#NuevoIFAI
Open Government, as a management model that promotes institutional openness in benet of society, should improve and
transform the relationship between society and authorities; foster a permanent dialogue between them to enhance better
public decisions, and generate joint eorts and collaboration to manage public issues.
IFAI will ensure the accomplishment of Mexicos
commitments in the #OpenGovernment Partnership
The full autonomy of the New IFAI has to provide certainty to Mexican society and the
international community about the accomplishment of all commitments assumed by our
country in OGP, as well as any future commitment in the Open Parliament Partnership.
A person requested the ME access to information
about ilegal mineral extraction in Mexico (loads,
mines where this crime has been detected and
closed mines).
The ME denied the existence of the requested
information due to the fact that its mandate
doesnt include mines close-down.
Even though the ME informed that it is not
authorized to execute mines close-downs, it should
have claried that it has jurisdiction to hear cases
involving mining leases cancellations. Thus, the ME
should have disclosed the related information.
The ME has been instructed to modify its answer
and, consequently:
To carry out an exhaustive search of the
requested information among all its
administrative units.
To inform the citizen the result of this
search in accordance to the Federal Law
for Transparency and Access to Public
Government Information and its
regulation.
A person requested the MCT access to information
about contracts for infrastructure projects
amounting 100 million pesos or more, that have
been signed between January 2005 and May 2014.
The MCT issued a document informing that the
requested information is available at the Electronic
System for Government Procurement, Compranet.
Neither the name nor the signature of the responsible
public servant appeared in the document.
The appeal presented by the citizen is founded
because the responsible public servants name and
signature dont appear in the document. This is
required for its legal validation.
The MCT has been instructed to revoke its answer,
as well as:
Additionally, the MCT has been encouraged to
notify both the IFAI and the citizenry, about
administrative acts properly motivated and signed.
To carry out a new search of the requested
information among all its administrative units.
To notify the result of this search in accordance
to the Federal Law for Transparency and Access
to Public Government Information.
The related document must contain name and
signature of the public servant in charge of this
administrative act.
