INTRODUCTION

The Planned Unit Development (PUD) of BAM Apartments (A Multifamily Residential


Development), consisting of 9.019 acres is located within the Northeast Quarter (NE/4)
of Section Twenty Three (23), Township Ten (10) North, Range Three West (R3W), of
the Indian Meridian (I.M.) in Cleveland County, Moore, Oklahoma. The subject property
is generally located South of SE 4th Street and adjacent to Eastern Avenue on the west.
2.0

LEGAL DESCRIPTION

The legal description of the property comprising the proposed PUD of BAM Apartments
is described in Exhibit A attached and is made a part of this Design Statement.
3.0

OWNER

The owner of this property described in Section 2.0 is BAM Investments, 1500 SW 35th
Street, Moore, Oklahoma, 73160.
4.0

SITE AND SURROUNDING AREA

The subject property is presently vacant. Surrounding properties are zoned as follows:
North: Zoned C4 District. Currently a portion of the land is developed.
East:
A portion Zoned R2 District. Single family residential development
A portion Zoned C4 District. Currently Undeveloped
South: Zoned C2 District. Currently developed.
West: Zoned R3 District. Single family residential development
5.0

CONCEPT

The concept for this PUD is a multi family residential development. This PUD will be
developed adjacent to a single family residential development located on the west side
of the property. Additionally, the property is abutting commercially zoned properties on
the north and south. There will be two points of access for the property from Eastern
Avenue. The locations for the access will be near the NE corner and SE corner of the
property. The proposed property will contain several three story residential buildings
that have 2 & 3 bedroom units. All amenities shall support this concept.
6.0

SERVICE AVAILABILITY

PUBLIC UTILITES/ACCESS

The planned unit development (PUD) has the following services available to serve the
site:

Eastern Avenue, abutting the east side of the property, will provide access to the
development. All access for the PUD shall be in accordance with the City of
Moores Fire Marshalls office.

Existing waterline main is located along the west side of Eastern Avenue. All
construction shall be in accordance with the City of Moore standards.
Existing Sanitary Sewer exists along the center of the property (approximately).
Sanitary sewer runs east west. All construction shall be in accordance with the
City of Moore standards.
Drainage runs from Northeast to Southwest into an earthen channel located
along the west boundary of the property. A portion of the area is in the FEMA
floodplain zone AE. The site shall meet FEMA criteria for building in Zone AE
areas and in accordance to any additional requirements of the City of Moores
Municipal Code, as amended.
A fire hydrant exists on the west side of eastern near the Eastern Ave. and SE 8th
Street intersection. Another Hydrant exists on the east side of Eastern Ave near
the intersection of Eastern Ave. & SE 9th Street.

FIRE PROTECTION

The nearest fire station to this property is located south on 1805 S. Eastern Avenue, just
north of the S. Eastern Avenue & SE 19Th Street intersection, which is a driving distance
of approximately 0.6 miles.
PRIVATE UTILITIES

Adequate service from the electric, natural gas, and phone companies are available for
the site and proper coordination of all utility service to serve the property will be made
during the development of this Planned Unit Development.
7.0

SPECIAL DEVELOPMENT REGULATIONS

The following Special Development Regulations and/or limitations are placed upon the
development of the PUD. Planning and zoning regulations will be those, which are in
effect at the time of development of this PUD. In the event of conflict between
provisions of this PUD and any of the provisions of the City of Moore Municipal Code,
as amended, the provisions of the PUD shall prevail and be controlling.
8.0

USE AND DEVELOPMENT REGULATIONS

The use and development regulations of the R 4 District shall govern this PUD, except
as herein modified, including conditional, special permit, special exception requirements
and/or accessory uses subject to their appropriate conditions and review procedures for
public hearings where applicable, unless otherwise noted herein.

9.0

SPECIAL CONDITIONS

The following special conditions shall be made a part of this PUD:

9.1

ARCHITECTUAL REGULATIONS
Exterior building wall finish on all main structures shall consist of a
minimum 25% brick veneer, masonry, rock, stone, stucco, wood, or other
similar type finish.

9.2

LANDSCAPING REGULATIONS
The subject parcel shall meet all requirements of the City of Moores
Landscaping Ordinance in place at the time of development.

9.3

LIGHTING REGULATIONS
To minimize light spillover on single family residential uses, outdoor lights
within any multi family tracts will be directed away from any adjacent
single family residential properties. To accomplish this, lights shall utilize
shields, shades, or other appropriate methods of directing light beams. All
lighting shall be in accordance with the City of Moores Municipal Code, as
amended.

9.3

SCREENING REGULATIONS
No less than a six foot and no greater than an eight foot high wall and/or
sight screened fence shall be required along the boundary of this parcel
where it is adjacent to any residential, commercial or industrial uses.

9.4

DRAINAGE REGULATIONS
Drainage improvements, if required, will be in accordance to applicable
sections of the City of Moores Municipal Code of Ordinances.

9.5

DUMPSTER REGULATIONS
Dumpsters shall be located within an area screened by a fence or
masonry wall of sufficient height that screens the dumpster from public
streets and residences.

9.6

ACCESS REGULATIONS
There shall be two access points from South Eastern Avenue to serve this
PUD. Curb cuts will be required and shall be in accordance with the City of
Moores Municipal Code, as amended.

9.7

PARKING REGULATIONS
The design and number of all parking facilities in this PUD shall be in
accordance with City of Moores Municipal Code, as amended.

9.8

SIGNAGE REGULATIONS
All signs within this PUD shall be ground (monument) signs and shall be in
accordance with the City of Moores Municipal Code, as amended.

9.9

ROOFING REGULATIONS
Every structure in this PUD shall have a pitched roof and have Class C
roofing or better.

9.10

SIDEWALK REGULATIONS
Five foot sidewalks shall be constructed on the street frontage or 6 foot
sidewalks shall be required if the sidewalk is constructed adjacent to the
curb, subject to the policies and procedures of the Public Works
Department. Four foot sidewalks shall be constructed on the interior
drives prior to any occupancy certificates being issued.

9.11

HEIGHT REGULATIONS
The base zoning district regulations shall regulate heights of structures in
this PUD.

9.12

COMMON AREAS/AMENITIES

Clubhouse
Pool
Pedestrian pathways

Maintenance of the common areas in the development shall be the


responsibility of the property owner.

10.0

DEVELOPMENT SEQUENCE

Developmental phasing shall be allowed as a part of the development of this PUD.
