Tel Aviv District Court 1752-08 Moseh Silman et al v Bituach Leumi et al Request for A. Due Process, and B. Appointment Record of Notice of Simulated Service of Judge Hagai Brenner's August 30, 2012 Decision . 1. Requester1, Dr Joseph Zernik, has filed a series of requests to inspect and to copy, for certification by the Clerk of copies of court decisions, for recusal of Magisrate/District Judge pro tem Hagai Brenner, for expediting process and/or for due service of the Court's decisions in the cases, related to Moshe Silman, 13491/2008, 1752-08, and 6909-01-10. [i] 2. The Requester1 filed all his papers duly signed in the office of the Clerk of the Court. 3. The Requester1 served all his papers on the parties by certified mail with certificates of delivery, and sent certificates of service to the office of the Clerk of the Court for each and every service he executed. Service was never conducted by phone or by electronic mail. 4. The online public access system Net HaMishpat, does not permit the Requester1, or the public at large to view a list of records that were entered into registration by the Court. Therefore, the Requester1 cannot ascertain, which of the papers, which he filed, and which were presumably received for registration, were indeed registered by the Court in cases 1752ii 08 and 6909-01-10. [ ] 4. To this date, all records, which were received by the Requester1 from the Court were not signed by a judge/magistrate and not certified by a clerk, including the latest two decisions in the name of Magistrate Avigail Cohen. The Court continues to ignore the Requester1's requests that the Court serve on him signed and certified papers. [iii] 5. Requester1 claims that a reasonable person cannot accept the unsigned, uncertified papers, provided by the Court, as valid judicial records of the Tel-Aviv District Court, and therefore, the mailing of such records cannot be considered as valid service of such papers in instant case. 6. Additionally, during the recent filings in the Court, clear differences were discovered, in the manner in which the office of the Clerk of the Court handles the cases, listed above, related to Moshe Silman in the Tel Aviv District Court: a) Case 13491/2008 - under this number, the original Silman complaint was purportedly registered. The office of the Clerk of the Court refused to receive a request to inspect and to copy under this number, claiming that it had never existed. b) Case 1752-08 under this number, the original Silman complaint was purportedly litigated. Under this number, the Requester was permitted to file papers, and the papers were purportedly received for registration. However, to this date, not a single decision, either by Magistrate Hagai Brenner, or by Magistrate Avigail Cohen has been received signed or certified. Regardless of repeated requests by the Requester1, the Court continues to issue unsigned, uncertified records. c) Case 6909-01-10 under this number, the Silman appeal was purportedly registered and litigated. Under this number, the Requester was permitted to file papers, and the papers

were purportedly received for registration. However, to this date, not a single decision has been received from the Court in this case. 7. Additionally, the following findings were discovered under inspection of the online public access system of the Court: a) Case 1752-08 Hagai Brenner, in his hat of Magistrate, purportedly affected the closing of Silman's original complaint. b) Case 6909-01-10 Hagai Brenner, in his hat of District Judge pro tem, purportedly affected the closing of Silman's appeal from Hagai Brenner's own decision under Case 1752-08. [iv] c) Case 1752-08 purported decisions of the Court, which were received by the Requester1 iii by mail from the Court, fail to appear in the online public access system of the Court.[ ] d) Case 6909-01-10 purported November 4, 2012 Decision by District Court Ofra Cherniak, in re: Request by Appellant1 [sic-jz] in general, including expediting process" appears in the online public access system of the Court. The "Decision" has not been received by the Requester1 to this date. [iv] 8. Requester1 filed in March and April, this year, requests with the Administration of Courts, pursuant to the Freedom of Information Act (1988), for the Appointment Record of Chief Clerk Kobi Bleich of the Tel Aviv District Court. The Administration of Court refused and continues to refuse to respond on the Requests with no legal foundation. [v] 9. Additional findings were reviewed in a report, filed by the Requester1 with the Human Rights Council of the United nations, point out the invalidity and lack of integrity of the electronic records of the courts of the State of Israel and raise serious concerns regarding vi validity and integrity of the offices of the clerks in the courts of the State of Israel. [ ] 10. Therefore, taking into account all the above, a reasonable person is likely to conclude, or at least be concerned that: a) That conduct of the office of the Clerk of the Court, relative to the cases, listed above, is outside the framework of the law, and that the three files, and respective proceedings, related to Moshe Silman in the Tel Aviv District Court - 13491/2008, 1752-08, and 690901-10 were and/or are conducted as simulated court files and simulated proceedings. b) That in the Tel Aviv District Court the office of the clerk is managed by a Chief Clerk, who had never been lawfully appointed, and therefore, is a simulated Chief Clerk. 11. The Requester1 claims that the findings, described above, are inconsistent with the Human Rights for Fair and Public Hearing and for Equal Protection under the Law. Therefore, the Undersigned requests: a) That the Court serve its decision on instant request, singed by a magistrate or a judge, and attached to a transmittal letter, signed by an authorized person in the office of the clerk. b) That the Court enter in instant case an order on Chief Clerk Kobi Bleich to produce his Appointment Record to the parties in this case, including Requester1.
