ThePublicProsecutor(meaningtheAttorneyGeneral)hasadiscretionoverwhatchargetobring. Inthecaseofakillingforinstance,thechargecanbemurder,orculpablehomicidenotamountingtomurderor evenvoluntarilycausinggrievoushurt.Thisisprosecutorialdiscretion. Itisnotexercisedarbitrarily.Thereareinternalguidelinesandtheprosecutorsarealwaysmindfulofprecedent whentheychooseaparticularcharge. Thereisnorulethattheprosecutionmustseekthemostseverepenaltypossibleindeed,thisisneverthecase. SometimesParliamenttakesawaythatdiscretion,byprescribingafixedpenalty,forexample,deathfor traffickinginaboveacertainquantityofillicitdrugs.Butingeneral,thetrialjudgehasadiscretionhowseverea penaltytoimpose.Thisisjudicialdiscretion. Assumingalljudgesandprosecutorsarefairandperformtheirjobsastheyshould,doesitreally matteronwhomthediscretionlies?
