COMELEC RESOLUTION No.

201401
RATIFICATION OF ELECTORAL CODE 2014
Promulgated: 12 July 2014

WHEREAS, according to Article XV, Section 4 of the 2005 Constitution, The Ateneo
COMELEC shall have an electoral code, which should at all times be in full agreement with
this constitution. In the event of non-concurrence, this constitution shall supersede the
particular article or section of the electoral code. This electoral code shall be reviewed yearly
and revised accordingly by the current Board of Commissioners subject to Student Judicial
Court concurrence.
WHEREAS, according to Article XV Section 1 of the Electoral Code 2013, If any
provision of this Code is held invalid or unconstitutional, the provisions not affected thereby
shall remain in effect.
WHEREAS, certain provisions of the previously released Code were deemed to be faulty
and as such, amendments were made to the provisions in question, particularly:
1. Modification of Article II Section 1:
FROM:
The Ateneo COMELEC recognizes the students right to form political parties
(hereinafter parties). However, accredited parties shall be bound by the provisions
of the Electoral Code.
TO:
The Ateneo COMELEC recognizes the students right to form political parties
(hereinafter parties). However, accredited parties shall be bound by the provisions
of the most recent Electoral Code.

2. Modification of Article II Section 5b:
FROM:
All parties must maintain a minimum of 40 members at all times. All party members
must be officially enrolled as regular students of the Loyola Schools.
TO:
All parties must maintain a minimum of 40 members at all times. A list of members
shall be submitted to the Ateneo COMELEC at the start of every semester at the date
set by Ateneo COMELEC. All party members must be officially enrolled as regular

3. Modification of Article III Section 1 and its accompanying footnote:
FROM:
The Ateneo COMELEC shall allow candidates to run under coaltions.
Footnote 3:
Coalitions, as used in this document, shall be construed as temporary alliances for
campaign purposes among candidates.


TO:
The Ateneo COMELEC shall allow candidates to run under coalitions. Coalitions
are termporary alliances formed by candidates running for the current elections for
campaign purposes.

4. Modification of Article III Section 4:
FROM:
Candidates forming a coalition must inform the Ateneo COMELEC of their intention
to do so during the Filing of Candidacy. To do this, an accomplished Ateneo
COMELEC Form 2 V(Application for Coalitions Formation) must be submitted.
Candidates for the positions of president, Vice-President, Secretary-General, and
Finance Officer of the Central Board are prohibited from joining coalitions. Once
submitted, a proposal for the formation of a coalition is final and may not be
withdrawn. Signatories to it who have not met all the requirements for candidacy at
the time of its submission are prohibited from joining said coalition.
TO:
Candidates forming a coalition must inform the Ateneo COMELEC of their intention
to do so during the Filing of Candidacy. To do this, an accomplished Ateneo
COMELEC Form 2 V(Application for Coalition Formation) must be submitted. Once
submitted, a proposal for the formation of a coalition is final and may not be
withdrawn. Signatories to it who have not yet met all the requirements for candidacy
at the time of its submission are prohibited from joining the said coalition.

5. Modification of Article V Section 1:
FROM:
(Paragraph 3)For the duration of the campaign period, a candidate should not hold
any major position in any of the officially recognized extracurricular organizations of
the Loyola Schools (including-but not limited to-COA and COA-accredited
organizations, ARSA, DSWS, and DSLD). If the candidate in question does hold a
position, it is imperative that the said candidate take a leave of absence.
TO:
For the duration of the campaign period, a candidate should not hold any major
position

in any of the officially recognized extracurricular organizations of the
Loyola Schools (including-but not limited to-COA and COA-accredited organizations,
ARSA, and DSWS). If the candidate in question does hold a position, it is imperative
that the said candidate take a leave of absence. For Special Elections, if the candidate
currently holds a position in the Sanggunian as elected during the previous General
Elections, he/she may not run for any position unless he/she resigns from his/her
current position in the Sanggunian. However, the position he/she leaves will not be up
for Special Elections as stated in Article IX of this Electoral Code.

6. Modification of Article V Section 4c:

The Ateneo COMELEC shall release the official list of candidates two (2) working
days after the last day of the filing of candidacy period.
TO:
The Ateneo COMELEC shall release the official list of candidates at most two (2)
working days after the last day of the filing of candidacy period.

7. Addition of voting procedure in Article VIII Section 5:
b. The poll officer shall add the voters name and ID number in a log sheet.

8. Modification of Article IX Section 1.6:
FROM:
During the counting of votes, the only persons allowed in the immediate vicinity
where the votes are counted are the Ateneo COMELEC members and Office of
Student Activities professionals.
TO:
During the counting of votes, the only persons allowed in the immediate vicinity
where the votes are counted are the Ateneo COMELEC members, SJC
representatives, and Office of Student Activities professionals.

9. Modification of Article X Section 2a:
FROM:
Vacancies that occur in the Central Board and School Boards before the election of
freshman officers, with the exception of the positions of Sanggunian President and
School Board Chairpersons, shall be filled via a special election to be held
simultaneously with the Freshmen Year Officers Election.
TO:
Vacancies that occur in the Central Board and School Boards before the induction
of the new Sanggunian, with the exception of the positions of Sanggunian President
and School Board Chairpersons, shall be filled via a special election to be held
simultaneously with the Freshman Year Officers Election.

10. Removal of Article X Section 2b:
If the vacancy occurs before the induction of the new Sanggunian, the position shall
remain vacant until the special elections.

11. Modification of Article XI Section 1:
FROM:
The elections shall be declared valid only if at least 50% + 1 (rounded up to the
nearest whole number) of the constituency has cast their votes.
TO:
The elections shall be declared valid only if at least 50% + 1 (rounded up to the
nearest whole number) of the constituency for the certain position has cast their
votes.
Footnote 14:
Constituency refers to the students whom the candidate is directly serving.

12. Modification of Article XI Section 2a:


FROM:
In validating general elections, the constituency refers to the incoming sophomores,
juniors, seniors only. The votes of the graduating seniors, while not included in the
computation of the quota, shall be included in the tallying of votes.
TO:
In validating general elections, plebiscites, and/or referenda, the constituency refers
to the incoming sophomores, juniors, seniors only. Graduating seniors, for the reason
that they are no longer stakeholders of the incoming Sanggunian officers, will not be
allowed to vote.

13. Modification of Article XI Section 2b:
FROM:
In validating special elections, plebiscites and/or referenda, the constituency refers
to the incoming sophomores, juniors, seniors only. The votes of the graduating
seniors, while not included in the computation of the quota, shall be included in the
tallying of votes.
TO:
In validating special elections, plebiscites and / or referenda, the constituency refers
to all currently enrolled students who are constituents of the positions left vacant in
the General Elections. (i.e. all Freshmen and affected constituents)

WHEREAS, under Article XIV, Section 3b of the Constitution, the COMELEC is vested
with power to promulgate rules and regulations, as well as decisions and instructions,
regarding previously stated matters by virtue of a resolution;
NOW THEREFORE, pursuant to the powers vested in it by the 2005 Constitution of the
Undergraduate Students of the Ateneo de Manila, the Ateneo Commission on Elections
RESOLVED, as it hereby RESOLVES, to promulgate the amendment of the Electoral Code
2014 ratified on the 11
th
day of July 2014 by the Board of Commissioners.
