stipulateandagreeas follows:
1. Respondentadmitsthejurisdictionof theDivisionoverRespondentandoverthe
subjectmatterofthisaction.
2. RespondentacknowledgesthatRespondententersintothis Stipulationknowingly and
voluntarily.

3. RespondentunderstandsthatRespondenthastherightto berepresentedby counselin
thismatterandRespondent'ssignaturebelowsignifiesthatRespondenthaseitherconsultedwith
anattorneyorRespondentwaivesRespondent'srightto counsel inthismatter.
4. RespondentunderstandsthatRespondentisentitledto ahearingbeforetheStateof
Utah'sBoardof Nursing("Board"),orotherDivisionPresidingOfficer,atwhichtime
Respondentmay presentevidenceonRespondent'sownbehalf,callwitnesses,andconfront
adversewitnesses. Respondentunderstandsthatby signingthisdocumentRespondenthereby
knowinglyand intelligentlywaivestherightto ahearing,therighttocall witnesseson
Respondent'sownbehalf,therighttocallwitnesses,therighttoconfrontadversewitnesses, and
anyotherrightstowhich Respondentmay beentitledinconnectionwithsaidhearing.
Respondentunderstandsthatby signingthisdocumentRespondentherebyknowinglyand
intelligentlywaivestherighttoall administrativeandjudicialreviewas setforth inUtahCode
Ann. 63G-4-301 through63G-4-405,andUtahAdministrativeCodeRI51-4-901 through
R151-4-907. RespondentandtheDivisionherebyexpresstheirintentthatthismatterbe
resolvedexpeditiouslythroughstipulationas contemplatedinUtahCodeAnn. 63G-4-102(4).
5. RespondentwaivestherighttotheissuanceofaPetitionandaNoticeofAgency
Actioninthismatter.
6. RespondentunderstandsthatthisStipulationandOrder,ifadoptedby theDirectorof
theDivision,will be classifiedas apublicdocument. TheDivisionmayreleasethisStipulation
andOrder,andwillreleaseotherinformationaboutthisdisciplinaryactionagainstRespondent's
license,tootherpersonsandentities.

7. Respondentneitheradmitsnotdeniesthefollowing, butagreesthattheDivision
shallmakethefollowing findingsoffact:
a. Respondentwaslicensedas aregisterednurseintheStateofUtahonorabout
June26,2012.
b. InApril2013 Respondenttouchedapatientinaninappropriatesexual manner
onmorethanoneoccasionwhileworkingat aUtahhospital.
c. RespondentdesirestosurrenderRespondent'slicensetopracticeasa
registerednurse intheStateofUtahalongwithall residualrightspertainingto
saidlicense.
8. Respondent, whileneitheradmittingordenyingthefindingsoffactsabove,agrees
thatthefindings offact aboveconstituteunprofessionalconductas definedinUtahCodeAnn.
58-1-501(2)(a)and(k); andthatsaidconductjustifiesdisciplinaryactionagainstRespondent's
licensepursuanttoUtahCodeAnn. 58-1-401(2)(a). Respondenthereby surrenders
Respondent'slicensetopracticeasaregisterednurseinthe StateofUtahalongwithall residual
rightspertainingtosaidlicense. Respondentagreesthatthe issuanceoftheOrderin thismatter
constitutesdisciplinaryactionbytheDivisionpursuanttoUtahAdministrativeCodeR156-1-
102(6)andUtahCodeAnn. 58-1-401(2)(a). Respondentagreesnotto reapplyfor licensureas
anurseintheStateofUtahuntilfiveyearshaselapsedfromtheeffectivedateofthisStipulation
andOrderandRespondentsubmitsdocumentationshowingthatRespondenthascompletedall
criminalsanctions,ifany. TheDivisiondoesnotguaranteethatany future applicationby
Respondentfor licensurewill begranted. Ifthe DivisionDirectoracceptsthetermsof this
StipulationandOrder,Respondentforfeits allrightstopracticeas anurseintheStateofUtah.
RespondentunderstandsthatRespondentwillnotreceiveanyrefundoflicenseorrenewal fees
previouslypaidtotheDivision.

9. ThisStipulationandOrder,uponapprovalbytheDirectoroftheDivision,shall
bethefinal compromiseandsettlementofthisnon-criminaladministrativematter. Respondent
acknowledgesthattheDirectoris notrequiredtoacceptthetermsofthis StipulationandOrder
andthatiftheDirectordoesnotdoso,thisStipulationandtherepresentationscontainedtherein
shallbenull andvoid, exceptthatthe DivisionandRespondentwaiveanyclaimofbiasor
prejudgmenttheymightotherwisehavewithregardtothe Directorby virtueofhishaving
reviewedthisStipulation,andthiswaivershallsurvive suchnullification.
10. Thisdocumentconstitutestheentireagreementbetweenthepartiesand
supersedesandcancelsanyandall priornegotiations,representations,understandingsor
agreementsbetweenthepartiesregardingthesubjectofthis StipulationandOrder. Thereareno
verbalagreementsthatmodify,interpret,construeoraffectthisStipulation.
11. IfRespondentviolatesany termorconditionofthisStipulationandOrder,the
DivisionmaytakeactionagainstRespondent, includingimposingappropriatesanction,inthe
mannerprovidedby law.
12. RespondentunderstandsthatthedisciplinaryactiontakenbytheDivisioninthis
StipulationandOrdermay adverselyaffectany licensethatRespondentmay possessinanother
stateoranyapplicationforlicensureRespondentmaysubmitinanotherstate.
13. RespondentunderstandsandagreesthatifRespondenthasbeenissuedan Order
bytheDivisiontopayanadministrativepenaltyorafine, andRespondenthasnotpaidthe
administrativepenaltyorfine in full atthetimethisStipulationandOrderbecomeseffective,
thenRespondentmay notreapplyforlicensureintheStateofUtah,inanyprofessionor
occupation,untilRespondenthaspaidtheadministrativepenaltyorfine infulL Respondent

understands and agrees that any application for licensure submitted by Respondent shall be
denied for the reason of failure to pay an administrative penalty or fine by the Division until
Respondent has paid the administrative penalty or fine in full. The Division may also deny the
license for any other lawful reason. Respondent understands and agrees that this surrender of
Respondent's licensees) does not extinguish any obligation Respondent has to pay any
administrative penalty or fine previously ordered by the Division.
14. Respondent has read each and every paragraph contained in this Stipulation and
Order. Respondent understands each and every paragraph contained in this Stipulation and
Order. Respondent has no questions about any paragraph or provision contained in this
Stipulation and Order.

ORDER
THE ABOVE STIPULATION, in the matter ofJOSHUA PLATTE SHUMWAY, is
hereby approved by the Division of Occupational and Professional Licensing, and constitutes my
Findings of Fact and Conclusions of Law in this matter. The issuance of this Order is
disciplinary action pursuant to Utah Administrative Code R 156-1-1 02( 6) and Utah Code Ann.
58-1-401(2). The terms and conditions of the Stipulation are incorporated herein and constitute
my final Order in this case.
