TAC L OBA N CITY Illegal small scale gold mining is being blamed as the cause of the death of a family of three in the upstream village of Maydolong, Eastern Samar, when storm Quinta battered the region.
Identified as fatalities were couple Rodrigo Busa, 56; Rosita Busa, 50; and their son Kimjie Busa, 7. They were killed when a tree fell to their makeshift in sitio Lumangag, Barangay Del Pilar in Maydolong town. Some of the roots of the big apitong tree have been cut as people dig the soil in search for gold. When the storm hit our place, the trees got uprooted easily and kill the Busa family, said Maydolong Mayor Henry Afable in a mobile phone interview. Busas 12-year-old son Roclito survived the incident but was severely injured. The incident happened on midnight of December 26 when the province was placed under public storm signal

DBM Regional Director Imelda Laceras said the performance-based bonus (PBB) is different from the 13th month pay, year-end cash bonus, and Productivity Enhancement Incentive (PEI) for government employees. Bizmen initiate road map to increase coconut yield in So. Leyte

MAASIN CITY-In a bid to boost the present coconut production in this province, businessmen here forged pact with local government units and church officials in Southern Leyte for a coconut rehabilitation road map. In the past, our two major crops were coconut and abaca. Our coconut production is about 700 million pesos per year, while abaca used to provide us with about 300 million pesos per year. Unfortunately, our abaca industry was wiped out by the bunchy top virus. So what remains now as our primary crop is only coconut, said So. Leyte Chamber of Commerce and Industry president Engr. Robert Castaares. If So. Leyte will succeed in doubling its production output from 700 million to 1.4 billion pesos by year 2018, the impact on 80 percent of the population in the province who relied on coconut will be unimaginable, added Castaares. A c c o r d i n g l y, t h e coconut rehabilitation road map which was crafted by the chamber had its initial implementation last November with the assistance from the Philippine Coconut Authority, National AntiPove r ty Commission, and in partnership with the Diocese of Maasin, other religious groups and stakeholders. Its goal is to increase the coconut harvest by 100 percent in 2018. This is one of the cornerstones of Southern Leyte s economic development framework, Castaares said. Also through an earlier resolution from So. Leyte Sangguniang Panlalawigan, the provincial government of So. Leyte under Gov. Damian Mercado expressed determination to provide funds for the said coconut rehabilitation road map which covers the expansion of coconut lands, cutting and replanting of senile c oc onut tr e e s, a n d conducting massive fertilization of healthy coconuts, this even to include intercropping of banana and coffee.

They wanted to turn state witness against Amalilio when they surrendered to the DOJ. Fireworks business slow this season

THE fireworks business in Cebu isnt doing as well this year compared with previous Christmas seasons, manufacturers and stall holders said. The passing of their patriarch, Julian Pongasi, earlier this year caused the family that owns JP Fireworks to slow down in their manufacturing. Pongasi is a pioneer in the fireworks business in Lapu-Lapu City who started and ran JP Fireworks for 20 years. The company had a fireworks factory in the middle of a fishpond in Sitio Radar, Brgy. Babag in Lapu-Lapu City. His daughter Flora said they are just completing orders of their regulars this December. She said the increase in prices of materials had affected their business. Pongasi said the business boomed in 2000. This year, however, sales have been slow with not many people buying fireworks. Those who do prefer to buy in malls and retail dealers. Pongasi said she is still hoping for sales to recover in the run-up to the New Year. JP Fireworks, which does not supply retailers, starts manufacturing firecrackers in September of each year. The company also accepts orders during fiestas and for small occasions. Stall holders in Barangay Babag in Lapu-Lapu City, which is described as Cebus fireworks capital, also reported slow sales this holiday. Rachel Quijano, an 18-year-old fireworks stall keeper, said their items are about five percent more expensive this year because factories have raised prices. She said sales were better last year. Quijano keeps the stall for Arsenio Berdin, who has been retailing firecrackers for 10 years. Jenny Ocaba, 16, daughter of stall owner Loreta Tabar, also said fewer people are buying fireworks this year. Ocabas family has been in the trade for almost 20 years.

This was the assurance made by CBCP President and Cebu Archbishop Jose Palma over fears of backlash to legislators who supported the Reproductive Health (RH), which was recently passed by Congress and will soon be signed into law by President Benigno Aquino III. Palma gave the assurance during Wednesdays press conference where he delivered his New Years message. At the height of the deliberations of the Reproductive Health bill, various groups against it threatened to campaign against politicians and lawmakers supporting RH. The Cebu Archbishop said in principle the bishops and the priests should never be partisan. We will not endorse a party. We will not endorse anybody in the mass or in the rally. Its not our prerogative, Palma said. The Cebu bishop said in the past, the Church gave criteria and it is up to the faithful to apply the criteria, but there are other considerations like advocacies, track record, competence and integrity. The Supreme Court has already decided that the purchase of the PCOS machines from the Smartmatic Corporation is valid and legal. The Commission on Elections is now conducting upgrading to enhance the system of the PCOS machine which was first used in the 2010 presidential elections. Comelec Commissioner Armando Velasco said the use of the PCOS machines was proven effective and is a milestone in the Philippine history since it delivered accurate information and results immediately after the elections compared to the manual counting that was practiced in the country for of a long time. It is wiser to use the PCOS machines than to go back to manual election, he said. (SUNNEX) Santander believes the relief served as a wake-up call to them, as Garbo is serious in his campaign. Last Dec. 15, the police officials were ordered out of their office. Is six months suspension correct?

The Local Government Code provides that any abuse of the exercise of the power of preventive suspension shall be penalized as abuse of authority. President Benigno Simeon Cojuangco Aquino III preventively suspended Governor Gwendolyn F. Garcia for six months. It is three months beyond the authorized preventive suspension the law provides. In Section 63 (b) of the Local Government Code provides: Preventive suspension may be imposed at any time after the issues are joined, when the evidence of guilt is strong, and given the gravity of the offense, there is great probability that the continuance in ofce of the respondent could inuence the witnesses or pose a threat to the safety and integrity of the records and other evidence: Provided, That, any single preventive suspension of local elective ofcials shall not extend beyond sixty (60) days. Provided, further, That in the event that several administrative cases are led against an elective ofcials, he cannot be preventively suspended for more than ninety (90) days with a single year on the same ground or grounds existing and known at the time of the rst suspension. The order of the President is 6 months multiply by 30 days is equals 180 days. Denitely the suspension order is an abuse of the exercise of the powers of preventive suspension. Could it be ground for the impeachment of the President? Section 65 of the same Code, provides that the respondent shall be accorded full oppor-

tunity to appear and defend himself in person or by counsel, confront and cross examine the witnesses against him. How can Governor Garcia confront a dead witness? Likewise, the local election will be held on May 13, 2013, which is 141 days more to go from today; hence, the suspension shall be automatically lifted on February 16, 2013, if the suspension order is legally received by the Governor. The Code in Section 62 (c) provides: However, no investigation shall be held within ninety (90) days immediately prior to any local election, and no preventive suspension shall be imposed within the said period. If preventive suspension has been imposed prior to the 90day period immediately preceding local election, it shall be deemed automatically lifted upon the start of aforesaid period. The Supreme Court decision in Rios vs Sandiganbayan, G.R. No. 129913, September 26, 1997, states: On the other hand, we nd merit in petitioners second assigned error. The Sandiganbayan erred in imposing a 90 day suspension upon petitioner for the single case led against

him. Under Section 63 (b) of the Local Government Code, any single preventive suspension of local elective ofcials shall not extend beyond sixty (60) days. The length of suspension is one aw that has to be resolved besides the accuracy of the ndings of former DILG Secretary Jesse Robredo. This should be brought to the court for resolution. In time of election preventive suspension should be held to avoid suspicion of political harassment. Anyway, if elected the administrative penalty is deemed erase, so what is the use of suspension. It only creates animosity between the supporters of either parties. I am not for Governor Garcia, but the suspension is useless because if Garcia is elected congresswoman, the administrative case has no more effect. In Malinao vs. Reyes, G.R. No. 117618, March 29, 1996, states: Pursuant to 66(b) of the Code, the penalty of suspension cannot exceed the unexpired term of the respondent or a period of six (6) months for every administrative offense. On the other hand, any administrative disciplinary proceeding against respondent is abated if in the meantime he is reelected, because his reelection results in a condonation of whatever misconduct he might have committed during his previous term. Family, a Priceless Treasure

Why would you like to be a nun? Do you not love us anymore? Reecting on the Feast of the Holy Family, this question of my father resounds in my heart for detachment from my family was one of my struggles when I was deciding to enter the convent. My family then, and up to now, is my priceless treasure. This I believe is true, especially for us Filipinos who take the pain for the needs of our family members. To promote family life and build up devotion to the Holy Family, Pope Leo XIII established a feast for the universal Church in 1921. The devotion to the Holy Family, however, developed as early as the 17th century, when Jesus, Mary, and Joseph were looked upon as the model for the ideal family life. We are now in the 21st century, and can we still say that the Holy Family is still able to speak to us as a model in living out an ideal Christian family life? Do we still value the presence of every member of our family, the love and care that we experience from them, which oftentimes lead us to have difculty in being detached or separated from them? Confronted by the realities of broken families, parental absenteeism due to overseas employment, children having difculties, indelities of husbands and wives what message can the Feast of the Holy Family convey to us? What lessons does the Holy Family teach us? We propose as follows only three among so many other possible lessons. 1. C O N C E R N FOR EVERY MEMBER OF THE FAMILY: We could imagine the anxiety of Mary and Joseph when they lost Jesus in the crowd. I remember how our parents would worry every time we went home late in the night. Parents are naturally concerned about the welfare of their children. Filipino parents work hard to send their children to college to give them a better chance in life. They usually remind their children that education is the only inheritance that they can leave to them, which nobody can take away from them. 2. CLARITY OF MISSION: The Catechism of the Catholic Church explains that in the nding of Jesus in the temple, Jesus lets us catch a glimpse of the mystery of his total consecration to a mission that ows from his divine sonship: `Did you not know that I must be about my Fathers work? (CCC 534). Jesus was so clear of his mission. He was clear of the mission entrusted to him by the Father. Consequently, he must be doing his Fathers work; he must be in his Fathers house. 3. LISTENING, OBEDIENCE, AND SILENCE: Mary and Joseph did not understand the words uttered by Jesus. But they accepted them in faith. Mary kept all these things in her heart during the years Jesus remained hidden in the silence of an

ordinary life. Obedience to parents, most of all to God, is never easy. One needs to know how to LISTEN, and this entails the capacity to be SILENT. For silence would allow us to hear what is in the mind and heart of our parents, what is in the mind and heart of God who calls us to do a particular mission in life. Jesus listened to Mary and Joseph, for this he advanced in wisdom and age and favor before God and man (Lk 2:52). He listened to the Father, thus he was able to fulll the will of the Father till the end, the mission entrusted to him by the Father. As a family, do we live according to the examples of the Holy Family? Do we show enough concern for every member of our family? Are we clear of the mission entrusted to us by the Father, not only as an individual but as a family? Do we know how to listen, be obedient and silent so that we, too, can advance in wisdom and age and favor before God and man?; so that we, too, can fulll in every moment of our individual and family life the will of the Father? If we could follow the example of the Holy Family, I am sure our family (natural, religious, or any community where we belong) will always be for us a priceless treasure!

CEBU CITY An hour after a direct assault charge was filed against him, suspended Governor Gwendolyn Garcias son filed a criminal complaint against Department of Interior and Local Government (DILG) Secretary Manuel Mar Roxas and three police officials before the City Prosecutors Office Wednesday afternoon. Pablo Paolo Garcia III charged Roxas, Police Regional Office (PRO)Central Visayas Director Marcelo Garbo, Regional Public Safety Battalion (RPSB) Chief Leopoldo Cabanag and Inspector Alvino Enguito with robbery. He cited the loss of three tents last December 19 at the Capitol, on the night the police kept the governors supporters from staying there to show their support after Malacaangs suspension order came out.

The tents were set up for the supporters of the governor who went to the Capitol to hold a prayer vigil. Before he filed the complaint past 3 p.m. Wednesday, Paolo, his friends Jose Maria Primitivo Joey Cal and Tonyson Lee were charged by Enguito with direct assault, a violation under the Revised Penal Code. Compounded with the political rumors and speculations that the policemen will forcibly drag out the suspended governor, all her siblings, relatives, friend(s) and supporter(s) (were) entrenched (in) the Capitol compound, he said. North Koreas recent rocket launch shows it has the ability to fire a rocket more than 10,000km (6,200 miles), South Korean officials say. The estimate, which would potentially put the Western US in range, was based on an analysis of rocket debris. However, there was no confirmation that the North had the re-entry technology needed to deliver a missile. Experts believe North Korea is also years away from gaining the ability to mount a nuclear bomb on a missile. North Korea launched the Unha-3 rocket on 12 December, in defiance of sanctions and international warnings. It was the first time the North had made successful use of a three-stage rocket to put a satellite into orbit, and observers said it appeared to mark a step towards fielding an intercontinental range ballistic missile. As a result of analysing the material of Unha-3 (North Koreas rocket), we judged North Korea had secured a range of more than 10,000km in case the warhead is 500-600kg, a South Korean defence ministry official told journalists. Crude The official said the type of oxidiser container that was found from the first stage of the rocket launch would rarely be used by countries with advanced space technology. Welding was crude, done manually, the official said. South Korea would not be able to tell whether the North had the technology to achieve re-entry until debris from the second and third stages of the rocket launch was analysed, the defence ministry said. The UN Security Council condemned this months rocket launch. It said it violated two UN resolutions banning Pyongyang from missile tests, passed after it conducted nuclear tests in 2006 and 2009. The rocket was celebrated extravagantly in North Korea, with a mass rally held in the capital, Pyongyang. The Norths leader, Kim Jong-un, called for the development and launching of a variety of more working satellites and carrier rockets of bigger capacity at a banquet to mark the launch on Friday, North Korean state media reported.
