JUDGMENT
CASEOFTHEPROSECUTION:
1. Statingbriefly,thefactsofthecase,asborneoutfromthe
chargesheetarethatonreceiptofinformationon21.02.2013videDDNo.
36AtoW.SINeeraj,shealongwithCt.DevenderreachedatH.No.A1,
Block,GaliNo.27,BengaliColony,SantNagar,BurariwhereSIRajeev
wasalreadypresent.SIRajeevhandedovercounsellingreportandcopyof
MLCofProsecutrix'J'toW.SINeeraj.

Prosecutrix'J'madeherstatementwhereinshestatedthatshe

isastudentofB.A.[Pass].Sheallegedthaton16.02.2013atabout2PM,
BhabhiofAccusedRupesh,wholivesinfrontofhishouse,calledherto
repairabulbinherhouse. WhenshereachedthereRupeshwasalready
presentthere.Aftersometime,fatherofRupeshcametherewithabottle
andhandedoverthesaidbottletoAccusedRupeshandleftfromthere.
Thereafter, Accused Rupesh forcibly made her consume that bottle and
after consuming the same, she became unconscious. She regained her

consciousnessatabout4PMandrealizedthatshehadbeenrapedforcibly.
Shecametoherhousebutdidnotdiscloseanythingtoanyone.

Complainant 'J'furtherstatedthaton19.02.2013 atabout 8

AMshereachedathouseofAccusedRupesh,wheretenantofRupesh,his
sister, his Mausi and Mausa werealready present. She asked Accused
Rupesh as to why he had committed rape upon her, on this Bhabhi of
Accused apologized from her. Upon this Accused Rupesh pushed her
statingthat'Tujhejokarnahai,karle'.MausaofAccusedalsostatedher
to commitsuicide. Thereafter,shemadeacall at100number,buther
father and father of Accused compromised the matter on 20.02.2013
stating it to be 'cherkhani'. Prosecutrix 'J' further alleged that on
20.02.2013atabout89PM,onseeingher,AccusedRupeshtauntedher
'Abtukatichipkalikitarahghoomegi'.Shestatedthatsheconsumed'All
Out'mosquitorepellentoutofdepressionandwasadmittedtoHinduRao
Hospital. On 21.02.2013 shewasdischarged fromthehospital madea
complaintagainstAccusedRupesh.

On the basis of aforesaid, the present case was registered

under Section 328/376/34 IPC. During investigation, W. SI Neeraj


preparedsiteplanattheinstanceofProsecutrix.StatementofProsecutrix
was got recorded under Section 164 CrPC. Thereafter, further
investigationwastransferredtoW.SISantoshSirohiasW.SINeerajwas
gottransferred.SISantoshSirohiobtainedNBWsofAccusedRupeshand
Bhagirathfromcourt,buttheycouldnotbefound. Thereafter,Accused
Rupesh surrendered before the court and he was arrested. Disclosure
statement of Accused Rupesh was recorded. One day police custody
remand of Accused Rupesh was obtained and at his instance, place of
incidentwasinspected.Accusedwasgotmedicallyexamined.Hisblood
samplewasseizedandtakenintopolicepossessionanddepositedthesame
inmalkhana. PotencytestofAccusedwasgotconductedfromForensic
Expert,SubziMandi,Mortuary,Delhi. Thereafter,Accusedwassentin
judicialcustody.

Anticipatory bail of Accused Bhagirath Mathur, Vinod and

Satyawatiwasgranted. Duringinvestigation,SISantoshSirohiobtained
ageproofofAccusedRupeshasperwhichthedateofbirthofAccused

was15.02.1995.ExhibitsofAccusedi.e.bloodsamplewassenttoFSL.
Thereafter,W.SISantoshSirohiwastransferredandfurtherinvestigationof
thiscasewasassignedtoW.SIMukeshDevi.W.SIMukeshDeviarrested
AccusedBhagirathandreleasedhimashewasalreadyonanticipatorybail.
AccusedVinodandSatyawatiwerekeptinColumnNo.12astherewasno
sufficient evidence against them for arrest. The learned MM directed
issuanceofsummonsonlyagainstRupeshandBhagirthandcommittedthe
caseforSessionstrialaftercomplyingwithprovisionsofSection207Cr.PC.
CHARGE:

Aftercommittalofthecase,onthebasisofmaterialonrecord,

AccusedRupeshwaschargedforoffencepunishableunderSection328/376
IPCwhileAccusedBhagirathMathurwaschargedforoffencepunishable
underSection328r/wSection109IPC. BothAccusedpleadednotguilty
andclaimedtrialwhenthechargeswerereadoverandexplainedtohim.

PROSECUTIONEVIDENCE:

Prosecutrix'J'wasthefirstwitnessexaminedonrecord. Her

testimonyshallbediscussedindetaillateroninthecourseofthejudgment.

PW2 is Sh.S.S.(name withheld), father of Prosecutrix. He

deposedthaton19.02.2013,Prosecutrix informedhimonphonethatshe
hadmadeacallat100numberregardingquarrelwithAccusedRupeshand
hisfamily.HecalledherattheshopatChandniChowk.Policecalledthem
atPS,buttheyshowedtheirinabilitytocometothePSonthatday.

On 20.02.2013, he along with Prosecutrix 'J' went to PS.

AccusedRupeshandhisfatherBhagirathwerepresentinthePS.Accused
persons apologized for their conduct in the PS and requested him to
compromisethematter.Thereafter,theydidnotmakeanycomplaintagainst
themandthematterwascompromisedbetweenthem.

PW2 further deposed that on 20.02.2013, in the evening,

AccusedRupeshcameinfrontoftheirhouseandhetauntedonProsecutrix

bysayingthattukatichipkalikitarahrahegi.Thereafter,Prosecutrix'J'
consumed'AllOut'liquid.Hemadeacallat100number.Prosecutrixwas
takentoHinduRaoHospital,whereshewasadmittedandwasdischarged
onthenextday.

PW2furtherdeposedthatwhentherewerecomingbackafter

gettingProsecutrix'J'dischargedfromthehospital,onthewayshetold
himthatAccusedRupeshhadcommittedrapeuponheron16.02.2013at
hishouseandalsotoldtheentirefacts.Thereafter,theymadeacomplaint
to the police and got registered the FIR. Prosecutrix was given
counselling.ShewastakentoArunaAsafAliHospitalbythepolicefor
hermedicalexamination.Policerecordedhisstatement.

PW8 Dr. Vishakha Nagraj proved the MLC Ex. PW8/A of

Prosecutrix,preparedbyDr.ReemaMehta,whohassincelefttheservices
ofhospitalandherpresentwhereaboutsarenotknown.

PW10 Dr. Abhay Parkash deposed that he had medically

examinedProsecutrix'J'videMLCEx.PW10/Aon20.02.2013whenshe
wasbroughttoHRHhospitalwithallegedhistoryofconsuming'AllOut'at
home.

PW11 Dr.GeetaprovedtheMedicoLegalInjurysheet No.

1161/13 dated 21.02.2013 Ex. PW11/A of Prosecutrix 'J', which was


preparedbyDr.SohrabKhan.
PoliceWitnesses:

PW3Ct.Devenderdeposedthaton21.02.2013hewasposted

atPSBurari.Onthatday,atabout9.30PM,DDNo.36Awasreceivedby
W.SINeeraj.HealongwithW.SINeerajreachedatABlock,GaliNo.27,
BengaliColony,Burari. SIRajeevofPSBurarialongwithoneCt.met
them there and he handed over some documents to W. SI Neeraj.
Prosecutrix'J'wasalsopresentthere.W.SINeerajmadeenquiriesfrom
the Prosecutrix and recorded her statement and prepared a rukka and
handedoverthesametoPW3,whichhetooktoPSforregistrationofFIR.
PW4 Ct. Devender handed over the rukka to Duty Officer. After
registration of FIR, Duty Officer handed over original rukka and

computerizedcopyofFIRtohim.Hecamebacktothespotandhanded
overtheoriginalrukkaandcopyofFIRtoW.SINeeraj.IOalsorecorded
statementoffatherofProsecutrix.IOinspectedthespotattheinstanceof
theProsecutrixandpreparedthesiteplanofthehouseoftheProsecutrix.
TheyalsowenttothehouseofAccusedRupesh,wholivesnearby,buthe
wasnotfoundthere.MotherofAccusedRupeshwasfoundpresentthere.
Prosecutrix was taken to Aruna Asaf Ali Hospital for her medical
examinationwhereshewasmedicallyexamined. Theyalsomadesearch
fortheAccusedRupesh,buthecouldnotbefound.TheycamebacktoPS.
IOrecordedstatementofPW3.

PW4W.SINeerajdeposedthaton21.02.2013shewasposted

asSIatPSBurari.Onthatday,onereceiptofDDNo.36AEx.PW4/A,
shealongwithCt.DevenderreachedatGaliNo.27,BengaliColony,Sant
Nagar, Burari. SI Rajeev met her there. SI Rajeev produced the
Prosecutrix'J'beforeherandalsohandedover MLCofProsecutrixand
some other relevant documents to him. She recorded the statement of
Prosecutrix which is already Ex. PW1/A and prepared a rukka thereon

whichisEx.PW4/BandhandedoverthesametoCt.Devender,whotook
ittoPSforregistrationofFIRandhandedovertheoriginalrukkaandcopy
of FIR to her. W.SI Neeraj inspected the spot at the instance of the
Prosecutrixandprepared thesiteplanwhichisalreadyEx.PW1/Dand
took the Prosecutrix to Aruna Asaf Ali Hospital and her gynecological
examination was got conducted there. Thereafter, PW4 alongwith the
Prosecutrixcameback tothehouseoftheProsecutrixandrecordedthe
supplementarystatementofProsecutrixandstatementofherfather.They
came back to PS and recorded the statement of Ct. Devender and SI
Rajeev.

PW4 W. SI Neeraj further deposed that on 27.02.2013,

statementofProsecutrixwasgotrecordedunderSection164CrPC. She
collectedthecopyofthesame. On28.02.2013Prosecutrixhandedover
thecopy of hermarksheet ofclass Xalready markedasMarkPW1/X,
whichsheseizedvideseizurememoalreadyEx.PW1/C.On20.03.2013
shehandedoverthecasefiletoMHC[R]asshewastransferredfromPS
Burari.

PW5ASIJaswant wastheDutyOfficer,whorecordedFIR

No.61/2013PDBurari,computerizedcopyofwhichisEx.PW5/A.

PW6SIRajivdeposedthaton20.02.2013hewaspostedasSI

atPSBurariandwasonnightemergencydutyfrom8PMto8AM.On
thatday,atabout10.15PM,hereceivedDDNo.42AEx.PW6/Athatone
girlhasconsumed'AllOut'.Onreceiptofthesaidinformation,healong
withoneConstablereachedatA1Block,GaliNo.27,BengaliColony,
Delhi.There,hecametoknowthatthegirl,whohadconsumed'AllOut'
has already been taken to Bara Hindu Rao Hospital by the PCR. He
reachedatPSBaraHinduRaoandcollectedtheMLCoftheProsecutrix,
whohadbeendeclaredunfitforstatementbythedoctorsandreturnedto
thePSalongwithMLC.

PW6 further deposed that on next date 21.02.2013, he

receivedinformationthatProsecutrixisdischargedfromthehospital.He
wenttoherhouseandmadeenquiriesfromherandalsogothercounseled
throughaladycounselor.PW6calledW.SINeerajfromPSandhanded

overthecounsellingreportandMLCofProsecutrixtoW.SINeerajandhe
wasrelieved.IOrecordedhisstatement.

PW7 W. SI Mukesh Devi deposed that on 23.09.2013, this

casewasassignedtoherforfurtherinvestigation. Shereceivedthecase
file from MHC[R]. On 18.10.2013, she formally arrested the Accused
Bhagirath videarrestmemoEx.PW7/Aandreleasedonbailashewas
already on anticipatory bail. After completion of investigation,
chargesheetwaspreparedagainstAccusedRupeshandAccusedBhagirath
andfiledincourt.

PW9SISantoshSirohideposedthaton10.03.2013,thiscase

was assigned to her for further investigation. Shemade searchforthe


AccusedinvolvedinthiscaseandreachedatthehouseofAccusedatSant
Nagar,Burari.Thehousewasfoundlocked.ShegotNBWsofAccused
personsRupeshandBhagirathissuedfromcourt.

PW9 SI Santosh Sirohi further deposed that on 07.05.2013

AccusedRupeshsurrenderedincourtofLd.MM.Withthepermissionof

the court, she interrogated the Accused Rupesh and arrested him vide
arrest memo Ex. PW9/A and conducted his personal search vide Ex.
PW9/B. PW9 SI Santosh Sirohi recorded the disclosure statement of
AccusedvideEx.PW9/C.AccusedwastakenonPCremandforoneday,
but nothing incriminating could be recovered. Accused Rupesh was
medicallyexaminedvideMLCEx.PW9/Dandhispotencytestwasgot
conducted on 08.05.2013 vide report Ex. PW9/E. Examining doctor
handedovertheblood sampleofAccusedinsealedconditionwhichhe
seized vide seizure memo Ex. PW9/F. Exhibits were deposited in
malkhana. PW9recordedthestatementofwitnesses,thereafter,shewas
transferredandfurtherinvestigationwashandedovertoSIMukesh.
STATEMENT OF ACCUSED PERSONS UNDER SECTION 313
CrPC:
25.

InhisstatementrecordedunderSection313CrPC,Accused

RupeshpleadedinnocenceandfalseimplicationinthiscasebyProsecutrix
fortakingrevengeandextortingmoneyfromhimandhisfamilymembers.
AccusedstatedthatProsecutrixusedtogivetuitionclassestohimforXII

classandshehadlovefantasytowardshim,buthewasnotawareofthe
same.On15.02.2013,itwashis18thbirthday,shegiftedateddybearto
him and proposed him for marriage with her. He was surprised and
refusedherproposal.

AccusedRupeshfurtherstatedthathewasstudyinginGovt.

BoysSr.Sec.School,CCColony,PratapBagh,Delhi9andon16.02.2013
itwashisboardexaminationofphysical educationXIIclassanditwas
heldtill1.30PM. Heandhisfriendswereinschooltill2PMandthey
tooktheirphotographsinschool.Thereafter,theyreachedatChinaTown
Shop at Gupta Colony, Pratap Bagh, Delhi for taking refreshment.
Thereafter,theyreachedCampChowkbywalking.Fromtherehisfriends
boardedbusesforBurariandotherplacesandhealsoboardedabusfor
Jahangirpuri,Delhi,fromwherehetookhismarriedsisteralongwithhim
andatabout4.154.30PM,hereachedhishousealongwithhissisteras
some relatives were gathered at their house forhis marriage talks with
daughterofSh.KunwarPal.Hismarriagewasfixedonthesamedayand
hegotmarriedwiththedaughterofSh.KunwarPalon16.02.2014.

InhisstatementunderSection313CrPC,AccusedBhagirath

statedthatheisinnocentandhasbeenfalselyimplicatedinthiscase.Heis
vegetablesellerandonthedateofincident,hewasonhisjob.

DEFENCEEVIDENCE:
28.

Accused examined two defence witnesses. DW1 Daudayal

deposedthaton20122013,hewasastudentofGovernmentBoysSenior
SecondarySchool,CCColony,Delhi9.HewasastudentofXIIclassand
AccusedRupeshwashisclassmate.

DW1provedhismarksheetandcertificateofclassXII,which

are Ex. DW1/A and Ex. DW1/B respectively. He deposed that on


16.02.2013, i.e. the date of alleged incident they had their Physical
EducationExaminationinschoolandfrom10AMto12Noon,practicalof
physical education examination was conducted in playground and their
theoreticalexaminationwasconductedfrom12noonto1.30PMonthat
day. As it was their last examination of class XII, they came to the
playgroundaftertheexaminationandtookphotographswithfriends.

DW1deposed that healongwithAccusedRupesh andother

boysnamelyBabluandSanjeevPalremainedintheschooltill2PMand
theytooktheirphotographsinschoolplaygroundsinceitwastheirlastday
ofclassXII. Fromschool,theyreachedatChinaTownFastFoodStore
andthereafter,theyproceededtowardsKingswayCampChowk.Atabout
3PM,theyallreachedatCampChowk,Rupeshtoldthemthathehastogo
to Jahangirpuri for taking sister to home, as his some relatives are
supposedtocomeathishouseforhismarriagetalks.Rupeshleftforgoing
tohouseofhissisterbybusandtheyleftfortheirhouses.

ARGUMENTS,ANALYSISANDFINDINGS:

IhavehearddetailedargumentsadvancedbyLd.Counselfor

Accused as well as Ld. Addl. PP for the State and gone through the
evidenceonrecord.

The testimony of the Prosecutrix is undoubtedly the most

relevant pieceof evidence in the present case. Upon stepping into the
witnessbox,theProsecutrixPW1'J'deposedthaton16.02.2013atabout2
PM, she was called by Bhabhi of Accused to her house to fix a bulb.
Accusedwaspresentthereandwhenshewastryingtofixthebulb,father
ofAccused alsoreachedthereandgaveabottletoAccusedRupeshand
thereafter,heleftfromthere.BhabhiofAccusedalsoleftstatingthatshe
willreturnshortly.Thereafter,AccusedRupeshforcedhertoconsumethe
liquidwhichwasinthatbottle.Itwashavingfoulsmellandshebecame
unconsciousafterconsumingit.PW1furtherdeposedthatuponregaining
consciousness,shefoundonlyAccusedRupeshwaspresentthereandshe
was in naked condition and she realized that Accused had established
physical relations with her while she was unconscious. She further
deposedthatAccusedRupeshtoldhernottodiscloseaboutittoanyone
statingthatitwillonlybringbadnametoher.Sheworeherclothesand
return to her house and did not disclose anything to any of her family
members.

On 19.02.2013 at about 8 AM, she went to the house of

AccusedRupeshwherehissister,hisMausaandhisMausiwerepresent.
SheenquiredfromAccusedRupeshastowhyhehadcommittedsaidact
withher.Uponenquiry,shealsonarratedtheentireincidenttothesister
ofAccused,whoaskedAccusedtoapologizeforhisconduct,butAccused
Rupeshpushedandalsoabusedhertodowhatevershewantedtodo.His
Mausatoldhertocommitsuicide.

PW1furtherdeposedthat,thereafter,shemadeacallat100

number.Sincethepolicedidnotcome,shewenttotheofficeofherfather
atChandni ChowkanddidnottellherfatherthatAccusedRupeshhad
rapedher,butshehadonlytoldhimthatshehadaquarrelwithAccused
Rupesh. Thewitness wasquestioned astowhyshedid not tell toher
fatherabouttheincidentofrape.Sherespondedthatshedidnotconfidein
herfatherasshewasafraidthathewillscoldher.

On20.02.2013thematterwascompromisedasherfatherwent

tothehouseofAccused.However,AccusedRupeshwhilegoingfromin
frontofherhousetauntedherbysayingthatshehavenotbeenabletodo
anything against him. Healsostatedthat abtukatichipkali kitarah

ghumegi. Shedeposed thatfeelinghumiliated,sheconsumed 'AllOut'


mosquitorepellent.Thereafter,herfamilymemberstookhertoHinduRao
Hospitalandsheremainedadmittedtheretill21.02.2013. Uponenquiry
by herfather, shenarrated all thefacts tohim andultimatelycasewas
registeredonhercomplaintEx.PW1/A.

IthasbeenarguedbyLd.DefenceCounselthatthetestimony

oftheProsecutrixinthepresentcasedoesnotinspireconfidenceandher
statementisfullofembellishmentsandimprovements,asisapparenton
goingthroughhercrossexamination. ItissubmittedthatProsecutrix'J'
has falsely implicated Accused in this case as he refused to marry her
thoughshewasverymuchinterestedinmarryingAccusedRupesh.

Ontheotherhand,Ld.Addl.PPcontendedthattestimonyof

theProsecutrixestablishesthecaseoftheProsecutionbeyondreasonable
doubtandboththeAccusedshouldbeconvictedfortheallegedoffences.

Acareful perusal oftestimony ofProsecutrix initsentirety

would,however,revealthatshecannotbesaidtobeacrediblewitnessand
herstatementisnotworthyofreliance.Duringhercrossexamination,she

wasconfrontedbyherpreviousstatementsbyLd.DefenceCounseland
shecertainlymadevariousimprovementsuponsteppingintothewitness
box.

AperusalofcrossexaminationofPW1'J'wouldalsoreveal

thatsheadmittedinthecourseofcrossexaminationthatthereareother
residentialhousesnearplaceofincidenti.e.houseofBhabhiofAccused
Rupeshandtheareaisthicklypopulated.Shedidnotraiseanyalarmor
madeanyattempttoescapefromthehouseofBhabhiofAccusedwhen
AccusedRupeshallegedlyforcedhertoconsumefoulsmellliquidbottle
broughtbycoAccusedBhagirath.AsperProsecutrix,shewasstudyingin
B.A.Secondyearatthetimeofallegedincident.Thereisnoexplanation
astowhyshedidnoteventrytoresisttheallegedactsofAccusedRupesh,
whoforcedhertoconsumeafoulsmellliquid.

Bethatasitmay,itisextremelydifficulttoacceptastowhy

Prosecutrixdidnotrevealabouttheallegedrapetoherfamilymembers,
butwouldgoandtalkedabouttheincidenton19.02.2013tothefamily

membersoftheAccused.NoreasonhasbeenfurnishedbytheProsecutrix
astowhyshedidnotconfideinherfamilymembersabouttheallegedrape
committeduponherbyAccusedRupeshon16.02.2013. Herclaimthat
Accusedtoldhernottodiscloseittoanyoneasitwillbringbadnameto
her,doesnotappealtoreasonasshewentaheadandtalkedtothefamily
membersoftheoffenderhimself.

Moreover,surprisinglyshedidnotutterawordaboutittoher

father even her father went to PS on 20.12.2013 and allegedly


compromisedthematterwiththefatherofAccused. PW2fatherofthe
Prosecutrixalsodeposedthaton20.02.2013healongwithProsecutrixwent
to PS where both Accused persons were present and matter was
compromisedbetweenthem.Strangely,evenwhenthematterwasbeing
compromised in presence of Prosecutrix 'J',she did not utter any word
regardingallegedrapecommittedbyAccusedRupeshuponher.Moreso,
whenitisherownclaimthaton19.02.2013itself,shehadgonetothe
houseofAccusedatabout8AMandnarratedallthefactstohissister.It
ishighlyunnaturalthatarapevictimwouldnotdisclosethetruefactsto

herfamilymembers, merelybecauseofthereasonthatherfatherwould
scold herandherfatherwouldgotothehouseoftheAccusedwithout
knowingthecompletefactsandcompromisethematterwithhimandhis
family.

IalsofindnoforceinthecaseoftheProsecutiontotheeffect

thatProsecutrixconsumed'AllOut'on20.02.2013whenAccusedRupesh
whilegoingfrominfrontofherhousetauntedherbysayingabtukati
chipkalikitarahghumegi. Inthisregard,myattentionisdrawnbyLd.
DefenceCounseltoDDNo.42Adated20.02.2013PSBurariEx.PW2/A.
As per this DD entry, it was reported at PS Burari that one girl has
consumedAllOutinfrontofPSBurarion20.02.2013at22:15hours.In
viewofthesaidDDentryEx.PW6/A,itisapparentthatcontentionofthe
DefenceiscorrectthatProsecutrixhadinfactconsumedAllOutwhile
standinginfrontofPSBurarionlytopressurizethepolicetoregistercase
againstAccused.

During thecourse ofcrossexamination,PW1also admitted

that several other cases have been registered on the basis of complaint

made by her against different persons. She also admitted that she got
registered case FIR No. 160/2011 under Section 376/342/506 IPC PS
BhalswaDairyagainstoneJinnha,copyofFIRisExPW1/DA;FIRNo.
412/2011underSection341/354/323IPCPSJyotiNagaragainstJinnha,
thecopyofFIRisEx.PW1/DB;FIRNo.348/2011underSection363IPC
PS Burari against Jinnha, the copy of FIR is Ex. PW1/DC; FIR No.
84/2012 under Section 509/506/34 IPC PS Bhalaswa Diary against
brothersofJinnhanamelyMohd.NaeemandMohd.Hassan,copyofsame
isEx.PW1/DD.ItwascontendedbyLd.DefenceCounselthatProsecutrix
andherfamilymembersarehabitualoffilingfalsecasesagainstdifferent
persons only with a view to extort money from them and the Accused
persons in the present case have also been falsely implicated by the
Prosecutrix.

It is further, noteworthy that in the course of cross

examinationofProsecutrix'J',Defenceputtohervarioustextmessages
sent on the mobile phone of Accused Rupesh from her mobile Nos.
8882093798 and 8527346190. Prosecutrix 'J' admitted that mobile No.

8527346190ismobilenumberofherhousethoughshedeniedthatmobile
No. 8883093798 belongs to her. When she was questioned about the
aforesaid text messages sent from mobile Nos. 8882093798 and
8527346190tothemobilenumberofAccusedRupesh,shedeniedhaving
sentanymessagetohim,butvoluntarilyaddedthatitmaybepossiblethat
thesaidtextmessagesEx.PW1/D2weresenttoAccusedRupeshbyhis
variousgirlfriends.TheaforesaidexplanationputforthbytheProsecutrix
isnotonlyhighlyimprobable,butalsoapparentlyfalse.

IamalsounabletoacceptthetestimonyoftheProsecutrixthat

she was forced by Accused Rupesh to consume intoxicating liquid on


16.02.2013.ItisalsohighlyimprobablethatfatherofAccusedRupeshi.e.
coAccusedBhagirathwouldbringthesaidintoxicatingliquidinabottle
in the house of Bhabhi of Accused Rupesh and forced to consume the
same.ItisownclaimofBhabhiofAccusedRupeshthatshewaspresent
inthehouse. Ithasalsocomeonrecordduringhertestimonythatthere
wereotherhousesinthevicinity.Thereisnoreasonastowhyshedidnot
trytoraiseanalarmagainstAccusedRupeshwhenhewasforcingherto

consumetheintoxicatingliquidwhenitisherownclaimthatitwasfoul
smelling. There is no explanation for this unnatural conduct of the
Prosecutrixandalsomakesherclaimhighlydoubtful.

Consideringtheabovediscussionandtheevidenceonrecord,

itisevidentthatProsecutrix'J'cannotbetermedasreliableandcredible
witness.Hertestimonydoesnotinspireconfidence.TheAccused,inthese
circumstances,cannotbeconvictedfortheallegedoffencesonthebasisof
suchunreliablepieceofevidence.

Consequently,uponconsideringtheentireevidenceonrecord,

AccusedRupeshS/oBhagirathMathurandBhagirathMathurS/oSh.Sukh
Ramareherebyacquitted.Bailbondscancelled.Suretiesdischarged.
