Chief Ministers action plan commendable!

he Supreme Court upheld the appointment of retired Justice R.A.Mehta as Lokayukta by Gujarat Governor Kamla Beniwal. It is a landmark judicious judgement, rejecting Chief Minister Modis objections as misplaced and no valid grounds. It is a rude shock to him and the government. The bench of Justices B.S. Chouhan and F.M.I. Kalifulla held that the Governor completed the consultation process for appointment of Lokayukta with other consultative committee members like Chief Justice of Gujarat High court and the leader of opposition correctly. They reiterated no cause to reopen the judgements disregarding Modis objections. Modi had protested that the Governor had byepassed his government in selecting Justice Mehta. Modi had objected the appointment of Mehta as Lokayukta, saying that he shared a platform with known critics of the state government and a panelist for N.G.Os and social groups, always dissatisfied with the manner in which the government was functioning. Having negative his contentions, the Suprement court held the appointment is valid on the basis of primacy of opinion of the High court Chief Justice, besides the Governor and the Leader of opposition who all endorsed his selection. The Supreme court lashed and criticised the harsh criticism of Chief Minister, ought to have maintained a calm disposition in the matter, eventhough they upheld the High courts decision in the appointment, The High court criticised the high-way attitude of Modi. The bench also came heavily on the role of the Governor

who misjudged her role and had insisted that under the Act 1986, the council of ministers has no role to play in the appointment and hence she could therefore fill-up with due consultations with the Chief Justice of Gujarat High court and Leader of opposition. They said that this is not in consonance with the avowed objectives and spirit of the constitution. The court also warned again leaving the finality of the choice to the council of ministers headed by Chief Minister. It would tantamount allowing a person who is likely to be the investigator to choose his own judge and rendered meaningless, if a known Lokayukta was allowed to be appointed. The court then directed the Gujarat government to immediately provide the necessary infrastructures and staff to make the office functional. It is unfortunate that the post of Lokayukta is lying vacant since November 2003 when Justice S.M.Soni had resigned. The Leader of opposition in the Rajya Sabha, Arun Jiteley remarked that Gujarats executive powers are usurped and Supreme courts ruling giving primacy to Chief Justices opinion in Lokayukta appointment as irrelevant in this context, rendering the role of the CM, Leader of opposition completely redundant. Constitutional short-cuts do not establish either good governance or good precedents. He said the judgements create an imbalance in the system. At the time the country is facing and plagued by series of scams and irregularities, the institute of Lokayukta is a paramount importance to strenghten the system of governance in full transparency and is a key to

the sucess of the anti-corruption drives. It is a pity that except states like Madhya Pradesh and Karnataka, no state evinced keen interest to have Lokayukta, in their respective states and at present, they have only state -level anti-corruption departments that can investigate and forward their recommendations to the government on corruption allegations against public servants. It is upto the government to decide in the matter. It is most appreciable that Karnataka Lokayukta under the able stewardship of Santosh Hegde made a real difference and had made a wonderful contribution by exposing massive scams in mining in the state leading to thousands of crores of money looted which made a furore in the country. That forced the then powerful Chief Minister B.S.Yeddyurappa to submit his resignation. To achieve systematic reform in corruptionridden sectors like land, mining, construction and grant of licences etc., Lokayukta play a dominant role and an integral part of the Lokayukta process. Hence Lokayukta should be made compulsory for all state governments to appoint forthwith and no state government can take the plea of federal rights and stall them in their respective states which is very harmful to the country. Why are they fearing on this, if the administration is run clean? Will the state governments have guts to do for an efficient governance?

Dattatreya and his 24 illustrious Gurumars!

When Yadhu, the king asked Dattatreya what was the sole success for his equipoise, balanced mind and unruffled thought over both pleasures and owes ? Avadhoota Dattatreya replied that though atma is my sole Guru and refuge, I envision and derive abandunt knowledge and spirits, unshakeable faith in the nature as 24 Gurumars - 24 thathvarthams i.e. 24 commandments. They are earth, air, sky, water, fire, moon, sun, bird, spider, pythan, sea, bee, elephant, and honey collecting hunter, deer, fish, the prostitute by name Pingala, Gurrabird, a damsel, blacksmith, snake, bug, fly, worms, etc., Earth : All the creatures and livingbeings live in this earth from time immemorial since creation. Even you dig, plough, burn the soil , the earth ever remains calm and patient without exposing anger, but gives all the essential inputs , nutrients like food, water etc. for a happy living. I learnt that patience , love, assistance and helpfulness at all times to everybeing. Hence the earth having mountains and rivers in it, is my first and foremost Guru. Air : Air is always unclean and non-fragrant. The air grows on all articles equally which emit bad and foul smell and which have good fragrance without any partiality or deviation. I learnt that life is a mixture of both good and bad, happiness and sorrow and take everything in its own stride. I became matured and balanced Sun : Eventhough the sun is effulging equally but reflects in the pot or pond differently. Likewise eventhough the mind is one, but thinking is different. Hence sun is my seventh Guru. Bird or dove: A hunter caught the birds from netting. Having seen this , out of love and attachment, both the male and female birds voluntarily caught into the nets. The attachment is the cause for all the troubles and turmoils. Hence bird is my eighth Guru. Pythan : Without moving out from its space, whether it is a small or big prey, it catches it when it comes to its place. I learnt that only by stint of hard work, we should earn and lead our life. Hence pythan is my nineth Guru. Flies : Even knowing that it is fire, the flies (wittle) voluntarily comes and puts itself into the fire and dies. Likewise, I learnt that I should not distract my attention and should ever concentrate on my mind. The fly is my tenth Guru. Sea : Hundreds of rivers flow and merge into the sea. Likewise whatever may be the pain and sufferings, face it squarely and patiently. Sea is my eleventh Guru. Bee : Bee takes the honey from various flowers little by little and is always brisk. Likewise I learnt living brisk, and living by taking food little by little from everybody without giving problems to others. Bee is my twelveth Guru. to be continued in next issue....

to all situations. Hence air is my second Guru. Sky and cosmos : The clouds are unsteady but changes its form according to times and seasons, vagaries of monsoon etc. Likewise whatever may be the situation around me, I am unmoved and steadfast in my views and never change my mind. My mind is always steady and unpolluted . Hence the sky is my third Guru. Water : Water is clean and takes the shape that exists. Likewise, I am always clean and just to different situations. Hence water is my fourth Guru. Fire : Whatever is placed inside the fire, it burns and becomes into a dust and it also gives light to the environs. Like wise I always give light to others, dispelling ignorance. Hence fire is my fifth Guru. Moon : The moon becomes smaller into new moon and grows bigger into a fullmoon. Likewise I learnt from poverty to affluence. Hence moon is my sixth Guru.

SHILPA'S BEAUTY TIPS

EXFOLIATION -Natural Chemical- Enzymes:
XFOLIATION is a necessary beauty regimen to follow. It cleans the superficial layer of the skin making it clear, blemish free and improves the blood circulation. But if done in excess, the same exfoliation that clears and polishes your skin can make it rough, dry and reddish. Our skin varies in nature in different parts of our body. You can feel the difference between your facial skin and that of your arms and legs. So, exfoliation of your face and neck must be done differently from that of the rest of your body. Each skin type is different and therefore, the kind of exfoliation that is used must be suitable to different skin types. A face exfoliation for dry skin may not be best suited for oily skin and vice verse. Three type of exfoliation - natural-chemical-enzymes: NATURAL: The dead cells on the surface of the skin are physically rubbed off with an abrasive. Care should be taken not to rub too harshly or this can affect the skin's texture . Homemade exfoliating packs like Salt, Sugar granules or Oatmeal scrubs are a few examples. Natural suit people with sensitive skin or with skin problems such as acne, pimples or fragile skin types which cannot tolerate friction. CHEMICAL: The common ingredients in chemical scrubs are Alpha Hydroxy Acids (AHA), Beta Hydroxy Acid (BHA). AHA comes from lactic acid in milk, malic acid from apples, glycolic acid from sugar cane and tartaric from grapes. BHA comes from salicyclic acid from wintergreen and sweet birch. MICRODERMABRASION is another chemical procedure that helps to remove damaged skin cells from the surface. They are two forms; superficial and deep. The first remove the dead cells in the top layers while the second involves the entire epidermis. The procedure when performed correctly can greatly improve the appearance the skin. ENZYMES: It dissolves dead tissues and neutralize the chemical reaction of other products. Papaya and Pineapple enzymes are natural enzymes that are known to buff the skin effectively.
