RISK MANAGEMENT CASE STUDY Risk Management Case Study With the advent of the Internet users are frequently confronted with such cuttingedge issues as privacy, freedom of speech, consumer rights and innovation. There was a need for an organization which could protect users from the drawbacks of developing Internet technologies. Electronic Frontier Foundation (EFF) was founded in July 1990 in San Francisco, USA. This non-profit advocacy organization was created with the purpose of protection of the rights established by the Constitution and the Declaration of Independence regarding the emergence of new communication technologies. In the other words, The corporation was formed for the purpose of understanding and fostering the opportunities of digital communication in a free and open society (GuideStar). The scope of the organization includes support, design and development of new legislation in order to protect the civil rights of users, general requirements of censorship policies, diversity of communities, etc. Electronic Frontier Foundation exists by donations from individual members and corporations. All contributions to the organisation are tax deductible. Blending the expertise of lawyers, policy analysts, activists, and technologists, EFF achieves significant victories on behalf of consumers and the general public (Electronic Frontier Foundation Website). EFL protects the rights of consumers mainly in courts. During the one of the most significant law cases EFF addressed the court between Hotfile and Warner Bros, in which the latter is accused of deleting content, which did not have a copyright. EFF claimed that Warner Bros stifles free speech and denies users access to the legal Hotfile content.

Competition issues raised by the EFF are not hypothetical. Google has previously noted that 57% of all received DMCA requests come from competing companies. This trial is crucial for responsibility of owners who use the automatic removal of the content. Thus, Electronic Frontier Foundation thinks Warner Bros. has to pay for mistakes made by an automated campaign that ordered an online storage provider to take down content that Warner Bros. didnt own (Electronic Frontier Foundation Website This legal case had a significant impact on the reputation of Electronic Frontier Foundation.
