met on or about April 16, 2012, and made various findings and recommendations

including the following:
Pursuant to Supreme Court Rule ("SC R") I I 7(2) the
Screenll1g Panel believes that Respondent is incapable of
the practice of law because of mental
Infirmity, illness or addiction. The Panel recommends
the filing of a petition with the Supreme Court seeking a
determination of the attorney ' s competency. Respondent
has been asked if he wishes to stipulate to the filin o of a

J" . The I NDB Chair has reviewed vanous materials to evaluate
the recommendation of the Screening Panel to file a petition with the Supreme
Court regarding a mental evaluation of the Respondent under SCR 117.

The State Bar Office has informed the NNDB Chair that the
Respondent may have a hi story of mental illness. The
DB Chair has been
informed that the Supreme Court issued an order on December 18, 2002, deferring
the admission of Zachary B. Coughlin as an attorney at law in this state. The
NNDB Chair has been informed that said deferral was at least partially based upon
a condition that Mr. Coughlin recei ve psychological counseling. The NUB Chair
has been informed that Zachary B. Coughli n was fi nall y admitted to practi ce law
on October 1, 2004.

Gar ounsel has reported to the NNDB Chair that the
investi gat ion of the grievances agai nst Respondent show a serious pattern of
misconductand bizarre behavior.

Bar Counsel reports that on ovember 30, 20II, Respondent
was found guilty, after a trial, ofthe offense ofPetit Larceny, a violation ofI MC
8.10.040, in the Municipal Court for the City ofReno. Said conviction was based
onan incident occurring on September9, 20II. Respondent shopliRed a candy bar
and cough drops with a value ofapproximately fourteen dollars ($14.00) from
INaI-Mart. Respondent appealed the judgment ofconvicti on. The judgment of
conviction wasaffirmed on appeal.
10. On November 30, 20II, Respondent was fo und to be in

II. On August 20, 20 II ,Respondent was arrested and charged with
Petit Larceny and Possession of Stolen Property, mi sdemeanors, for stealing a cell
phone. Respondent recorded his arrest and has posted the video on You-Tube.

12. On January 14, 2012, Respondent was arrested and charged
with Abusing 911 Emergency Servi ces, a gross misdemeanor. Respondent
recorded his arrest and posted the video on You-Tube. The video is posted at the

13. Concerning the criminal proceedings invol vi ng the charge
referenced in paragraph 12, above, Respondent tiled a document in the Reno
Justice Court, Case o. RCR20 12-065630, entitled," otice of Appearance, Entry

On
ovember 13, 10 II, Respondent was arrested by Reno
Police Department and charged with Tre passing, a misdemeanor. Respondent
recorded his arrest and has posted the an'est video on You-Tube. The internet
address of the video is: http: //www.youtube.com/ watch?v- s EOFWI-I FI EY
15. Respondent's trespass arrest arose after an eviction hearing
before Justice of the Peace Peter SfelTazza. Respondent was evicted from hi s
residence pe r order of the court effective November 1, 20 II. After being evicted,
Re pondent was later found living in the basement of the residence. The locks on
the res idence had been broken. The Reno Police tried to convince Respondent to
leave the premi ses; but he would not voluntarily leave. The owner kicked a door
open and Respondent was arrested therea fter.
Respondent filed a 36-page "Notice of Appearance as Co-Counsel and
Motion to Di smi ss" the trespa charge on March 5, 2012, in the Second Judici al
District Court, bearing Case No. I I CR 26405. A copy of the "moti on" is attached
as Exhibit 3 and incorporated by this reference.
The document is incoherem, confused and rambling.

On February 27, 2012, in the case ofCiry 0/ Reno vs. ZachG/y
Barker Coughlin, Reno Municipal Court Case
o. II TR 26800 21, a trial was
held on a traffic citation i sued to Respondent Coughlln. T
he matter was called at
approximately 3:00 p.m. and concluded without a verdict at about 4:30 p.m. after
the Court held Respondent in criminal Contenlpt f ti
o court or hi s behavior and
activities committed in the direct presence ofthe Counduring trial. Respondent' s
behavior is chronicled in the coun'scontemptorder which isattached as Exhibit 4
and incorporated by thi s reference.
17. On March 12, 2012, The Honorable Dorothy I ash Holme
found by "clear and convincing evidence" that Respondent Coughlin committed
numerous acts ofattorney mi sconduct. Judge Holines explains in her Order that
Respondent served a five-day Contempt ofCOLII1 anction impo ed by the Coun
on February 27, 2012. Thereafter, Respondent fax-filed to the Reno Municipal
Court a 224-page document. Judge Holmes found that the document contained
rambling references to hi s personal li fe and was incoherent. A copy ofJudge
Holines' Orderis attachedas Exhibi t5and is incorporated herein by this refcrence.
I . On December 14, 20II , Re pondent fil ed an Affidavit of
Povel1y in support of his Moti on to Proceed Informa Pauperi s. In hi s Affi da vit ,
Respondent alleges that he has almost no income and refers to himselfas being
employed as a "Jack of All Trades ." See, Exhibit 6 attached hereto and
incorporatedherein by this referenc .

On March 22, 2012, Respondent arrived at the Reno Municipal

20. Respondent has posted on You-Tube and on his law practice
webpage, under the moniker, 25TeddyJames, several vi deos. In the videos,
Respondent is seen driving in his car or sitting in pajamas discussing both the COLIrt
and its staff. In the videos, he states that a named police detective admitted taking
bribes from a named local attorney. He also discusses court staff and states how
much income they make.
21 . Respondent exhibited di turbing behavior in a prior case where
he was representing a client. On April 10,2009, Di strict Judge Linda Gardner of
the Second Judicial District Court executed an "Order After Trial," in Case I o.
DVO -01168. Judge Gardner stated in her order that the mo t troubling as pect of
the case was Respondent's rude, sarcastic and disrespectfu l presentati on at tri al;

discovery; and his lack of knowledge with regard to the rules of evidence and trial
procedure. All of thi s was compounded with a continuously antagoni stic

presentation of the case that resulted in a hift from a fairly simple divorce case to
a contentious divorce trial lasting an excessive amount of time.
22. During the course of the Respondent's variOUS criminal
proceedings before the lower courts, a case was referred to Di strict Judge Steven P.
Elliott of the Second Judicial Di strict Court for evaluation regarding Re pondent 's
mental competency to stand trial. After examination of the Respondent was
completed by two doctors, Judge Elliott entered an order finding that the
Respondent was competent to stand trial under RS 178.425. A copy of Judge
Elliott's Order is attached hereto as Exhibit 8.
Judge Elliott's deci s ion is not dispositive of the issue of
whether the Respondent is "competent" to practice law. The issue before Judge
Elliott focused only on the ability of the Respondent to stand tri al.

immediately pro\ ided.
Based upon the above infollllation received by the Chair of the
I orthem I evada Disciplinary Board, the Chair hereby asserts pursuant to Supreme

DB Chair hereby seeks a determination by this Honorable COLlrt of the
Respondent's competency and an order transferring the Respondent to disability
inactive status, thereby preventingthe Respondent from practicing law in the tate
ofNevada L1ntil such time as this HonorableCourtdetermines that the Respondent,
Zachary B. Coughlin, may resume his practiceoflaw underSCR I17(4).

Thematterwas calledat approximately3:00 p.m. and concludedwithoutaverdictabout
4:30p.m.afterthecourtheld the defendantin criminal contemptofcourtfor his behaviorand
activitiescommittedin the directpresenceofthis courtduringthe trial.
Thecourtfinds thatdefendant'scontemptuousconductconsistedofhis rude, sarcastic,
inappropriate, insubordinate,disrespectful, antagonistic, deceitful, disruptive, argumentative
andchildishbehaviorduringtrial, all ofwhich appeared to be done to vex and annoy the
court, the witness, andthe opposingparty, and to disruptthe trial process. The courtfinds
that the following occurred,and constitutecontempt: 1) defendant ' smime-like, clownish
anticsofmaking faces atthe court; saggingdown into his seatand hanging his head; looking
behind himselfand insidehis coatas ifsearchingfor abetterwayto askaquestion; rolling
his eyes; and mimickingotherswords; 2) defendant's incessantarguing with the court,
talking overthe court, and interruptingthe court; 3) defendant's repeatedlyrestating matters
after being told by thecourtto "move on"or"ask the next question; "4) defendant 's
repeatedl yinjecting allegationsofbri bery, perjury, and policeretaliationinto the matterafter
the court instructed hi m not to, and directed him tolimit himselfto i sues pertaining to the
fact softhe "Boul evard Stop;" 5) defendant's repeatedly trying to insert "Richard Hil l"into

Thecourt finds thatthe defendant'sactions were intentional and donein utterdisregard
andcontemptfor thecourt,andin the presenceofthe court, forpurposesofdisruptingand
delayingthe proceedingsand dishonoring the rule oflawand this court, and constitute the
misdemeanorofcriminalcontempt, aviolationof RS 22.0IO.Goodcauseappearing
therefore, the following sanctionsare imposed:
IT IS ORDERED, pursuantto NRS 22.100, that the defendantbe incarceratedat the
WashoeCountyRegional Detention Facility for the termoffive (5) days, from the time he
wastakeninto custodyonthis court'sorderon February27,2012,andthatsentenceshall not
be reduced for anyreason.In thealternative, the defendant maypaya fine of$500to the

DefendantZACHARYBARKERCOUGHLIN who, as memberNo.9473 ofthe evada Bar,
is anattorney representing himself, the defendant. The trial was continuedon Febmary27,
2012, when, aft erapproximatelyan hourandahalf, the defendantwas held in criminal
contempt by thecourt for his antics and misconductduring that trial. His behavioris noted in
detail in the court' s Orderentered on February 27, 2010.
Today, Mr.Coughlin fa iled to appear tocomplet e th is tria l. He has notcontacted this

a 224-page document entitled "Notice
of /\ppeal of Summary Contempt Order; Motion to Return Personal Property Confiscated by
Reno Municipal Court and Its Marshals; Motion for ew Trial and to Alter or Amend
Summary Contempt Order." The document purported to appeal this court's Order holding
him in direct criminal contempt. It contained a portion of one sentence on page 4 seeking a
continuance of today's hearing. but no further discussion of that topic . It also mentioned
being a "tolling" motion in an apparent afterthought. It did not address most of the other
topics listed in the caption, Instead, the document contained rambling references to his
personal life and this court's; his father's football career in college; dozens of pages of string
citations taken off the internet; documents from a prisoner online site; an article about a
"police state;" an anicle about Discovery; a website printout showing a police officer's salary;
and copy of court documents from a District of Columbia case.
It was a disjointed regurgitation of case law citations from a legal research on line si te
with little reference to, or argument about, the facts of his instant " l3oule vard Stop" traffic
case. The document was an incoherent and pathetic demonstration of what might once have
been legal and academic prowess that appears to now be greatly damaged. Mr. Coughlin 1'ax-
filed another document in which he apparently took a Motion to Proceed Informa Pauperis

February 27, 20 12 disrupted Department 3 of this court and caused distress to this court and
its statT and marshals, as well as the prosecutor and the witness, and resulted in Mr. Coughlin
being held in contempt of court, his faxing and tiling of these documents greatly Jisrupted the
operation of the entire Reno Municipal Court system, including the clerk's office and the
other departments, and necessitated that action be taken by the Court Administrator and
Administrative Judge.
Apparently beginning on March 9, 2012 at 12 :3 8 p.m., Mr. Coughlin again undertook
another massive fax-filing to Reno Municipal Court. This time it was a document that was
file-stamped by the clerk on March 12, 2012 at 8: 12 a.m. This second 218-page GOCW11ent
purported to be yet another motion in this case entitled "Motion to Return Cell Phones;
Motion to Set Aside Summary Contempt Order; and Notice of Appeal of Summary Contempt
Order. " With scant discussion of, or relevance to, the above-captioned matter, saiJ document
mostly argues against Judge Howard in a Department 4 case and again contains more than
200 pages of string legal citations; lyrics to rocks songs; Mr. Coughlin's personal family
history; discussion of an eviction case and another contempt case; disjointed legal citations,
and other nonsensical matters that have no apparent relevance to his traffic citation case.
80th documents were massive and took up a great deal of time because the court had to
review them to look for some connection to the case. This court has the inherent authority to
maintain respect, order and decorum in the court, and to refuse to al low the court to be useJ
as a \chick I"or the deranged rantings ofa litigant.

Based upon the total circumstancesofthis case, the in-court performanceofthe
defendant, as observedby this court, the written documents faxed to the court for tiling by
this defendant, the statementsand behaviorofthis defendantand his overall conduct herein,
this court finds, by clearand convincingevidence, that Zachary BarkerCoughlin,an att orney
licensedto practice law in the StateofNevada, has committed numerousacts ofattorney
misconduct, including, but not limited to, violating the following Rules ofProfessional
Conduct:
8.4(c)--eng3gingin dishonesty, fraud, deceit ormisrepresentation;
8.4 (d)--engaging in conductthat is prejudicial to the administrationofju tice;
3.3(a)-lack ofcandorto the court by knowingly making false statements to atribunal;
3. 1--defending in a proceeding by assertingorcontrovertingan issue wi thout abasis in
fact and with matters that are known to be frivolous;
3.2-failure to make reasonableefforts to expedite litigation, and, in fact, taking
extreme me3sures to delay litigation;

I, Scott Coppa ,Marshal of Reno Municipal Court, a court oflaw organized,
incorporated or existing under the laws of the City of Reno,
and with its principal business located at: 1 South Sierra Street, Reno. NY 89501.
Being duly sworn, do depose and say:
On March 22, 2012, approximately 1055 hrs, I (Marshal Scott Coppa) was notified
by central control to respond to Donna Ballard desk in reference to a Defendant
Zachary Coughlin.
Both Marshal Thompson and I met with Miss Ballard at her desk. She informed us
Coughlin has been at Daniel Casillas window #8 for approximately 15 minutes and
was becoming argumentative with court staff. Miss Ballard further stated the Staff
has answered all his questions as he was now becomi ng repetit ive with his
questions . At one point Coughlin demanded to have Casillas read the docket to hi m
word for word and that he was going to "depose" Miss Ballard.
Marshal Thompson and I approached Coughli n in the publi c hallway. As I
approached Coughlin I noticed that he was wearing red smi ley fa ce fl annel paj ama
bottoms and a white tee shi rt. Underneath the tee shi rt Coughli n al so had on a
dress tie and a dress shirt. I informed Coughlin all hi s quest ions have been
answered by court staff and it was time for him t o leave. Coughlin asked me " did
they tell you to tell me to leave." Coughl in then turned t o Casillas and asked if he
could talk t o him. Both Marshal Thompson and I again asked Coughl i n to leave.
Coughlin asked for our names, gathered his it ems from the counter and left the
Court.
