Preamble WHEREAS it is expedient to define and amend certain parts of the law relating to contracts ; It is hereby enacted as follows "RE#I$INAR% - Short title ! Re0ocation of proposals and acceptances ! A proposal may be re0o3ed at any time before the comm,nication of its acceptance is complete as against the proposer$ b,t not afterwards( An acceptance may be re0o3ed at any time before the comm,nication of the acceptance is complete as against the acceptor$ b,t not afterwards( Ill,strations A proposes$ by a letter sent by post$ to sell his ho,se to 7( 7 accepts the proposal by a letter sent by post( A may re0o3e his proposal at any time before or at the moment when 7 posts his letter of acceptance$ b,t not afterwards( 7 may re0o3e his acceptance at any time before or at the moment when the letter comm,nicating it reaches A$ b,t not afterwards( Re0ocation how made ! A proposal is re0o3ed9 : by the comm,nication of notice of re0ocation by the proposer to the other party 9': by the lapse of the time prescribed in s,ch proposal for its acceptance$ or$ if no time is so prescribed$ by the lapse of a reasonable time$ witho,t comm,nication of the acceptance; 92: by the fail,re of the acceptor to f,lfill a condition precedent to acceptance ; or 94: by the death or insanity of the proposer$ if the fact of his death or insanity comes to the 3nowledge of the acceptor before acceptance( Acceptance m,st be absol,te !

In order to con0ert a proposal into a promise$ the acceptance m,st9 : be absol,te and ,n;,alified; 9': be expressed in Some ,s,al and reasonable manner$ ,nless the proposal prescribes the manner in which it is to be accepted( If the proposal prescribes a manner in which it is to be accepted$ and the acceptance is not made in s,ch manner$ the proposer may$ within a reasonable time after the acceptance is comm,nicated to him$ insist that his proposal shall be accepted in the prescribed manner$ and not otherwise; b,t if he fails to do so$ he accepts the acceptance( %- Acceptance by performing conditions$ or recei0ing consideration Performance of the conditions of a proposal$ or the acceptance of any consideration for a reciprocal promise which may be offered with a proposal$ is an acceptance of the proposal( <- Promises express and implied ! In so far as the proposal or acceptance of any promise is made in words$ the promise is said to be express( In so far as s,ch proposal or acceptance is made otherwise than in words$ the promise is said to be implied( CHA"TER II OF CONTRACT:, 9OIDA;#E CONTRACT: AND 9OID A=REE$ENT: =- What agreements are contracts ! All agreements are contracts if they are made by the free consent of parties competent to contract$ for a lawf,l consideration and with a lawf,l ob>ect$ and are not hereby expressly declared to be 0oid( /othing herein contained shall affect any law in force in )*India. and not hereby expressly repealed by which any contract is re;,ired to be made in writing') or in the presence of witnesses$ or any law relating to the registration of doc,ments( - Who are competent to contract ! <- Coidability of agreements witho,t free consent !
