En la Gaceta Oficial N38.894 de fecha 29 de marzo de 2012, fue publicada la Providencia Administrativa N 059 emanada de la Superintendencia Nacional de Costos y Precios, por medio de la cual se fijan, en todo el territorio nacional, el Precio Mximo

Publication of Order that sets the maximum prices for the products therein indicated

Administrative Order N 059, issued by the Office of the National Superintendent of Costs and Prices, was published in Official Gazette N 39,894 of march 29, 2012. Such Order provides for the Maximum Retail Price for Manufacturers and/or Importers, Wholesalers-Distributor, RetailersDistributor, and General Public or Final Consumer, of the food, personal care, and sanitation items listed below: Pasteurized fruit juices; Jarred baby food; Mineral water; Hair conditioner; Bath soaps (bar and gel); Hair shampoo; Toothpaste; Softeners and rinses. Antiperspirants (bar); Antiperspirants (liquid, gel or spray); Disposable baby diapers (size S, M, L, XL and XXL); Sanitary pads Toilet paper; Disposable shaving razors (2, 3 and 4 -blade); Dishwasher (liquid or gel); Dishwasher (cream); Detergents; Bleach; Floor finishes; Cleaners (disinfectants); Laundry bar soap.

Los precios que se indican en dicha Providencia para cada una de las presentaciones de los mencionados productos no incluye IVA. Al respecto se establece que en el marcaje de precio mximo de venta al pblico , se debe diferencia este concepto y la alcuota del Impuesto al Valor Agregado. Asimismo, se establecen una serie de restricciones respecto a la implementacin de los eslabones correspondiente a la cadena de comercializacin, As por ej. Cuando un productor venda directamente al vendedor al detal, el precio mximo de venta no podr exceder el precio mximo de venta de productor. Los precios mximo s de venta al Pblico establecidos en la Providencia, debern ser impresos, rotulados, inscritos o marcados en forma indeleble y en un lugar visible en el envase, empaque o envoltorio final por el productor, para lo cual tendr plazo hasta el dos (02) de mayo de 2012.

Prices indicated in such Order corresponding to the different product presentations do not include VAT. In this regard, the Order sets forth that the maximum retail prices marked shall differentiate such price and the Value Added Tax rate. Likewise, several restrictions are established regarding the implementation of the links corresponding to the commercialization chain; e.g., when a manufacturer sells directly to the retailer, the maximum retail price shall not exceed the maximum sales price of the manufacturer .

Maximum Retail Prices for the General Public set forth in the Order must be printed, labeled, recorded or marked indelibly and in a visible place on the container, packaging or wrapper by the manufacturer before May 2, 2012.

Los propietarios o responsables de los establecimientos comerciales al detal, deben exhibir con preferencia los productos sealados en esta providencia administrativa, respecto del producto similar. Las empresas productoras que notificaron productos al SISAP de conformidad con las Providencias 007 y 019, cuyo precio fue determinado antes del 23 de noviembre de 2011, que no aparecen en la Providencia, y que no lo informaron debidamente ante la SUNDECOP, no podrn venderlos a un precio superior a los notificados a dicho sistema, hasta tanto no se determine su Precio Mximo de Venta. Los sujetos de aplicacin que infrinjan la mencionada Providencia Administrativa, sern sancionados conforme lo establecido en el Decreto con Rango, Valor y Fuerza de Ley de Costos y Precios Justos. Igualmente, los sujetos de aplicacin que incurran en los supuestos de especulacin, acaparamiento, usura, no fabriquen ni comercialicen, o se nieguen a la venta y que realicen prcticas evasivas de cualquier naturaleza u otra prcticas conexas, para no cumplir con los Precios Mximos de Venta al Pblico o Consumidor Final, sern sancionados conforme la ley que regula la materia. Los precios fijados en esta Providencia Administrativa entrarn en vigencia el 1 de abril de 2012. Finalmente, se dejan sin efecto los actos que hayan fijado con anterioridad precios a los productos previstos en el artculo 4 de la providencia.

The owners or managers of retail premises must preferably display the products listed in this administrative order than the like products. For manufacturing companies that notified their products to SISAP in conformity with Orders 007 and 019, the price of which was determined before November 23, 2011, but not included in the Order, and this was not duly reported to SUNDECOP, such products shall not be sold at a price exceeding that notified to such system, until the Maximum Retail Price thereof is determined. Individuals or corporations ruled thereunder that violate this Administrative Order shall be punished as provided in the Decree with Rank, Value and Force of Law of Fair Costs and Prices. Likewise, whoever incurs practices of speculation, hoarding, usury, non-manufacturing or non-sale, or refuses to sell, and undertakes evasive practices of any kind or further related actions, resulting in non-observance of the Maximum Retail Price for the General Public or Final Consumer, shall be punished in conformity with the applicable Law. Prices published in this Administrative Order will enter into force from April 1st, 2012. Lastly, records that have previously set prices for the products set out in Article 4 to the Order are hereby derogated.
