NOW THE PRESENTS WITNESSTH AND IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES HERE TO FOLLOWS:-

1. And whereas the seller doth hereby assures the purchaser that the said flat is free from any or all encumbrances and such as all the rates charges and the dues payable in respect of the said flat to any or all persons, authorities or bodies and also undertakes to clear and satisfy the same which includes municipal charges at his expense up to the date of execution of this agreement till date of possession of flat and agreed to pay the pending due of this current year in the future. 2. And whereas the seller hereby also assures the purchaser that said flat is not, and was never mortgaged to any person or any institutions or institutions for financial assistance of any kind and is completely free and makeable from any of all kinds of debts. 3. And whereas The seller hereby states that she is the sole and absolute owner of the said flat and is in completed and whole possession of the said flat he also states that, there is no liability of any kind from any person or person or any institutions or institutions thereof pending till date of execution of this agreement. And she is entitled to sell and transfer the same to and in the name of purchaser. 4. And whereas The seller agreed to sell to the purchaser and the purchaser has agreed to purchase from the seller they said flat on terms and conditions appearing hereinafter. 5. And whereas The purchaser has agreed upon the total consideration of rs, 500000/-(five lakh only) towards the sale of the said flat paid by cash. Purchaser to seller 6. And whereas On receipt of total consideration from the purchaser the seller shall hand over peacefully and vacant possession of the said flat at lying and being at Thane Panchpakadi,

Tukada No.2, Survey Nos.423 and constructed a multi storied building and christened the said building as wherein the party of the first part purchased a flat premises Sadguru Kripa Building ,bearing Room No.4, on the Ground floor of the said Sadguru Kripa Building at Shanti Nagar, (Kisan Nagar No.4), Shree N.G.V.S.M. Road No.28/27, W.I.Estate, Thane (W), 400 604. And all the relevant and necessary documents, supporting the ownership of the said flat duly executed in the favor of the purchaser permanently. 7. And whereas The seller has agreed to hand over his consent in writing to the respective authorities like thane Municipal Corporation, and all other authority for transferring his rights towards the said flat in the name of the purchaser. 8. And whereas The seller hereby transfer and assign forever and herein future his said flat hereunto the purchaser to have, sold and enjoy and possess the same as true and lawful owner thereof and use enjoy to the best of his needs and choices at obstruction by or

from any person or authority or body or his legal heirs against the payment of taxes, rates and other charges due and payable to any person authority or body in respect of the said flat. He/she/ they also declare that there will never be any claim from him or legal heirs or any person or persons representing him/her/their of any sort in respect of the said flat and the purchaser shall own enjoy the ownership of the said flat forever. 9. And whereas The seller hereby also agrees to give necessary papers, documents to the purchasers after receiving all amount of agreement and also agreed to give signature wherever necessary in future for the above said flat and seller will attach Xerox copy of pan card no-..
10. And whereas The purchaser herein is in need of flat for him residential purpose and thereof approached to the seller amd inspected all the documents in respect of the said flat and after satisfaction requested to the seller the purchase bearing Thane Panchpakadi, Tukada No.2,

Road No.28/27, W.I.Estate, Thane (W), 400 604.The Flat Seller or the party of the first part has been a regular payee of property tax to the concerned department of Thane Municipal Corporation and his TMC at R.W.C Block Vasuli No is 53, TMC at R.W.C Consumer No is 8022331/00010 and his TMC at R.W.C Ghar Kramak No is 47, as agreed to sell the aforesaid flat to the purchaser on ownership basis along with all rights, titles interest to the purchaser for a valuable consideration after negotiation by and between parties hereunto the seller of the said flat agreed to sell the aforesaid office to the purchaser and purchasers has rs.50000/-( five lakh only) therefore, the parties hereto and hereunto are desirous of producing the terms and conditions in writing herein after appearing. 11. The transfer do hereby convenient as follows
a) There are no suits, litigations civil or any other proceedings, pending as against the seller personally affecting the said flat b) There are no attachment or prohibitory orders as against or affecting the said flat and the said flat and the said flat is free from all encumbrances or change and or is not subject matter to any lispendents or easement or attachment either before or after judgment. The transferor has not received any notice from the government or Municipal Corporation regarding any of the proceedings in respect of the said flat. The said flat is free from all mortgages charges, encumbrances of any nature whatsoever. c) The seller has paid all the necessary cgarges of any nature whatsoever in respect of the said flat and the seller has not received any notice from ant statutory body or authorities asking for the payment of any nature whatsoever of the said flat. d) The seller in the past has not entered in any agreement either in the form of sale, lease exchange, assignment or in any other way whatsoever land has not created any

tenancy, leave and license or any other rights of the like nature in the said premises and has not deal with or disposed off the said flat in any manner whatsoever. e) The seller is in exclusive use, occupation and possession of the said flat and every part thereof and except the seller no other person or persons are in use, occupation and enjoyment of the said flat or any part thereof f) The seller has good and clear title free from encumbrances of any nature whatsoever of the said flat and every part thereof and there are no outstanding estates or effect by the way of lease, lien, charges inheritance, sale, gifts, trust, mortgage or otherwise however outstanding against the seller and or against the said flat or any part thereof g) The seller has not done any act, deed, matter or things whereby he is prevented from entering into this agreement on the various terms and conditions as stated herein in favor of the purchaser and the seller has all the rights, title and interest to enter into this agreement with the purchaser on the various terms and conditioned a stated herein. Relying up on the aforesaid representations and declarations made by the seller herein the purchaser has agreed to purchase the said flat. h) The purchaser shall get transferred from the seller his aforesaid flat at in the registered of the said deed for the registration of this deed in the sub-registrar flat of thane seller shall co-operate for the same and shall sign all necessary applications declaration etc. for the purpose of transferring his said flat. i) That its hereby agreed by and between the parties hereto that the purchaser shall be a liberty to sell, mortgage, transfer his aforesaid flat to any person or personson the basis of this deed to which seller of the said flat shall has no objection for the same. j) This agreement shall always be subject to the provisions of the Maharashtra ownership flat act (Maharashtra act no-XV of 1971 and the rules made the under.
