A RESOLITION ESTABLISHING A COMPLAINTIGRIBVANCE


PROCEDURE RELATING TO SERVICES FTJNDED BY THE TEXAS
DEPARTMBNT OF IIOUSING AI{D COMMI]MTY ATT'AIRS.

WHEREAS,the City of PelicanBay is a recipientof fundsfrom theTexasDepartmentof


Housingand CommunityAffairs; and

WHEREAS, the Stateof Texasrequiresthat a complaint/grievanceprocedurerelating to


servicesfundedby the TexasDepartmentof Housingand CommunityAffairs be adopted;
now therefore
BE IT RESOLVED BY THE CITY COI]NCIL OF THE CITY OF PELICAN BAY.

Adopted
The attachedExhibit I entitled 'Complaint ProceduresRelating to ServicesFundedby
the TexasDepartmentof Housingand CommunityAffaim" is herebyadopted

Section2. Effective Date

This resolutionshall be effectiveupon its passageby the City Council and approvalby
the Mayor of the City of PelicanBay.

dayof October,1994.

DEPARTMENT OF HOUSING AND COMMTINITY AFFAIRS

The following are procedural requirementsfor responding to local complaints


concerningthe quality of servicesprovided by the City of Pelican Bay related to
servicesfunded by the TexasDepartmentof Housing and Community Affairs, as
requiredby 10T.A.C.Section1.13:
(a) A recipientwho hasa commentor complaintaboutthe quality of servicesfundedby a
block grant administeredby the departmentmay submit suchcommentor complaintin
writing to the internalauditorof the department.
(b) The internal auditor shall transmita copy of the commentor complaintto the City of
Pelican Bay within two calendar days and request a responseto the comments or
complaintsarising underthe TexasCommunityDevelopmentProgram
(c) The City of PelicanBay shallcompleteits investigationof the commentor complaintand
submitits findings,in writing, to the internalauditorwithin sevenbusinessdaysafter the
date the entity receivedthe commentor cdrnplaint,or notify the internalauditorwithin
suchperiod,of the datetheinvestigationcanbe completed.
(d) The executivedirectorof the depar,tment shallnoti$ the complainantof the department's
and the City'l findingg.b.fo..g the business.dayafter the date the commento.r complaint
was received or shall notify the complainant, within such period, of the date the
investigationcanbe completed.
(e) The executivedirector of the departmentshall notify the complainantof the statusof the
complaint at least quarterly and until the final disposition of the complaint unlessthe
noticewouldjeopardizean undercover investigation.

(0 The departmentshall considerthehistory of complaintsregardingthe City of PelicanBay


determining whether to enter into a new Texas Community Development hogram
contractwith the contactor.

The terms used above arc defined in t0 T.A.C. Section 1.11.
