Please explain relevant legal requirements and procedures STLS 20 K3
covering confidentiality and the disclosure of information in
your setting

As a teaching assistant all information must be treated


confidentially as stated in the Data Protection Act 1998, any
information must be stored as stated in the Act and all member of
staff must be familiar with this and follow the guidelines.

In my role I ensure that no information is passed on to any third


parties and always checking with my line manager if I am unsure. If
a parent gives me information about a child, I ensure this
information is recorded correctly and following school policies and
passed on the relevant members of staff.

Schools ask parents for a range of information so that we are able


to care for children as effectively as we can. However we can only
ask for information that is directly relevant, such as health or
medical information, records from previous schools or records for
children who have special educational needs. All this information is
confidential and must only be used for the purpose for which it was
gathered. If the information is to be passed onto others, parents
consent must be given.

Respecting confidentiality is very important. When working in a


childcare setting there is certain information that has to be
gathered in order to work effectively. This information includes:
Names.
Contact numbers and addresses.
Medical information.
Dietary needs.
Family changes.
SEN
To give out any of this information is a breach of confidentiality. It
should only be passed on, on a need to know basis. For example,
Certain information may need to be passed on to other
team members.
Information that deals with the childs health, well-being/ welfare
or protection.

Data protection Act 1998.


Covers both paper and electronic records.
Individuals have a right to see all information stored about them.
You have the responsibility to ensure information is correct.
You have the responsibility to keep information confidential.

Confidentiality is important within the school. The information given


by the parents is information concerning the family and their
children and is given in trust. All records are stored safely so that
access is restricted to only those who are involved. This information
must only be shared with the people who are directly involved with
the child such a named carer, any staff members which work with
the child and the Head Teacher. Lack of confidentiality can have
serious impact on parents and their children and by betraying their
trust it will damage the working relationship. The Data Protection
Act 1998 is a piece of legislation that outlines this. This is an act
that is designed to prevent personal information from being passed
on or held onto unnecessarily. The act covers handwritten personal
information a well as information stored on computers.
