SANTA ANA DEL MONTE MEETING WITH PURCHASERS

We are writing to you with regards to the deposit you paid to Grupo San Jose for the off plan
properties they were developing in Jumilla, Santa Ana del Monte, which havent been built.
Our Law Firm is specialized in Real Estate Law, Financial Law and Consumers protection Law,

plus legal interest since payment to developer (about 4% every year). We not only sued depositary
Banks, but also Banks who should be legally considered as a guarantors.
Our claims are based in the Generic Bank Guarantee agreements that Grupo San Jose: Herrada
del Tollo signed with Banks and Insurance Companies where they committed to produce
individual bank guarantees for every purchaser under the provisions of the 57/68 Act.
Unfortunately just a few valid individual bank guarantees were given, and most of buyers never got
one.
We do understand that the generic bank guarantee is legally sufficient to support Banks liability for
deposits and legal interest, because lack of individual bank guarantee is not enforceable to buyers,
whose rights cant be limited or waived just because Banks and Developers violated their
obligations.
Luckily, Spanish High Court has endorsed this interpretation of the 57/68 Act on the judgement
dated on 09/23/2015, which establishes that Banks are liable if Generic Bank Guarantee
Agreements were signed with Developers, although no individual bank guarantees werent made,
given that 57/68 Act is a mandatory Law, so the rights that recognizes to purchasers cant be
waived.
The bad news is that Spanish Government has repealed 57/68 Act, and from January 2016
deposits for off plan properties will be covered just when the building permission is approved (and
this is not the case for Santa Ana del Monte). Furthermore, the period to claim has been reduced
from 15 years to only 5 years time.
For the aforementioned reasons, we highly advise every purchaser of Santa Ana del Monte, of any
other off plan property, to start proceedings as soon as possible. To make it easier, our Law Firm is
offering unbeatable conditions to buyers, who could join one of the class actions that we are
preparing.
