Summary Narrative
This report will document a Criminal Mischief that occurred on 2/17/13, at approximately 1840hrs. This occurred at the KFC parking lot, at 3285 28th St., City/County of Boulder, State of Colorado. The suspect is unknown, however, another male, Matthew Tello, was arrested for Accessory to this crime. Tello was arrested by Ofc. Logue under CR13-2215. This case is closed due to lack of suspect information.

Narrative
On 2/17/13, at approximately 1840hrs, Ofc. Logue and I, Ofc. Vest, were dispatched to 3235 28th St., City/County of Boulder, State of Colorado, on a report of a Criminal Mischief that had just occurred. According to dispatch, a male on a bike had damaged the victim's car, and left the area. Ofc. Logue arrived on scene, and learned that the male had returned, and subsequently left the area. As I arrived in the area, I checked the surrounding area briefly, then contacted the victim, Carol Steinberger. Also on scene were two witnesses to the crime, Brian Tracy and his son, Michael Tracy. Steinberger told me that she was leaving the parking lot of KFC, and pulled to 28th St., and was waiting for cross traffic before pulling out. She told me that suddenly, she heard yelling from her left (the north). Steinberger saw a

bicycle approach. There were two males on the bike, the driver, later ID'd as Matthew Tello, and the unknown passenger, who was riding on the handlebars of the bike. The passenger jumped off the bike, and began "banging his hands" on the outside of Steinberger's car. He circled around the rear of the car, and to the passenger side. Once there, the suspect kicked the front passenger side door, causing significant damage to it, creasing the metal. The cyclist rode south along the sidewalk, and the suspect ran along side him. Steinberger stated that she was so "shocked" by the incident, she was unable to get a good description of either party. At this point, she was able to describe the suspect as a white male in dark clothing. She described the cyclist, Tello, as a male riding an orange or red bicycle. After the two males left, Steinberger called 911, and also saw that two witnesses were in a car behind hers. These men were Brian and Michael Tracy. Steinberger stated that while waiting for the police to arrive, she saw a male on a bicycle approach from the south. She recognized the male and bike as the rider from before. She stated the male approached, and began to ask about a lost wallet. She and the Tracys began to try to talk to him about the damage from the car and told him that they had called the police. The male became very angry, and quickly left the area, riding southbound. At this point, she was able to observe more details concerning his appearance. She described Tello as a white male with a hat and headlamp, lighter colored hair, and a silver or light colored jacket. She described this coat as a puffy "down type" of coat. See Steinberger's voluntary statement. Again, he was riding an orange or red bicycle. I also spoke to Brian and Michael Tracy. Brian stated that they had pulled up behind Steinberger's car, and saw the two males on the bike. Brian saw the male riding on the handlebars jump off, and he began to yell, kick and hit Steinberger's car. Brian then saw both leave, going south, with the suspect running alongside the male on the bike. Brian and Michael remained to assist Steinberger. Brian then saw the bicyclist ride back from the south. The cyclist, Tello, began to ask about a lost wallet. Brian stated that Tello was very intoxicated. Brian asked Tello to stay, as the police had been called. Tello became very angry, and quickly left. See Brian's voluntary statement. Brian's juvenile son, Michael, provided a similar account of the incident. He described the suspect as approximately 5'10, and wearing dark clothing. See Michael's voluntary statement. While investigating this crime, I heard over the radio that Ofc. McNalley had contacted a male matching the cyclist's description. After a fight, the male was placed into custody. Ofc. Bliley assisted in providing rides for showups with Michael and Steinberger. These showups were conducted separately. Both Michael and Steinberger positively identified Tello as the cyclist involved in this incident. I photographed Steinberger's car. I observed a footprint on the driver's side rear bumper. I saw that the tread pattern was very aggressive, as though it were a hiking boot or mountain bike shoe. On the passenger side rear side of the car, I saw several fresh wiping type marks in the dirt on the car. I also observed the significant dent made to the passenger front door. The dent left a crease in the body metal, and I saw that paint was flaking off. At the bottom of this dent, I saw the same shoe print pattern as mentioned above. I utilized grey/silver magnetic print powder, and attempted to locate latent prints in the wipe marks. I located a single partial print. I submitted both the photographs and the partial latent print to P&E. I provided Steinberger with my business card and case report number. I then responded to the Boulder County Jail to assist Ofc. Logue, and to complete paperwork related to this incident. While at the jail, I learned that an unknown party had called BPD dispatch, asking about a male on a bike, who was missing from the area of this call. Dispatch forwarded this call to the Boulder County Jail Booking Desk. I spoke to deputies at the jail, and learned that this unknown male was looking for Tello, and asking when he would be released. He was told he could call back later to find out. At approximately 2200hrs, I was approached by jail deputies, and learned that several people were in the jail lobby, looking for Tello. Ofc. Logue, Ofc. Bliley, and I contacted these parties. I first glanced at their footwear, and saw that none were wearing shoes that would have left the print pattern I observed on Steinberger's car. I spoke to a male identified as Dann Stevenson, in the vestibule area between the lobby and outside. Stevenson told me that he had been with a group of people, including Tello, at Gateway Park for Tello's birthday. Stevenson rode back into Boulder with a group of approximately 7 people, including Tello. As they approached 28th St and

Jay Rd, The group split into two. Tello and some others rode west on Jay to 26th St., and Stevenson and others continued south on 28th St. Stevenson said that his group rode to an Indian Restaurant in the area of 28th and Valmont Rd., where they had dinner. He stated that Tello never showed up. I asked Stevenson questions concerning who was in the group, and who had been riding with Tello. Based on my experience, Stevenson became increasingly nervous. Stevenson refused to cooperate, refusing to identify who was with their group, or who the rider with Tello was. Stevenson then, stated that he was uncomfortable with this, and asked if he were free to leave. I told him that he was. Stevenson quickly left the lobby. I observed that Stevenson was wearing flat soled sneakers. I then spoke to the other two parties in the lobby, Rakia Ranney and William Madden. I immediately saw that while Ranney was fairly calm, and appeared concerned for Tello, Madden was extremely nervous. Based on my training and experience, he showed signs of being deceptive with his answers. Madden stated that they were at Gateway, and afterwards, left for dinner. Madden never provided a consistent answer regarding who may have been riding with Tello, and he too refused to provide information regarding who was with their group. He did acknowledge that he knew everyone at the gathering, but when asked who had failed to show up at dinner, he never gave a full answer. Madden stated that he would only tell me what he "knew" and wouldn't say anything he wasn't certain of. He too stated that he didn't feel comfortable giving us names of people who might not have been involved. After seeing that they were not going to cooperate with this investigation, Ofc. Logue and I concluding this conversation with Madden and Ranney. I did observe that Madden was wearing Birkenstock style sandals at this time. Tello, given his involvement in this case, was arrested by Ofc. Logue for Accessory to Crime, among other charges. For details of this, see BPD CR#13-2215. This case is closed due to lack of suspect information.
