Tam writing regarding my FOTA request of June 16, 2015, which was assigned FOIA.
case number F-2015-02300. As the message copied below demonstrates, I was
informed that the estimated completion date for this request was “March 2016.” I
have not yet received responsive documents, nor have I received an updated
estimated date of completion. Please advise me as to the status of this request and
provide a new estimated date of completion.
‘When requesting an estimated date of completion 5 U.S.C. § 552(a)(7) states, in
pertinent part, “Each agency shall ... provide[ ] information about the status of a
request to the person making the request ... , including ... an estimated date on which
the agency will complete action on the request.” Pursuant to this statute, I hereby
formally request that the State Department provide me with a written estimated date
on which the agency will complete action on this FOIA request(s). A mere statement
of the request’s place in your queue will not satisfy this status request. Similarly, a
statement that the agency has a significant backlog of requests and cannot provide an
estimated date of completion will not satisfy this status request. Only “an estimated
date on which the agenev will complete action on the reanest” will satisfy this statusrequest and the agency’s statutory responsibility.
Thank you for your help in processing this request. I look forward to hearing your
response within the statutory time limit. If you have any questions, or believe

Per our conversation on February 25, 2016, regarding your case: F-2015-
02300. An email was sent to a Sean Dunagan on February 24, 2016 with
the estimated completion date of March 2016 as well.
This is the current ECD — March 2016.
ECDs are subject to change and are “strictly” estimates and not intended
to be used as “actual” dates of completion, due to various extenuating
factors, which are beyond the control of the Branch, which may or may
not include coordination with other Agencies during the process
(referrals, concurrences, etc.). Interim release dates are provided, as
applicable.
