CONFERENCE MEMORANDUM AND ORDER

Plaintiff in this diversity action asserts claims for breach of

contract, breach of the duty of loyalty, misappropriation of trade

secrets, tortious interference, unfair competition, and conspiracy.

Plaintiff seeks compensatory and punitive damages, as well as

injunctive relief. On November 23, 2005, plaintiff moved for a

temporary restraining order (“TRO”) to enjoin defendants from,

inter alia, soliciting business from Wegman’s Food Markets.

The Court conducted an informal conference in this matter

on November 30, 2005. Counsel for all parties participated in

the conference. After consulting with counsel, the Court

determined the following briefing schedule concerning

plaintiff’s TRO motion:

1. Plaintiff shall file any additional evidentiary materials in

support of its TRO motion, and a brief on subject matter

jurisdiction by 5:00 p.m. on December 5, 2005.

2. Defendants shall file their memoranda in opposition to

plaintiff’s TRO motion, and their brief on jurisdiction by

5:00 p.m. on December 9, 2005.

3. Plaintiff shall file any reply memorandum by 4:30 p.m. on

December 12, 2005.

All parties shall comply with the Court’s rules concerning the

electronic filing of documents.

The Court will endeavor to issue a decision on plaintiff’s

TRO motion by December 16, 2005.
