DiMartino (“Respondent”), and the Insurance Commissioner of the State of Connecticut ("Commissioner") to wit: WHEREAS, Terry J. DiMartino, hereinafter referred to as the “Respondent”, holds a resident insurance producer license issued by the Connecticut Insurance Department, license number 217490, and an active resident business entity producer license for “Realistic Ventures”, license number 2345699; WHEREAS, the Department alleges that the Respondent failed to disclose within thirty days after the initial pretrial hearing date, that federal charges were pending against him, as required under section 38a-702o of the Connecticut General Statutes; WHEREAS, the Department alleges that the Respondent's conduct violates sections 38a-769, 38a-702k, 384-7020, and 38a-771 of the Connecticut General Statutes and constitutes cause for the suspension or revocation of his insurance licenses and/or the imposition of a fine pursuant to sections 38a-702k, 38a-771, and 38a-774 of the Connecticut General Statutes; WHEREAS, the Respondent neither admits nor denies the Department's allegations; WHEREAS, in an effort to avoid the expenses and uncertainty of litigation and/or an administrative proceeding, the Respondent neither admits nor denies the allegations contemplated by the Department and agrees to voluntarily waive: any right to a hearing; b, any requirement that the Commissioner's decision contain a statement of findings of fact and conclusions of law; and c. any and all rights to object to or challenge before the Commissioner or in any judicial proceedings any aspect, provision or requirement of this Stipulation. www.ctgov/cid P.O, Box 816 + Hartford, CT 06142-0816 ‘An Equal Opportunity EmployerWHEREAS, the Respondent agrees to the payment of a fine in the amount of $750.00 to be paid in three installments, with the first payment of $250.00 due within thirty days from the execution of this Stipulation and Consent Order, and the second payment of $250.00 due within thirty days from the Department's receipt of the first payment, and the third (final) payment of $250.00 due within thirty days of the Department's receipt of the second payment. WHEREAS, this Stipulation and Consent Order shall not be construed as limiting, curtailing, preempting, restricting or otherwise modifying any rights of third parties in connection with the Respondent's activities that are the subject of this Stipulation and Consent Order. NOW THEREFORE, upon consent of the parties, it is hereby ordered and adjudged: |. That the Insurance Department of the State of Councetiout has jurisdiction ‘over the Respondent and over the subject matter of this administrative proceeding; 2. That Respondent shall pay a fine in the amount of $750.00 upon the execution of this Stipulation and Consent Order, in accordance with the payment arrangement set forth herein; 3.
