RELEVANT PROVISIONS OF IRR OF EXPANDED SENIOR CITIZENS ACT OF 2010 ON WATER SERVICE

WHO MAY AVAIL OF THE PRIVILEGE

Article 5
1. Filipino resident citizen, sixty years old or above 2. Filipino citizen with dual citizenship status provided that a) They prove their Filipino citizenship b) Have at least six (6) months residency in the Philippines 3. Senior citizens centers established under RA 7876 and accredited by the DSWD May be a private or public building or attached to community center, barangay hall or chapel 4. Group Homes for senior citizens 5. Residential care facility for senior citizens

IDENTIFICATION REQUIREMENTS TO AVAIL THE PRIVILEGE Article 5, par 5.5


Any of the following identification documents may be presented to avail the privilege 1. Senior Citizens ID 2. Philippine Passport 3. Drivers license 4. Voters ID 5. SSS/GSIS ID 6. Postal ID 7. PRC Card 8. Other government-issued IDs

UTILITY DISCOUNTS Article 12


I. Grant of five percent (5%) discount to the monthly utilization of water by households with senior citizens Requisites for the grant of privilege: 1. Individual meters are registered in the name of senior citizen residing in the household 2. Monthly consumption does not exceed thirty cubic meters 3. That the privilege is granted per household, regardless of the number of senior citizens residing in said household Procedure for availment of privileges 1. Apply for the discount personally or thru a representative. There shall be annual renewal of application to the utility provider. 2. Submit requirements:

Proof of age and citizenship Proof of billing. Meter registration should be in the name of the senior citizen for a period of one year Proof of residence

Grant of fifty (50%) discount on water consumption for DSWD-accredited senior citizens centers and residential care institutions or group homes Requisites for the grant of privilege 1. That said institutions/homes are government-run or organized and operated by nonstock, non-profit domestic corporations 2. That the primary purpose of these institutions/homes is the promotion of the well-being of abandoned, neglected, unattached or homeless senior citizens. 3. That said institutions/homes must have been in operation for at least six (6) months 4. That said institutions/homes must have a separate meter for water service Under Section 3, DSWD will issue the necessary guidelines within thirty (30) days from effectivity of these Rules for the accredited senior citizens centers and residential/group homes willing to avail of the utility discount.

ERC, MWSS, LWUA and other concerned utility regulatory agencies shall, within six (6) months after the effectivity of these Rules, formulate supplemental guidelines to cover recovery rate mechanisms and/or sharing of burden, among other concerns of the distribution utilities.

OTHER RELEVANT PROVISIONS 1. Express lanes shall be provided in all government establishments Priority shall be given to senior citizens in the absence of express lanes 2. No double discount Senior citizens may avail either promotional discounts or 20% senior citizen discount, whichever is more favorable to them, but not both If the senior citizen is also holds a valid person with disability (PWD) card, the senior citizen may avail the discount given by using either the PWD card or the senior citizens card, but not both PENALTIES FOR VIOLATION First violation fine not less than P50,000 but not exceeding P100,000 and imprisonment of not less than two years but not more than six years fine of not less than P100,000 but not exceeding P200,000 and imprisionment for not less than two years but not more than six years fine of P50,000 but not more than P100,000 and imprisonment of not less than six months
