GREETINGS:
WHEREAS, the Petition docketed as GR. No. 210255 filed on
December 20, 2013 involves a class suit challenging the validity of private
respondent MERALCO's automatic rate adjustments and increases, which
was allowed by public respondent Energy Regulatory Commission.
WHEREAS, a similar Petition was filed a day earlier by several party-
list representatives in Congress, questioning the Energy Regulatory
Commission's approval of MERALCO's proposed rate hike to recover its
generation costs for November 2013. This was docketed as GR. No. 210245.
WHEREAS, considering the allegations contained, the issues raised
and the arguments adduced in the Petitions, it is necessary and proper to:
a) CONSOLIDATE GR. No. 210255 with GR. No.
210245;
b) REQUIRE petitioners in G.R. Nos. 210245 and 210255
to submit a soft copy of their Petition by compact disc
(CD) pursuant to the Efficient Use of Paper Rule in A.M.
No. 11-9-4-SC dated November 13, 2012;
c) REQUIRE petitioners in GR. No. 210255 to submit (1)
proof of authority of Rodrigo C. Domingo to sign,
execute, verify and deliver the Petition and other papers
and instruments he may deem appropriate and necessary
on behalf of petitioner Federation of Las Pifias

Homeowners Association (FOLPHA); and (2) a certified
true copy of the assailed Order of the Energy Regulatory
Commission dated December 9, 2013;
d) REQUIRE the respondents to file their respective
COMMENTS on the separate Petitions on or before
January 8, 2014;
e) GRANT a TEMPORARY RESTRAINING ORDER
effective immediately and for a period of sixty ( 60) days,
enjoining (1) respondent Energy Regulatory
Commission, its agents, representatives, or persons acting
in its place and stead, from implementing its December 9,
2013 Order and acting further on the letter-request of
MERALCO dated December 5, 2013; and (2) respondent
MERALCO, its agents, representatives, or persons acting
in its place and stead, from increasing the rates it charges
to its consumers based on the matters it raised in its
December 5, 2013 letter;
t) SET THE CASES FOR ORAL ARGUMENTS on
January 21, 2014, Tuesday, at 2:00 o'clock in the
afternoon at the New Session Hall, New Supreme Court
Building, Padre Faura St., Ermita, Manila;
g) REQUIRE the PARTIES to fully comply with the
Efficient Use of Paper Rule in A.M. No. 11-9-4-SC dated
November 13, 2012, especially with respect to Supreme
Court bound papers; and
h) REQUIRE the RESPONDENTS to serve copies of their
COMMENTS on the petitioners personally.
NOW, THEREFORE, effective immediately and for a period of sixty
( 60) days, (1) respondent Energy Regulatory Commission, its agents,
representatives, or persons acting in its place and stead, are hereby
ENJOINED from implementing its December 9, 2013 Order and acting
further on the letter-request ofMERALCO dated December 5, 2013; and (2)
respondent MERALCO, its agents, representatives, or persons acting in its
place and stead, are hereby ENJOINED from increasing the rates it charges
to its consumers based on the matters it raised in its December 5, 2013 letter.
