To: ECG. Subject: Interim Payment Certificates Delay.

Dear Sirs, With reference to the aforementioned subject and to Engineer correspondence ref. # 161-DETAC1699S received on February 20, 2014, kindly note the following: We again refer to Sub-Clause 4.2.8 of the LOA which states that: Settlement/Payment of lnterim Payments shall be within fifty two (52) calendar days from submitting the correct Interim Payments to the Consultant (7 days for Engineer + 45 days for Employer) (Emphasis added). Accordingly, the contractual duration for settlement of certificates starts counting from the date of submitting the correct Interim Payments by DETAC. Days in the aforementioned Sub-Clause 4.2.8 synonymies with (means) calendar days which include weekends and national vacations. This is due to the fact that Working Days are defined in Clause 1 of the LOA Definitions and Abbreviations as follows business days where usually banks are normally opened for business, excluding weekends and public holidays., while no definition for Days is included. Interim Payment statement is deemed correct when the Consultant does not request amendments within 7 days from the date of issue by DETAC of such statement to ECG. DETAC wishes to record that Engineer statements on the aforementioned correspondence, which state that Etisalat cash room did not receive Invoices No. 9 and 10 on the dates specified by DETAC on correspondence ref. # DTC-ECG-224 were inaccurate. In fact, correct Interim Payment Statement No. 8 / Invoices No. 9 [Attachment 01] was issued to Employers cash room on December 4, 2013, and Invoice No. 10 / Interim Payment Statement No. 9 [Attachment 02]) was issued to Employers cash room on January 12, 2013. The approval/settlement duration of 45 days granted by the Contract for Etisalat shall not restart, whenever there are minor adjustments that could be avoided or amended in the following certificates. Moreover, DETAC shall not be responsible for any delays caused by the working days of the Employers cash room. DETAC hereby requests the handing over of correct Interim Payment Statements on site to Employer Representative thereafter.

As such delay by the Employer is causing major disruption to the Contractors cash flow, therefore DETAC hereby reiterates its notice to claim the effects of such delay in settlement of Interim Payments as follows (as detailed by Attachment 03): Interim Payment No. 6 / Invoice No. 7 (correct submission to the Consultant attached [Attachment 04]): 1 day. Interim Payment No. 7 / Invoice No. 8 (correct submission to the Consultant attached [Attachment 05]): 2 days.

Interim Payment No. 8 / Invoice No. 9 (correct submission attached [Attachment 06]): 36 days.

This is for notification. Substantiation, of the resulting effects shall be forwarded for valuation in due course.
