaysian aircraft when the latter
was hit by a missile. When the pilots learnt the cause of the crash later, they were stunned.

I may state that I am concerned as to the numerous reports that make claims and counter claims
as to the shooting down of MH17.
There are reports that because there are round holes in part of the wreckage of the plane then this
indicates the plane was shot down with a round of ammunition. However, as reportedly separatist
were firing in the area of the crash side then the round holes may have resulted from shooting 40
after MH 17 already had crashed and as such only by trying to reassemble the plane as much as
possible can it be shown if those parts that have purportedly bullet holes are not fitting with the

Aviation and defence experts say the victims bodies could contain missile shrapnel.
Chemical residue on the plane could confirm the type of weapon that brought down
Malaysia Airlines Flight 17. And the location of the wreckage could yield information on
how the attack unfolded. 5
The black boxes could offer vital clues as well. The cockpit voice recorder would record
the bang of a missile. The data recorders, which register altitude and position, would be
able to tie that information to the timing of a known missile launch in the area.
Even the size and shape of holes in the aircrafts skin can potentially reveal a lot of detail.
You can effectively backtrack and give a relatively high degree of confidence in the 10
location where that missile took off from, said a Manchester, England-based aviation

which we all suspect it is, that would be the first point where you could point the finger of

Some analysts are already doing just that, with online discussions focussing on the location 15

EVIDENCE BACKS MISSILE HIT
Analyst at the Royal United Services Institute in London, Justin Bronk, has tweeted what
he says is photographic evidence that MH17 was brought down by a missile strike.
The size of the shrapnel holes is consistent with what one might expect to see from an SA- 20

well as to Mr Angus Housten who is the Australian delegate at the recovery site.

I had anticipated to forward this correspondence a few days earlier but having received an email 20
from the Dutch government, last week, that it would provide a response within 2 days (to provide
an email address) but not having received it I view it better then to send it out now.

My view is that there has been a considerable disregard to the provisions of the Ukraine
constitution and it appears to me to be more than likely to be the cause of the violent conflicts. 25
And I view that all involved should first of all consider the terms of the Ukraine constitution and
act accordingly.

This correspondence is not intended and neither must be perceived to refer to all details and
issues but merely is some outline, and may be understood to pursue to end the conflict by all 30
concerned directing differences to the court of competent jurisdiction in Ukraine, as provided for
in the Ukraine constitution.

In my view, Russians outside the Russian Federation must be deemed to be subject to the
Russian constitution and as such cannot carry weapons in Ukraine or elsewhere either.
After all if Russian could do whatever they like outside the Russian Federation then they could
violate the Russian federation constitution at will, even against the Russian Federation. Hence,
the conduct of any person of the Russian federation must be both within and outside the Russian 5
Federation governed by the Russian Federation constitution. This means that those who
participated in Crime against the Ukraine government must be held legally accountable and so
likewise those who now are supporting the separatist.
In my view there is no such thing as to pick and choose what a person may or may not desire to
comply with in regard of a constitution as no one can be above the constitution. As such, anyone 10
acting in violation of the relevant constitution, including personnel of the armed forces and of the
government must be held legally accountable each under its relevant constitution.
.
In my view anyone who has a gain of common decency in his/her body will not accept that the
bodies of the victims are left to rot away in the field merely because of the fighting. The fighting 15
is to be stopped and the matter must be pursued before the Ukraine constitutional court. That is
why there is a constitution and also why there is a constitutional court.
.
As you are the President of Ukraine and the commander of the Ukraine armed forces I urge you
to consider the above and accept that errors were made by various persons and they need to be 20
resolved not with weapons but by litigation before the courts.
My intend with my 5-8-2014 correspondence was to seek to avoid further complications as there
would be no justice if police officers were to use weapons out of self-defence and then find that
despite an y legislation passed by the Ukraine government their carrying of weapons was
nevertheless in violation of the Ukraine constitution. However, now it is upon both the Ukraine 25
government and the Russian Federation to ensure the actual cooperation is provided for the UN
resolution that Mrs Julie Bishop Foreign Minister of the Commonwealth of Australians had
successfully placed before the UN (United Nations) and was adopted by a UNIFIED VOTE.

I look forwards to you passing on this correspondence to all listed in the heading of this 30
correspondence and to positively act towards my goal to bring peace and tranquillity to Ukraine
and have warring parties do the battle within the legal processes before the constitutional court.
After all that is why there are judges appointed to deal with constitutional issues
