UK Tier 1 Points-Based System Entrepreneur Program


UK Tier 1 Entrepreneur visa is an ideal and perhaps one of the most flexible immigration programs for businessmen and investors. It is meant for applicants who wish to make UK their home and will do a genuine business in UK. This is an excellent opportunity to start a business in UK. It permits the applicant to live and do business in UK. The applicants spouse and children under 18 can accompany him as part of the application. Ideally, an applicant is expected to invest a MINIMUM of Pound Sterling 200,000 as business investment and also generate 2 full time jobs for UK residents/citizens. An investment into maintenance (housing and living expenses) is NOT included under the minimum required business investment and should be done over and above Pound sterling 200,000/- The holder under this visa category is NOT permitted to take up a job/employment. Key selection attributes You MUST meet ONE of the requirements from (1) and (2) below: (1) Access to not less than 200,000 If you have not less than 200,000 of your own money available to make a fresh investment into business in the United Kingdom you need to supply documentary evidence as specified below. You may include funds made available by one or more other people (known as a third party or parties). In these circumstances you must also provide a declaration from every contributor that the funds are available to you or your business, together with confirmation from a legal representative that the declaration document is valid. The total amount available to the entrepreneurial team must be no less than 200,000. If you are relying on money held by a husband, wife or partner that person will be regarded as a third party. In the case of an entrepreneurial team, one team member can act as third party contributor of funds for the other. (2) Access to not less than 50,000 If you have access to no less than 50,000 funds from: 1. One or more registered venture capitalist firms regulated by the Financial Services, 2. One or more registered UK entrepreneurial seed funding competitions which is listed as endorsed by the UKTI, or 3. One or more UK Government Departments, and made available by the Department(s) for the specific purpose of establishing or expanding a UK business. If you have access to no less than 50,000 funds plus a letter from each venture capital firm; seed funding competition; or UK Government Department providing the funds, you can use these funds, together with confirmation of the investment funds to claim points.

(3) Funds held in one or more regulated financial institutions The financial institution or institutions that provide confirmation of the funds available to you must be regulated by the home regulator. The home regulator is an official financial regulatory body in the country where the financial institution operates and the transaction was made. This body must be appropriate to the type of financial transaction. (4) Funds disposable in the United Kingdom Funds held in the United Kingdom must be held in an institution that is regulated by the Financial Services Authority (FSA). If the funds are not held in the United Kingdom, all of the investment funds required to qualify must be freely transferable to the United Kingdom and convertible into pounds sterling. If the funds are held overseas but in an institution that has a presence in the United Kingdom and is regulated by the FSA, then the institution already does business in the United Kingdom and therefore no further evidence is required as regards availability of the funds for transfer to the United Kingdom.

If you rely on funds that are held in an overseas institution that is not regulated by the FSA you must provide confirmation that the funds can be transferred into the United Kingdom. Do this by supplying a document from your bank or financial institution confirming the amount of funds. English language ability

The ability to meet the required English standard is a mandatory requirement. If you cannot meet this level, your application can be refused. There are four ways in which you can meet this requirement. You can: Be a national of a majority English speaking country on the following list - Antigua and Barbuda, Australia, The Bahamas, Barbados, Belize, Canada, Dominica, Grenada, Guyana, Jamaica, New Zealand, St Christopher (Kitts) and Nevis, St Lucia, St Vincent and the Grenadines, Trinidad and Tobago, the United States of America or Hold an English language qualification equivalent to the Council of Europe's Common European Framework for Language Learning level C1 (approximately IELTS level 6.5, GCSE Grade C) or Hold a degree that was taught in English as confirmed by the UK NARIC database as equivalent to a UK Bachelors degree or Have previously been granted leave under the Business Person Category.

Maintenance (Funds) You must be able to support yourself for the entire duration of your stay in the UK without needing any help from public funds. In order to qualify under Tier 1 (Entrepreneur) you must be able to demonstrate that you have 2,800 for yourself and (where applicable) 1,600 for each dependant accompanying you and that you have held these amounts for a consecutive 90 day period immediately preceding and dated no more than 1 month prior to the date you submit your application. The balance should not fall below the required minimum at any time during the consecutive 90 day period. Visa duration The visa will be issued for a period of three years plus four months. After this period, another extension of 2 years will be granted. Should the visa holder not invest the minimum pound sterling 200,000 into a new or running business and not generate minimum 2 jobs for local residents/citizens, it is highly unlikely that he/she will be given 2 years extension. After the applicant is in UK for 5 years, he/she and dependent family members can apply for indefinite leave to remain (UK residency) subject to applicable conditions. Normally and if eligible, the holder can apply for citizenship in year 10 from Dependents Your husband, wife, civil partner or eligible partner and children under 18 can join you as your dependants in the UK if: They have a visa for this purpose and You can support them without any help from public funds. You need 1,600 for each dependant joining you within 12 months of your arrival in the UK and 533 thereafter. Business plan For an application to be successful, it is strongly recommended and advised that it be filed along-with a well researched with business plan/intent of what the applicant wishes to do if the visa is issued. Application fee UK Government application fee (non-refundable) of Pound 816 per person is payable with the application. Thus a family of four including applicant, spouse and 2 dependent children below 18 years will pay a non-refundable fee of Pound 3600 along with the application. The fee is subject to change without notice.
