Model Law Firm Policy Relating to the Use of the Internet Internet Access Services The Firm provides

access to the Internet from the desk-top and from computers in the library. This policy statement sets forth the Firms policies with respect to acceptable use of any Firm-provided Internet access resources (personal computers, browser software and communications lines to the Internet). To the e tent that Internet access is used to send or receive e-mail, this policy should be read with the Firms !olicy "elatin# to $se of %-&ail. Appropriate Use of Internet Access 'usiness $se The Firms Internet access resources are, like other resources of the Firm, first and foremost made available for Firm-related business. They can be used for work on client matters, practice and business development, associated research and other Firm matters. !ersonal $se The Firm reco#ni(es that use of the Firms Internet access resources for personal use may be necessary, )ust as personal telephone calls from the office may be necessary, and may be more efficient than usin# the telephone or leavin# the office to conduct personal business. !ersonal use of the Firms Internet access resources is permitted sub)ect to this policy. The capacity of the Firms communications lines to the Internet is not unlimited and, therefore, Firm-related uses have priority at all times. !ermitted $ses *ownloadin# of Te t and +ther ,on-% ecutable Files For Firm-related business, users, in their discretion, may download te t and other non-e ecutable files. $sers are encoura#ed, where possible, to download lar#e files (whether for Firmuses and always for personal uses) durin# off-peak periods (e.#., evenin# hours), when there is likely to be less con#estion on the Firms communications lines to the Internet. For personal use, users should -ttempt, where possible, to determine the si(e of a file before downloadin# and avoid downloadin# audio, video or #raphics files, or any other files that are in e cess of twenty pa#es.

Interactive .ites $sers of the Internet may need to access /eb sites or other Internet locations that re0uire user re#istration or for which a char#e is imposed. $sers also may need to access or upload information to other interactive sites, such as bulletin boards or private or public chat rooms. .ub)ect to the Firms !olicy "elatin# to $se of %-&ail (which prohibits subscribin# to personal listservs at the Firm, limits personal use to short messa#es and asks that users try to limit the receipt of len#thy personal messa#es from correspondents), access to such sites and locations is permitted in accordance with the followin#1

"e#istration usin# a Firm e-mail address is permitted.

/henever the user re#isters usin# a Firm e-mail address, participates in a listserv, enters a chat room, sends or otherwise uploads information, the inclusion of the domain name 2lawfirm.com3 indicates that the user is affiliated with the Firm. $sers should be sensitive to any such affiliation (whether implicit or e press) and, for uses that are obviously Firm-related, they must be authori(ed to en#a#e in interactions or upload information that identifies their relationship to the Firm. If a /eb site or other Internet location char#es for access or to obtain relevant information, users should char#e, or authori(e another to char#e, such fees to their Firm-issued or personal credit cards. /here such char#es are re0uired for access in connection with Firm-related matters, they are reimbursable in accordance with usual Firm policies and procedures.

!articipation in interactive #ames or in other similar interactive sites is not permitted for personal use.

!rohibited $ses Internet access from the Firm is prohibited for ob)ectionable activity and the followin# activities are e pressly prohibited1 -ccessin# (includin# browsin#) any se ually-oriented or other similar 2adult3 /eb sites, news #roups or other Internet locations. $sers are forbidden from undertakin# any other activity that is intended to cause se ually-oriented or other 2adult3 materials to be downloaded to, or to be otherwise associated with, the Firm.

*ownloadin# e ecutable pro#rams (e.#., self-e tractin# (ip files) or pro#ram modules (i.e., software applications or applets), or installin# e ecutable attachments to e-mail, e cept as authori(ed by the Information .ervices *epartment, to protect the Firms computer systems from viruses and to prevent incompatibility with Firm-provided software.

Confidentiality Considerations *isclosure of user information is inherent in Internet usa#e. $sers should be aware that they may be inadvertently disclosin# confidential information about themselves and the Firm to /eb site operators or third parties. !articularly when Internet usa#e is undertaken in connection with client-related matters, users should be aware that /eb sites and other Internet locations are capable of monitorin# and trackin# user-specific and Firm usa#e, the fre0uency and len#th of user visits, any items searched and any information that was retrieved and downloaded.

/hen /eb sites and other Internet locations re0uire information about the Firm or its resources as a condition of re#istration or access, users should not disclose sensitive or proprietary information. !rovidin# public information about the Firm is permissible, but users should clear any disclosure of proprietary information with the Information .ervices *epartment.

&any /eb sites use 2cookies,3 which are files that are sent to a users hard drive and allow Internet servers to keep track of specific user information. In the interests of maintainin# user privacy and the confidentiality of information about the Firm, its users and their usa#e patterns, the Firms Internet browser has been modified to re0uire the e press consent of the user before a /eb site is allowed to install a cookie on a users personal computer. In most cases, /eb sites remain fully accessible even when a user declines to permit the cookie to be installed.

Privacy 5onsistent with the tradition of the Firm, we respect the privacy of all users of the Firms Internet access resources. !ersonnel at the Firm do not routinely monitor users in their Internet-related activities. ,evertheless, all users are put on notice that the Firm tracks Internet usa#e and is aware of which sites (includin# the /eb, news #roups and other Internet locations) are visited by which users. It uses computer pro#rams to check for and lo# patterns of activity, routin# information and len#th of Internet access to 6

particular sites and locations, and has the capability to monitor the contents of uploads and downloads. -ccordin#ly, no user of the Firms Internet access resources has (or should e pect to have) any e pectation of privacy. (The Firm will, of course, respect its professional and le#al obli#ations not to disclose client confidences.) /hether for the purposes of mana#in# those resources and traffic flow, assurin# system security, verifyin# and ensurin# compliance of all persons with Firm policies or applicable law, or for any other reason, the Firm specifically reserves the ri#ht (from time-to-time or at any time), to intercept, divert, discard, access or review any Internet communication, other electronic communications or file, or any contents of such communication, or any other information created on, transmitted over or stored in Firm or service provider facilities, whether incomin# or outbound, and whether at the time of transit or thereafter. The Firm also reserves the ri#ht to disclose to other persons or otherwise use the contents of any Internet communication or any other electronic communications or file for any of the fore#oin# purposes, as well as for the purposes of complyin# with or assistin# law enforcement officials or le#al authorities who may, by subpoena, search warrant or otherwise, seek review of such communications, or for the purposes of liti#ation or other le#al proceedin#s. The only persons authori(ed by the Firm to intercept, divert, access, disclose or review any Internet communication, other electronic communications or file, or any contents of such communication, without the consent of the sender or recipient, is the *irector of the Firms Information .ervices *epartment.
