Purpose of Course ‘Many situations will require the ICE officer to process aliens for removal, Intreduction who have violated their legal status, who are undocumented aliens or who are aliens seeking entry into the United States. This process will require the officer to be familiar with applicable statutes, regulations, procedures and forms required to properly process an alien for removal proceedings. This course will concentrate on the foundation document for alien processing, the 1-213 Record of Deportable/ Inadmissible Alien. ‘The use of the I-213 creates a historical record of information which, ‘The BIA nuled in the since itis used as evidence in removal proceedings, must be complete Mater of Ponce- and aceurate. There are several different versions of Form 1-213 used in the Field Offices. However, they contain the seme basic format, and method of completion. ‘When interviewing in a field situation, the agent will often complete a “scratch” 213 as opposed to the “formal” 213 that ‘will be used as evidence. The differences are that the scratch 213 will be hand written and will not have a written narrative as will the formal 213. The narrative portion of the scratch 213 can be used for case notes and to collect information necessary for processing the alien that is not otherwise found on the 1-213. B, Inany of the data spaces, if the block is not applicable, write ‘NA’. If Field Tip: Information ‘more explanation is required, type “See Narrative”. Field Tip: Mate a habit of calculating and recording the subject's ‘age when recording the DOB. Date of Action - Date of apprehension, location or interview. Location Code - Your duty station code (three-letter code). Example: Atlanta = ATL At/Near — City where subject arrested. Date and Hour - Month, day, year and time located/apprehended. City, Province (State) and Country of Birth - Town ot city, state or province, and country of birth. AR — Alien Registration — Any alien that was lawfully admitted imo the U.S. (Le. LPR, Visitor, ete. is considered registered. Ifthe alien file DOES NOT have proof of registration (i.e. 1-94, Immigrant Visa), check the block shown. If an alien makes a claim to US. citizenship, alienage and deportability must be established prior to processing. An 1-213 can only be executed for INADMISSIBLE OR DEPORTABLE, ALIENS. Indicate in the narrative what claim was made, how alienage and removability was determined, and any documents used to support the claim. Criminal History: List a detailed account of subject's criminal history and disposition. Include State Identification numbers not noted in “FBI Number” or “Criminal History”. Health and Humanitarian Aspects: Full details should be recorded as fo health and humanitarian aspects of the case, such as close family ties in U.S., any health problems (1. positive tuberculosis test reaction), if subject is on public assistance or welfare, etc. Intelligence Information: Provide a detailed account of any additional information that is of intelligence value, such as information concerning subject's smuggler if he used one to enter the U.S., false documents or other related items. If subject has fraudulent social security card, note vendor information. The ICE officer/agent may also note intelligence information provided by subject that relates to other aliens in the U.S. Information conceming false documents should be as detailed as possible. In the case of documents, a description of the document, distinguishing security features (i.e., does not fluoresce, print is green, plastic is oily, ete.). Smuggling information should include as much information as possible about the: Arranger, smuggler and/or transporter, if not the same person (name, description, ICE ACADEMY 1-213 PREPARATION ‘Marcn 2006 Page 11 INSTRUCTOR GUIDE address, ete.) This notification must be effected regardless of the alien’s wishes. The officer will not notify the consular or diplomatic officer of any application by the alien for asylum or withholding of removal. The following information is provided to the ICE officer/agent as a guide in using Spanish names in alien processing B. The filing system for Spanish names used by ICE is based upon the names as they are used in Spanish rather than in the English system. It is, therefore, almost impossible to conduct a search by name with any degree of thoroughness if the name is not full and complete by Spanish standards. C. The basic difference between Spanish and English names is the fact that two last names are used in Spanish, whereas only one last name is used in English. The surname of the father goes before that of the mother and the two surnames may or may not be joined by the conjunction “y” or by a hyphen, ie., Jesus Garcia v Gonzales, Jesus Garcia-Gonzales, or Jesus Garcia Gonzales. D. This practice originated in Spain in medieval times when a coat of arms was based upon the two family names united in marriage. Ithas continued down to the present time. The inclusion of the second sumame is absolutely essential when processing someone of Hispanic origin. So many Hispanics have the same first name and first sumame that positive identification would be very difficult without the inclusion of the second sumame. For example, there are thousands of people with the name Jose Garcia. 'E. The addition of the second surname narrows the number of names to be checked. F, When processing an unmarried individual (male or female), i the father's surname should be written first followed by the mother's sumame and the first name in that order. The first and second surname should be separated with a hyphen, Example: Juan Ramirez-Canales - First Name ~ Juan Father's Sumame — Ramirez Mother's Sumame — Canales G. A Spanish female retains her father’s sumame after marriage ‘but she drops the surname of her mother. The surname of her ICEACADEMY T-213 PREPARATION ‘Marcu 2006 Page 15 father will be followed by the word “de” (NOT capitalized), The “de” is followed by her husband’s first sumame (the surname of his father). ‘Example: If a woman nimed Marcela Garza-Hemandez marries Juan Ramire2-Canales, her name becomes Marcela Garza de Ramirez. First Name ~ Marcela ‘Female’s Father’s Name ~ Garza ‘Husband’s Fathei’s Name — Ramirez HL In the event her husbeind should die, Mareela would then use the name Marcela Garza Vda. de Ramirez. “Vda.” is the abbreviation for “viuda” (widow). The English translation is ‘Marcela Garza, widow of Ramirez. I. The “de” which appears in the name of a married woman is not considered a part of her name but merely denotes the fact that she is matried. There are, however, maniy Spanish names in which “De,” “Del,” “De La,” and “Le” are an integral part and should not be confused with the “de” for marriage. Examples are “De Anda, Del Conde, De La Cruz, and De La Rosa.” In this instance, the “De” is capitalized. These names should be treated as one unit, not two separate names. Example: Paula Amaya De Jesus (single woman) First Name ~ Paula Father's Sumame ~ Amaya ‘Mother’s Sumame — De Jesus Rosa Morales de De Anda (married womai) First Name - Rosa Father's Suriame ~ Morales Husband’s Sumame~ De Anda J. In many Spanish first names, religious overtones are given to children by their parents. Such names as Maria de Lourdes and Maria de los Angeles are frequently encountered. These are first names, and should not be confused with sitnames. Riis also not unusual to find boys with a girl’s middie name, such as Jose Maria Velasquez-Rodriguez. The Maria is derived fom the Virgin Mary. L. Many Spanish names are pronounced alike ané spelled. Gifferently. Care must be taken to assure that every effort is made fo spell the names correctly. M. Ifthere is any difficulty in understanding or correctly spelling ‘a Spanish name, the subject should be asked to write the name. IV. SUMMARY REVIEW QUESTIONS: 1. Complete a FORMAL 1-213 (with narrative) on each of the following five individuals from the scenarios and attached documents. All attached documents can be assumed to be genuine. The instructor will spot check these 213s as you complete them. KEEP all six of your J-213s as you will use them azain during the Alien Processing Leb. ‘You must complete ail five scenarios. Scenarios Scenario 1 (Subject 95) ‘You have encountered 2 person who claims fo be Bdilberto Juan Hemandez Soto. Based ‘upon your interview, he has given you the following information. From his property at the jail, you have recovered the attached documents. Subject claims birth in Matamoros Mexico on 2/13/1976. He says he entered the US on 11/23/2005 12 miles west of Browasville, Texas, by swimming the river. He admits to paying an unnamed coyote $900. Subject has no papers to be in the US and has never filed any paperwork to be here Jegally. He claims no family living in the United States.
