Ss 9 OP ay mae . _— DEMOCRATIC PARTY COMMONWEALTH OF PUERTO RICO THE RULES OF THE DEMOCRATIC PARTY OF THE COMMONWEALTH OF PUERTO RICO ‘As Amended by the DPCPR March 2008 Rules of the Democratic Party of the Commonwealth of Puerto Rico 1. _ Statement of Principles ‘The Democratic Party of the Commonwealth of Puerto Rico (hereinafter referred to as “DPCPR”) hereby adopts the following statement of principles and beliefs: We believe that the Democratic Party of the United States of America, with its great diversity, its historic role in being the voice for the needs of the Hispanic community, and its instinetive responsiveness to the human needs and aspirations, is the adequate instrument to provide the leadership demanded in the challenging times we live. We frther believe that the Democratic Party responds to the needs of the people of Puerto Rico and will provide our people ‘a responsible and responsive government. Therefore, DPCPR stands for the following: a. A society where the rights of all Hispanics and minorities ate fully scoured ‘and where no one is denied the opportunity for a better quality of life, b. A society where both public and private discrimination based upon race, sex, age, color, creed, sexual orientation, national origin, religion, ethnic identity, economic status or physical disability are condemned and where our government moves aggressively to end such discrimination through lawful means; ¢. That government fimetions best when it is closest to the people; . That all Democrats are bound to defend and protect the founding principles of our Party; fe. We stand for individual freedom in the framework of meaningful participation by all citizens, £ Asociety where the elderly, the veterans and the disabled can lead lives of dignity; g. A society where all workers are guaranteed without question the right to join unions of their own choosing and to bargain collectively for decent ‘wages and conditions of employment; and hh. A society where a sound education, proper nutrition, quality medical care, affordable housing, safe streets and a healthy environment are possible for every citizen. To achieve these principles and beliefs, we hereby make these declarations and adopt the following Rules to govern the organization and conduct of business by the DPCPR: e. The DPCPR shall be open to all who desire to support the aforementioned principles and beliefs, who wish to be known as Democrats, and who do not Support or participate in the affairs of any other party that nominates candidates for the Presidency of the United States or publicly supports or campaign for any Republican candidate for any office in any jurisdiction of the United States of America. ‘No Democrat in Puerto Rico shall be denied the right to vote in any process based solely on the person’s preference regarding the political status of Puerto Rico. Neither test of membership in, nor oats of loyalty to, DPCPR shall be required or used if it has the effect of requiring prospective or current members of the Democratic Party to acquiesce in, condone, or support discrimination on the grounds of race, sex, sexual orientation, age, color, creed, national origin, religion, ethnic identity, economic status or disability. DPCPR, at all levels shall support the broadest possible voter registration and participation without diserimination on the grounds of race, sex, age, color, sexual preference, ereed, national origin, religion, ethnic identity, economic status or disability DPCPR shall take affirmative steps to encourage young people, members of the underrepresented minorities to seek selection as Delegates to Party Conventions ‘and as members of Party Committees so that they shall be represented in reasonable relationship to their presence in the state. Every person who accepts a Party office at any level (including, the position of Convention Delegate and Altemate) must agree to support all of the Party's nominees or shall be removed. Public meetings at all levels of DPCPR shall be open to all members of the Party, regardless of race, sex, age, color, sexual preference, creed, national origin, religion, ethnic identity, economic status, philosophical persuasion or disability The time and place of all meetings of DPCPR shall be publicized fully and in such manner as to assure timely notice to all interested persons. Such meetings shall be held in places accessible. Timely notice may appear as legal notice, paid of non paid media, news item, direct mail, radio or television or in any other form as may reasonably be designed to notify Democrats of the meeting. DPCPR is not required to purchase paid advertisement for a meeting. No person may allege to the Democratic National Committee that DPCPR has failed to provide full pasticipation in all party affairs to comply with the provisions of this rule until he br she have filed and obtained a resolution of a challenge or complaint under the applicable Rules and Regulations of the Democratic National Committee. If challenged, DPCPR shall be deemed to be in compliance with the notice requirements upon proof of eflfetive notice by the Party. Ifa challenge is set forth alleging non compliance with the aforementioned, the alleged non compliance shall be referred to the Democratic National Committee for review, provided that any person alleging non compliance shall be a resident of Puerto Rico and provided that any person alleging non compliance with these rrles shall have exhausted all remedies provided by DPCPR. nL. General Provisions a h Name- The name of this Party shall be “Democratic Party of the Commonwealth of Puerto Rico, The official name in Spanish shall be “Partido Demeéerata del Estado Libre Asociado de Puerto Rico” Seal- The official seal of The Democratic Party of the Commonwealth of Puerto Rivo shall be the following: P99 OF aap eas EA we DEMOCRATIC, PARTY “Availability of Rules- These rules have been sent to the Secretary of the Democratic National Committee and to the Puerto Rico's State Elections Commission. Membership i. Any qualified Puerto Rico voter eighteen “18” years of age or older who supports the foregoing "Statement of Principles" contained in Article I may participate fully in any Party meetings and may be clected to any Party Office, except where specifically prohibited by law or by Party Rules. ii, Any other persons who support the foregoing "Statement of Principles" of the Democratic Party are encouraged 1o participate in Party activities but may not vote. ‘Amendment of Rules- These rules may be amended by a majority of the total membership of the Central Committee, provided that reasonable notice shall have been given of the amendments of the Rules no less than. fifteen (15) days and that the amendments are pre-approved by the Executive Committee. Proxy Voting- There will be no proxy voting, Quorum- No ess than 35% of the total membership of the Central Committee shall constitute a quorum for the conduct of business, Ex Officio Members and Distinguish Party Leaders are not to be counted for the purposes of determining Quorum, Other Rules i. Unless otherwise requited by statute or by these Rules, the eurrent edition of Robert's Rules of Order, Newly Revised shall be the parliamentary authority governing all Party Committee meetings and procedures. ii. Atall times and at all levels of DPCPR, no secret ballots shall be used, no fees shal] be charged for voting, and the meetings shall be open. iii, ‘The method of voting at all Party Committee meetings may be by voice vote, by (standing) division of the house, by signed written ballot, or by roll call vote. The method used shall be left to the discretion of the Chair, except that on request of any member (who need not be recognized by the Chair to voice such request), a standing division must be held, and the request of 20% of the members present shall require a roll eall vote. TH. Central Committee And Executive Committee DPCPR shall be organized in a Central Committee and an Executive Committee, a. Members of the Central Committee of the Democratic Party of the Commonwealth of Puerto Rico i. The Central Committee of DPCPR shall be composed by the following members: State Chair Vice-Chair of the opposite sex from the State Chair Vice Chair for Finance Treasurer Parliamentarian General Counsel Secretary Executive Director Affirmative Action Director 10. President of the Young Democrats in Puerto Rico 11 National Committee Members that reside in Puerto Rico. 12. There shall be two (2) members elected from every senatorial district in Puerto Rico which shall be gender balance, one woman and one man. 13. There shall be ten (10) members At Large which shall be gender balance, one woman and one man. Officio Members and Distinguish Party Leaders- a Democratic Governor, former Democratic Governors, Democratic Member or Former Democratic Members of Congress and former State Chairs shall be ex-officio PRI ABVaAYNe members of the Central Committee. Ex-officio members shall not count for quorum determination. b. Exceutive Committee of The Democratic Party of the Commonwealth of Puerto Rico i, The Executive Committee of DPCPR shall be composed by the following members of the Central Committee: 1, State Chair 2, Vice Chair 3. Vice Chair for Finance 4, Treasurer 5. Parliamentarian 6. Secretary 7. Affirmative Action Director 8. General Counsel 9. National Committeemen 10. National Committeewoman ii, Following the election of the State Chair, but no later than four (4) weeks of its election, the Executive Committee shall appoint the Vice-Chair, Viee Chair for Finance, and Treasurer. The Affirmative Action Director, the General Counsel and Parliamentarian and the Executive Director of the DPCPR are appointed by the Chair iii, The Executive Committee, at the request of the Chair, will meet regularly during the calendar year to discuss general party affairs, including but not limited to Party Rules, delegate selection plan, fund raising events, make appointments, create advisory committees and coordinate political strategies. c. Manner of the Election of State Chair and the Two Members from Every Senatorial District and At Large Members i. The election of Chair, the two (2) members elected from every senatorial district and the ten (10) At Large members shall occur within the calendar year of the presidential election but prior to the Democratic National Convention in a General Assembly of DPCPR. ii, The two (2) members from every senatorial district and the ten (10) At Large members shall be gender balance, one women and one man, iii, Members of the Central Committee, delegates that participated in the immediately preceding Democratic National Convention and the delegates that will participate in the next Democratic National Convention (if selected prior to the election of the Chair and the two members from every senatorial district) shall participate with one vote each in the election of the State Chair, tne two members elected from every senatorial district and the ten (10) At Large Members. iv. Ifa Member of the Central Committee was also a Delegate to the immediately preceding Democratic National Convention, or was elected a Delegate to the next Democratic National Convention, he/she shall be entitled to only one vote in the election of the State Chair, the Two Members from Every Senatorial District, At Large Members and National Committee Members. ¥. The candidates for the positions stated in Article 3 (b) (i) shall file a timely notice of candidacy with the Seoretary of DPCPR no later than the second Friday of the month of April at 5:00 p.m, of the year in which the presidential national election takes place. The notice of candidacy shall siate the candidate's occupation, county of residence, post office address, date of birth, and the office sought, Such Statement of Candidacy shall be available at the Offices of the Democratic Party. yi. The notice of candidacy not received by the deadline of the second Friday of the month of April shall not be accepted. The deadline shall be extended until the next working day if it falls ona weekend or a holiday. d. Manner of the Election of National Committee Members i. ‘The Chair and the highest ranking officer of the opposite gender of the DPCPR shall be members of the DNC pursuant to Article 3, Section 2(a) of the Charter of the DNC. ii, The Central Committee, pursuant to the procedure established in these Rules, shall select one National Committeeman and one Committeewoman to which the Charter and By-Laws of the DNC entitles Puerto Rico. iii, ‘The election of these National Committee members apportioned to Puerto Rico by the DNC shall occur within the calendar year of the presidential election but prior to the Democratic National Convention in an open General Assembly of DPCPR. iv. Members of the Central Committee, delegates that participated in the Jast Democratic National Convention and the delegates that will participate in the next Democratic National Convention (if selected prior to the election of the DNC National Committee Members) shall participate with one vote each in the election of the State Chair and the two members elected from every senatorial district. vi vii Dur: The candidates for the National Committee Members shall file a timely notice of candidacy with the Secretary of DPCPR no later than the second Friday of the month of April at 5:00 p.m. of the year in which the presidential national election takes place. The notice of candidacy shall state the candidate’s occupation, county of residence, post office address, date of birth, and the office sought, Such Statement of Candidacy shall be available al the Offices of the Democratic Party. The deadline shall be extended until the next working day if it falls on a weekend or a holiday, Ifadditional membership to the DNC is apportioned to the DPCPR, the Central Committee shall elect those members as equally as practicable between man and woman, n of Term- The term for the members of the Central Committee will commence on the day the National Convention adjourns and terminating the day the next convention adjourns, Duties of Officers of the DPCPR i State Chair - The State Chair shall be the principal and presiding officer of DPCPR, shall have all of the authority and duties implied by such title and expressed and implied by these Rules, and shall have the authority to establish and to appoint committees with the advice and consent of the Executive Committee and deal with the affairs of the Party. The Chair will preside all meetings of the Central and Exeeutive Committee. The Chair shall issue calls for all meetings of the Central and Executive Committee, as well as the General Assembly, and shall give written notice to all members and officers at least five (5) days prior to the date of the meeting. ‘The Chair will be coordinating all the fund raising effort fo support the Democratic Party, the DNC and the national candidates of the Democratic Party. The Chair shall have the authority to appoint an
