Definition of a Builder (as per Bihar Apartment Act 2006) The person who constructs or causes to be constructed a building consisting of Apartments or converts an existing building or a part thereof into Apartment for the purpose of selling all or some of the Apartments to other persons, and includes his assigns. Where the person who constructs or converts a building and the person who sells are different persons, the terms include both of them. Any development authority and any other public body so notified by Government are deemed to be the Promoters in respect of the allottees in building constructed by them on land owned by them or placed at their disposal by Government & does not include apartment owner (s)3 (r)- Promoter or developer- means the person whi constructs or causes to be constructed a building consisting of apartments or converts an enisting building apart of thereof into apartment for the purpose of selling all or some of apartments to other persons and included his assigns where the person who construct or concvert a building and the person who sells are different persons the term include bpth of them. Any development authority or an other public body so notified by govt body are deemed to be the promoters in respects of promotees in building construced by them on land owned by them ir placed at their disposal by government: Explanation- any such person who acts in the manner described in the above will be deemed to be a promoter in that capacity also if

ii.
He claims to be acting as the holder of a ppower of atony o the owner of the land on which the building is constructed.
3 (s)-Property/owner means the pereson who is actual owner of the land on which the apartment building is to be construced and has the right title and interest over the proposed land and it is alos included the successor and the legal heirs of the owner of the land if the land owner is state goovt/govt. of india/ public undertaking/cooperative society/trust etc. thed concerned authority shall be termed as proprietors/owners.

Note: Builder registration in PMC The Patna Municipal Corporation and the dissolved PRDA is responsible for approving the building plans submitted by the property owners/builders/private land owners/promoters. At present the registered Architect has given the responsibility for approving the building plans without any consultation with PMC officials, which causes loss in municipal revenue.
