In addition, the Clients hold or may hold claims (Claims) as such

term is defined in section 101 of title 11 of the United States Code (the Bankruptcy Code) against Mervyns Holdings, LLC, Mervyns LLC and Mervyns Brands, LLC (together, the Debtors). Such Claims include Claims arising from nonresidential real property leases entered into with the Debtors. The Claims may also include, but are not limited to, claims arising under other contractual agreements, unsecured claims, administrative claims, other secured claims, setoff and recoupment rights, if any, and claims arising under section 502(h) of the Bankruptcy Code. Paul Weiss and Klehr Harrison cannot, at this time, specify the amount or nature of these Claims. Paul Weiss and Klehr Harrison reserve the right to supplement this statement as and when they are able to specify the amount and type of Claims held by the Clients. 5. Each of the Clients has retained Paul Weiss and Klehr Harrison to

represent its individual interests in connection with the above-captioned cases. 6. Upon information and belief formed after due inquiry, Paul Weiss

and Klehr Harrison do not hold any claims against or equity interests in the Debtors.
