the following is a translation from 'Fataawaa al-Albaanee' (a transcription of some of the cassettes of the shaikh) when the shaikh

was asked his opinion on jihaad. The Answer: " ith respect to !ihad" # m$ brother" in this time and before this time it is fard a$n" beca%se the problem at hand is not a problem of &osnia (alone) which has again mo'ed the emotions of the m%slim $o%th. For here we ha'e neighbo%ring %s" the !ews who ha'e occ%pied (alestine" and not a single )slamic co%ntr$ has mo'ed to establish the obligation of making !ihad with them" and e'icting them and throwing them in the sea" as some of or one of the presidents of the )slamic lands %sed to sa$. And the point is that !ihad is fard a$n" beca%se man$ of the m%slim lands ha'e been occ%pied in the past and the present b$ the k%ffaar. And the likes of this occ%pation is not hidden from the m%slim who concerns himself with the affairs of the m%slims" not to speak of the )slamic gro%ps or )slamic sects or )slamic lands. &%t !ihad has pillars and conditions" and we - the gro%p of m%slim scholars belie'e that the obligator$ !ihad is onl$ obligator$ %pon those m%slims who wo%ld help one another to establish what Allaah has obligated %pon them from the jihad against the k%ffaar" and e'icting them from the lands the$ ha'e occ%pied. And we do not need now to relate the e'idences from the &ook and *%nnah" for this point has no difference of opinion o'er it between the scholars - that jihad is fard a$n when an area of the m%slim land is occ%pied" so how abo%t when the occ%pation has occ%rred in man$ lands+, &%t" %nfort%natel$ ) wish to sa$ that this jihad which is fard - rather fard a$n is not possible to be established b$ indi'id%als as occ%rs in the -%estion" rather not e'en b$ some of the )slamic gro%ps. &eca%se the likes of this jihad" especiall$ in o%r times in which the means of fighting ha'e become man$" is not possible to be established b$ the )slamic gro%ps not to speak of indi'id%als, &%t the obligation is %pon the co%ntries" and those )slamic co%ntries that ha'e the strength to prepare for war" and the means of modern da$ warfare" b$ which if the$ gathered together sincerel$ for this jihad the$ wo%ld establish the fard a$n. &%t" 'er$ %nfort%natel$" these co%ntries ha'e not mo'ed a limb to establish this. *o ma$be the$ refer the matter of this jihad to the 'ario%s )slamic gro%ps and sects" while these are not capable of doing an$thing to stop the ad'ance.attack of the k%ffaar. And the c%rrent affairs bear witness to the fact that an$ )slamic gro%p that tries" either to fight the aggressor as occ%rred in

Afghanistan for e/ample" or b$ re'olting against the r%ler whose k%fr has become clear" like in Algeria for e/ample - then these %nfort%nate occ%rrences indicate that the indi'id%al jihad or gro%p jihad does not prod%ce the e/pected fr%it" and that is that the ord of Allaah be made s%preme. *o therefore" we belie'e that this !ihad is not possible e/cept %nder an )slamic a%thorit$ firstl$" and %nder an )slamic gro%p comprising of people from different lands" not j%st one land or one region. And add to this the necessit$ that ta-wa of Allaah be present" b$ sta$ing awa$ from what Allaah has prohibited from the matters that are well known amongst the m%slims" b%t %nfort%natel$ the$ are 'er$ far from p%tting into practice. And we ha'e mentioned - and ) am tr$ing to s%mmarise m$ words as m%ch as possible - man$ times that what has befallen the m%slims toda$" this h%miliation and abasement.ignomin$ that has not been known in the histor$ of )slaam at all" is that the m%slims ha'e misapplied" at the 'er$ least" one 'erse of the 0%raan....and that is the sa$ing of Allaah" "if $o% help Allaah" Allaah will 1elp $o%." And there is no do%bt that this 1elp of the m%slims from Allaah" is 1elp in making the 2aws of the *hariah an obser'able realit$" and this %nfort%natel$ is not realised in the majorit$ of the )slamic lands" or in the m%slim indi'id%als. And those amongst the m%slim lands that do ha'e some remnants of r%ling b$ the 2aw of Allaah ha'e not" %ptil now proclaimed the call to !ihaad. And d%e to this the m%slim indi'id%als and nations will remain weak as long as none of the )slamic lands lift the flag of !ihad" and that !ihad which calls for fighting those nearest them" not those that are far far awa$. For the m%slims" with their lands" and gro%ps" and sects" and as indi'id%als" if the$ cannot establish !ihad with those that neighbo%r them or are close to them then the$ are not capable of making !ihad with those that are distant from them....for e/ample 3ritrea" "*omalia" &osnia and 4echn$a. And d%e to this we mention now" that it is %pon the 5%slim $o%th as indi'id%als and gro%ps and sects that the$ spread the correct )slamic awareness in the lands firstl$" and then in the r%lers secondl$ - and that (correct %nderstanding) is that all of these people r%le b$ what Allaah has re'ealed. The r%ler that he r%les b$ what Allaah has re'ealed and ordered. The indi'id%al that he r%les b$ what Allaah has re'ealed... ) know that toda$ man$ of the indi'id%als" and gro%ps and sects" throw the responsibilt$ (of the state of affairs) onto the r%lers onl$" while in m$ certain belief the responsibilit$

e-%all$ falls %pon these indi'id%als" gro%ps and sects" as it falls %pon these r%lers, This is beca%se these go'ernments arose from the lands of these m%slims.....these m%slims who were addressed b$ two hadeeth from the 5essenger (sallallaah% 6alaihi wasallam) ....the first his (sallallaah% 6alaihi wasallam) sa$ing"'when $o% deal with interest" and hold fast to the tail of the cow" and become contented with agric%lt%re" and $o% lea'e !ihad in the a$ of Allaah" Allaah will permit $o%r h%miliation and will not lift it from $o% %ntil $o% ret%rn to $o%r deen.' And the second hadeeth" his (sallallaah% 6alaihi wasallam) sa$ing" '"the nations s%mmon each other %pon $o% as $o% call g%ests to eat from a plate of food"" the$ said " "will we be few in n%mber on that da$ # 5essenger of Allaah+" 1e said" "no rather $o% will be man$ on that da$" b%t $o% will be like the foam on the ocean. And Allaah will remo'e the fear in the hearts of $o%r enemies and place in $o%r hearts al-wahn". The$ said" "what is al-wahn # 5essenger of Allaah+" 1e said" "lo'e of this world and hatred of death."' And these occ%rrences which are mentioned b$ the 5essenger (sallallaah% 6alaihi wasallam) in this hadeeth ha'e now occ%rred in e'er$ m%slim societ$" and the$ are from the clear afflictions that necessitate the descent of this h%miliation %pon the m%slims %ntil the hearts of the r%lers" and indi'id%als become totall$ co'ered in black (d%e to their sins). The m%slim lands do not r%le b$ what Allaah re'ealed" and if there is one amongst them that does (claim to) r%le b$ what Allaah re'ealed" then the first clear indication that it does not r%le b$ what Allaah re'ealed is that it does not raise the call for !ihad. *o if this time is not the time in which !ihad in the a$ of Allaah does not become obligator$" and man$ of the m%slims lands ha'e been occ%pied" then when will this !ihad become obligator$+ &%t the problem - and this is the heart of the matter - is that there is no one amongst %s who is capable of %ndertaking (this jihad)" wh$+.....&eca%se we are drowning in sins" and drowning in sectarian differences and national differences" and we know that one of the doorwa$s to weakness and defeat is that the m%slims differ amongst themsel'es. And we ha'e been tried recentl$ with a 'er$ sad trial" and that is the Afghani !ihad" where we were hoping that its endpoint wo%ld be 'ictor$ for the m%slims" and there were strong signs for placing the seed of the )slamic state. Then the end and res%lt t%rned o%t to be totall$ opposite (to what was hoped) d%e to the earl$ signs of 'ictor$ o'er the enem$" the comm%nists (sh%$%i$$een)" diminished when the differences between the tribes made them split into se'en gro%ps" and their )slam which the$ took as deen did not pre'ent them from doing this" and o%r 2ord sa$s" "and do not be from the

m%shriks. From those that split their deen and became sects" each sect rejoicing in what it has." Therefore" it is %pon the one who desires to go on !ihad that he gets the means of jihad" and the means of a-%iring 'ictor$" and that is not realisable in o%r times %nfort%natel$. And Allaah sa$s in the 7oble 0%ran" "indeed Allaah will not change the state of a people %ntil the$ change what is in themsel'es." Therefore we call the 5%slim indi'id%als" and gro%ps and sects" not to speak of the go'ernments that the$ concern themsel'es b$ spreading the p%rified" a%thentic )slam" p%rified from e'er$ sp%rio%s element that has entered it with the passing of time" and then bring %p the m%slims on this p%rified )slaam. The da$ when these signs begin" and become clear in this 'ast )slamic land" that da$ shall the signs of getting read$ to establish this fard a$n !ihaad begin. These an/io%s indi'id%als that go to man$ of the m%slim lands in'aded.attacked b$ the k%ffaar like &osnia and 4hechn$a for e/ample..... what are the weapons that the$ ha'e with them+ who are the leaders who can discipline them and make them fight %nder one a%thorit$ and %nder one flag+ *o if there was a single a%thorit$ then we wo%ld see the (fr%its) of the !ihad as we saw them in Afghanistan (i.e 'ictor$ o'er the aggressor) Therefore Allaah sa$s" "and prepare for them what $o% can from stength and weapons to strike fear into the hearts of the enemies of Allaah and $o%r enemies". here is this preperation+, And who is the one capable of this preparation+ The indi'id%al+, 7o" the go'ernments+...$es the go'ernments" and it is possible for %s to sa$ that the$ do establish a small amo%nt of this preperation.....b%t this preparation is taken from their enemies..... so if there was a jihad established between the kaafir and m%slims" then soon these m%slims wo%ld not be capable of s%ppl$ing their armies with the necessar$ weapons e/cept b$ b%$ing them from their enemies. *o can their be 'ictor$ and !ihad b$ b%$ing weapons from the enemies of the m%slims+, This is impossible" and d%e to this" this preparation ordered %s" cannot be established e'en b$ the )slamic co%ntries" beca%se the )slamic co%ntries b%$ their weapons of destr%ction from their enemies and aggre'iated states. And there are wa$s of making these weapons malf%nction when the$ (the m%slims) intend to %se then against the kaafir enem$. And d%e to this ) sa$" and ) finish m$ words and repl$ %pon this -%estion that Allaah" when 1e said"

"And prepare for them what $o% can...." this address was to the 4ompanions of the (rophet (sallallaah% 6alaihi wasallam) " then the address is directed to the generalit$ of m%slims d%e to the generalit$ of the te/t. &%t this address was directed to the *ahaabah after the$ were bro%ght %p on the a%thentic )slamic %pbringing %ntil it was possible for them to establish the likes of this address - preparing the worldl$ might after preparing the spirit%al might in themsel'es or with themsel'es" d%e to the %pbringing the$ went thro%gh at the hands of their (rophet (sallallaah% 6alaihi wasallam) . And histor$ repeats itself.....*o there has to be an %pbringing of a nation from the )slamic nations so that is ma$ be possible for this nation to establish this worldl$ preparedness" and we toda$ do not find a nation that has established this obligation which we can depict in two words: tasfi$$ah (correction) and tarbi$$ah (ed%cation.c%lti'ation). (8ather) we see %s as scattered indi'id%als here and there. And if there were a gro%p" and o'er this gro%p a leader who has the allegiance of all the m%slims" and he raises the flag of !ihad against the enemies: this has not happened $et" and d%e to this we call for the e/istence of this introd%ction.predicate to this hol$ !ihaad. And as for r%nning (of these people) behind emotions when the spirit%al jihad has not e'en been realised in them - and that is the correct %nderstanding of )slaam" and appl$ing it collecti'el$" and that there be o'er them a leader after that" and he enjoins them to prepare what the$ can from strength and weapons: *o the da$ we see the likes of this" that da$ the m%slims will rejoice in the 'ictor$ of Allaah" and Allaah 1elps whom 1e ills. This is m$ answer to $o%r -%estion."

The disc%ssion starts with al-!ihaad s%pporter :-

Al-jihad s%pporter : e ha'e no do%bt that $o% are one of the first of the scholars in the cent%r$ to call for the ret%rn to the %nderstanding of the *alaf.

There is no do%bt that the iss%e of jihad is an iss%e of disagreement among those who follow manhaj as-*alaf assali9. )n the iss%e of jihad" we call the people to fight jihad %nder two conditions : The first is that is has to be done in p%re intention for the sake of Allah. The second that it has to be %nder the banner of )slam. 1owe'er we hear from the de'o%t m%slim $o%th other conditions that the$ narrate from $o% which we ne'er heard abo%t in hadith" s%ch conditions are )slamic knowledge (or 3d%cation and p%rification Tasfi$ah wa Tarbi$ah) and ha'ing :hilafa or an )slamic state. These conditions we hear a lot from the brothers who follow manhaj as-*alaf" and ) am among those who follow this manhaj insha' Allah. 5$ 0%estion is : do these conditions ha'e an$ reference in the *%nnah + or are the$ onl$ an ijtihad regarding the c%rrent sit%ation and;or conditions+ and before that do $o% reall$ call for these conditions+

Al-Albani : first of all" we agreed to disc%ss this iss%e with $o% to find o%t abo%t $o%r da<wa. Al-jihad s%pporter : ) told $o% abo%t it. Al-Albani : Then" e/plain $o%r da<wa. =o%r -%estions are premat%re now" ) want to %nderstand what $o% da<wa is for. Al-jihad s%pporter : m$ da<wa is clear" to do jihad according to the conditions ) mentioned. )ntention beca%se the prophet :A said "whoe'er fo%ght for the word of Allah to be the higher word is fi sabeel Allah". >nder the banner of )slam beca%se the prophet :A said "whoe'er fo%ght for the sake of <asabi$ah s%pporting one gro%p or fighting another and died" he died the death of jahili$ah." Al-Albani : #:. ?o we need an Amir to do jihad + Al-jihad s%pporter : 7o. Al-Albani : so we do jihad in a big disorgani@ed mess + (Arabic : Fawda) Al-jihad s%pporter : 7o ... b%t Al-Albani : Also" $o%r first condition which is the p%re intention. This condition in e'er$ worship so we are done with it. =o%r second" %nder the )slamic banner" do $o% imagen jihad witho%t an Amir+ how can we ha'e an )slamic banner witho%t an Amir for that banner + Al-jihad s%pporter : e can do jihad in this manner like if a m%slim goes to a

kafir enem$ leader" and kills him. Al-Albani : &%t we were talking abo%t the jihad of a gro%p. !ihad %nder an )slamic banner is it the jihad of one person or the jihad of a gro%p + Also" a gro%p of 5%slims that lea'e for jihad" do the$ not need an Amir to lead them + Al-jihad s%pporter : =es" $es of co%rse. A gro%p of 5%slims who tra'el or lea'e for jihad need an Amir. and )f a gro%p of 5%slims of more than < lea'e for !ihad the$ need an Amir. Al-Albani : Then wh$ did $o% not mention this as a condition+ Al-jihad s%pporter : well" oka$" let %s make it a third condition. Al-Albani : #ka$ for the Fard <a$n jihad" do we need a jama<a for it or can it be done as indi'id%als + Al-jihad s%pporter : 3ither case. Al-Albani : This is not an answer. Al-jihad s%pporter : wh$ is that + Al-Albani : e said that jihad is two kinds : Fard :ifa$ah" which onl$ a small gro%p of 5%slims can do" and if a gro%p do it" the rest of the 5%slims are not -%estioned abo%t it. This kind of jihad indi'id%als can do on their own. Fard <a$n which A22 the 5%slims ha'e to do it in a specific area. To do this kind of jihad" do we not need an Amir to lead the 5%slims + Al-jihad s%pporter : $es we need an Amir for this gro%p if it fights or if it doesn't fight. Al-Albani : Aood Aood" we ret%rn to sa$ Amir to mean a :halifa of the 5%slims. Al-jihad s%pporter : no not a khalifa. Al-Albani : h$+ is it dangero%s to sa$ khalifa+

Al-jihad s%pporter : =es of co%rse" beca%se this means we want to reap the fr%it before we plant the trees. Al-Albani : This is what ) see $o% doing. =o% sa$ $o% want an Amir for the whole gro%p of 5%slims to lead jihad and at the same time $o% don't want him to be the khalifa, is this what $o% want + Al-jihad s%pporter : well" $es.

Al-Albani : ,, #ka$ then where is this Amir+ and who is this Amir+ and can we ha'e more than one Amir+ e are now on the condition we agreed on before" which is that we need an Amir" and $o% claim that we need an Amir to lead this gro%p jihad witho%t him being the khalifa. hich do we get first" the Amir or the jihad + this is like asking do we pra$ before the athan or after. which comes first + Bafter a while of arg%ing aro%ndC Al-jihad s%pporter : #ka$ we do need an Amir for the Fard <a$n jihad before we start the jihad. Al-Albani : 3/cellent. Then do we call to ha'e an Amir first" or do we call for the jihad first. Al-jihad s%pporter : well" both at the same time. Albani : la hawla wa la -%waata illa billah. e j%st agreed that we need an Amir for !ihad al-<a$n before we start the jihad. The ne/t -%estion is do we call for an Amir First or do we call for the jihad first+ This gro%p" all kinds of gro%ps need an Amir. To call for this kind of jihad we do need an Amir first" the Amir will call for the m%jahideen and send those here and those there. Al-jihad s%pporter : oka$ what if a gro%p of 5%slims read in the 0%ran abo%t jihad and want to do jihad" so the$ gather for jihad and then appoint an Amir on them. Al-Albani : =a akhi what $o% are describing is a case of jihad Fard al-:ifa$ah. For Fard Al-:ifa$ah it is oka$ for a small gro%p to gather and go do jihad. For Fard al-<a$n we need the whole gro%p of 5%slims. 1ow can we ha'e to the whole gro%p of 5%slims if we don't ha'e a %nified leadership for this kind for jihad+ This kind of Amir" ) do not see an$ of the 5%jahideen calling for it. h$ do $o% not call for that Amir+ Al-jihad s%pporter : #ka$ then let %s call for this Amir. Al-Albani : #:" then what are the characters for this Amir" in $o%r opinion+ Al-jihad s%pporter : Bsome characters C Al-Albani : and do $o% see an Amir with these -%alities + Al-jihad s%pporter : $es" man$. Al-Albani : where + Al-jihad s%pporter : e'er$where. Al-Albani : e said that we need an Amir for the whole gro%p" ie for all the

5%slims. 1ow can we ha'e more than one Amir for all the 5%slims + Al-jihad s%pporter : ... Barg%ing aro%ndC Al-Albani : do $o% know what does the hadith of 1%tha$fah bin $aman (fa in lam $ak%n lahom jama<a wa la imam) sa$ abo%t this" does it lead to the concl%sion that this jihad needs a khalifa" or otherwise + Bhadith narrated in b%khari " :itab al-mana-ib" hadith D<<<E hadith sa$s hen people were asking the prophet abo%t the goodness" i was asking abo%t the e'il in fear that it ma$ get to me" so ) asked "oh prophet of Allah we were in jahili$ah then Allah bro%ght this goodness" will there be an$ e'il after it+" the prophet said "$es there will"" ) said "will there be goodness after it+" he said "$es and it has some imp%rities" i asked "and what are its imp%rities+" he *A said " people who g%ide witho%t m$ g%idance" $o% know of them and den$." ) asked "is there e'il after this goodness+" he said "$es" there will be preachers who preach for the doors of hellfire" whoe'er answers them the$ throw him into hellfire" so i said "oh prophet of Allah" describe them for %s" he *A said "the$ are from % and the$ speak from o%r lang%age." so i asked "what sho%ld ) do if i witness that+" the prophet *A said "stick with the gro%p of 5%slims and their leader" i asked "what if the$ had no leader+" he said "if the$ had no leader or imam" then lea'e all these gro%ps e'en if $o% had to bite on a tree %ntil $o%r death."C Al-jihad s%pporter : what does this hadith ha'e to do with o%r disc%ssion+ Al-Albani : did 1%tha$fah not ask the prophet abo%t what to do when there are callers to the doors of hellfire + the prophet answered that he m%st stick to the imam of the jama<a" if there is no imam then let him sta$ awa$ from e'er$ jama<a. ?o these conditions appl$ to toda$+ do we not ha'e people who claim to be 5%slims $et the$ are callers to hellfire+ is :hilafa not missing + Al-jihad s%pporter : ) prefer to to disc%ss other hadiths" like "there is still a portion of m$ nation fighting for the right" the$ do not care whoe'er disagreed with them or let them down." Al-Albani : hat does this ha'e to do with o%r disc%ssion+ e are not in disagreement abo%t calling for jihad. e are in agreement that jihad is a an obligation (Fard <a$n) toda$" what we disagree on is that do we need a khalifa first or not. hat $o% -%oted adds nothing to the arg%ment. e both agree that jihad is a Fard. ?o $o% %nderstand+ hat we disagree abo%t is the iss%e of needing a khalifa to start this jihad. Al-jihad s%pporter : #:. Al-Albani : notice that the prophet ad'ised 1%tha$fah to stick with the imam

of the 5%slims and their main gro%p. =o% ha'e that all the conditions in that hadith are tr%e toda$ .. Al-jihad s%pporter : tr%e ... Al-Albani : and the prophet said if the 5%slims had no imam or jama<a" to lea'e all the gro%ps. so what do $o% do now + Al-jihad s%pporter : well" we tr$ to look for the gro%p of 5%slims and find an imam for it. Al-Albani : this is what we call for, jihad is fard" b%t right now is not the time for it. e need the imam first and that the prophet ordered $o% to follow and stick with his gro%p. Al-jihad s%pporter : 1ow do we know that we can not do jihad %ntil we get this khalifa that is indeed necessar$ + Al-Albani : the hadith sa$s if the 5%slims had no one leader then lea'e all the gro%ps. And we alread$ said before that the jihad for fard al-<a$n has to be done the jama<a led b$ a leader to all the 5%slims" an Amir. )f the 5%slims had no leader the$ sta$ awa$ from A22 gro%ps. 1ow can the$ do gro%p jihad if the$ sho%ld at the same time sta$ awa$ from all gro%ps+++ $o% are contradicting what $o% alread$ agreed on. islamicall$ we ha'e onl$ one banner" one gro%p and one leader. e do need this one gro%p to start the fard al-<a$n jihad. Al-jihad s%pporter : ... Al-Albani : now what ) want to do is pro'e to $o% that this Amir of the fard <a$n jihad m%st be a khalifa" not j%st an Amir. The dallel is the hadith of 1%tha$fah again. *ometimes as $o% know the e'idence is clear and sometimes not 'er$" (-at<i al-dilalah" or thahiri al-dilalah). 2et %s consider an e/ample of a *haikh ad'ising his st%dent on the g%idelines of this hadith. The st%dent asks his *haikh what to do to to a'oid the e'il" the *haikh sa$s stick with the imam of the 5%slims. The st%dent answers that the 5%slims ha'e no khalifa" so the *haikh ad'ises him to sta$ awa$ from all the gro%ps. This st%dent is obedient to his *haikh and this *haikh that is following his prophet. what wo%ld this st%dent do+ he wo%ld go ahead li'ing his life in a 'alle$ looking after his sheep or whate'er" worshiping Allah. here is jihad+ if it was a wajib on this m%slim to fight then the *haikh wo%ld tell him to fight" and not to sta$ awa$ from e'er$ gro%p. is there a jihad here+ as long as there is no imam then there is no jihad. This e'idence is 0at<i al-?ilalah. !ihaad m%st be in the s%per'ision of an )mam" or khalifa. &%t let me tell $o% abo%t some thing that tro%bles man$ of the st%dents of knowledge" that there are man$ gro%ps that fight like the afghan or those in *$ria a decade or more ago.

Those people" if the$ want to fight the$ m%st be %nder the leadership of one Amir" that doesn't mean that *$rians fight in Afghanistan and afghanis in *$ria" no. )t means that both fighting gro%ps m%st be %nder the s%per'ision on one )mam and one khalifa. )f there was no one imam and no one jama<a (not in the meaning of two fighting gro%ps" b%t in the meaning of one gro%p in their %nit$ of leadership" b%t co%ld be more than one gro%p of fighters each fighting in a part of the )slamic world)" both gro%ps wo%ld be operating on their own. To do this fard <a$n jihad" the wajib of the 5%slims is %nit$" the %nit$ needs a khalifa. kills himself along with ten" or a h%ndred" or two h%ndred other people" then )slaam will not benefit b$ that" since the people will not accept )slaam" contrar$ to the stor$ of the bo$. 8ather it will probabl$ j%st make the enem$ more determined" and this action will pro'oke malice and bitterness in his heart to s%ch an e/tent that he ma$ seek to wreak ha'oc %pon the 5%slims.
