Respected Ministry of Public Education, By means of the present letter, receive a warm greeting from Julia Loraque and Diego Beamonte, volunteers of Spanish nationality who collaborated with the community of Palmera in the Cabecar Indigenous Reserve of Bajo Chirrip from the 21st of October to the 29th of November of 2012. This letter constitutes a major effort to solve one of the most serious problems affecting the Cabecar Indigenous Reserve of Bajo Chirrip and its surroundings. The following statements are based on information obtained during our stay in Palmera through observations and conversations with community members, students, teachers, employees of the educational institutions, and parents of students. The subject matter of this communication is the administration of the Liceo Rural Palmera, whose responsibility (at the time of our stay) rests with the director Jonathan Ros and the president of the Board of Education. Worryingly, this conflict is impossible to summarize in a single incident since it has become a network of alleged negligence and fraud closely tied together. Firstly, there are reasons that point to a constant misappropriation of funds belonging to the High School. These funds appear to be partly utilized for the personal use of the directive. These expenses include food such as cookies, soft drinks, meat, etc., and various personal hygiene products that never reach the hands of students or teachers. However, the most disturbing case is the alleged purchase of alcoholic beverages on the High Schools account, the careless consumption of alcohol in front of students and its storage in the High Schools kitchen. In addition there is evidence of falsification of invoices for teaching materials. These invoices indicate the purchase of school supplies which have never been given to teachers. Moreover, there are teachers who have been forced to purchase materials with their own salary. Secondly, and following from the above, the cook at the Lyceum is unable to feed the student body on a constant basis because of the frequent lack of food. The terrible result is the regular loss of school days each week. In addition, the multiple and repeated cancellation of classes usually occurs at the last minute, after the students have traveled by foot the long distances separating the Lyceum from their homes. On one occasion, a teacher complained that the meals were too repetitive (rice and tuna almost every day) and the principal provocatively, responded: "If they do not want to eat rice and tuna, they can eat air." This problem seems to have two causes; embezzlement and administrative neglect. The principal does not fulfill his prescribed duties. Many of his functions end up being carried out by teachers or other people. Proof of this is that after several months in office, in late October 2012, the principal still did not have an email address where he could receive information relevant to his position. It is also important to note that the principal has appointed illiterate people as members of the Board of Education and the

Board of Trustees, disagreeing with Section C, Article 10 of Chapter II of the Regulations on Boards of Education and Administrative Boards. Also, there are reasons to believe that the director has used, on more than one occasion, marijuana before and during working hours. The lack of advance notices and schedule planning creates an environment where it is difficult to educate and be educated, because it reflects poorly on the image of the teachers, who are forced to endure the situation in frustrated silence in order to keep their posts and salaries. Students, who could otherwise work and provide a much needed source of income for their families, often feel that their time is wasted, which leads them to associate negative concepts with education. As authors of the present letter, we consider it of extreme and transcendental importance to investigate this matter diligently, thus we ask for your help to achieve a rapid solution that benefits the affected. As a first step, and in accordance with the requests of the community of Palmera and its surroundings, we ask for the hiring of a new principal for the Liceo Rural Palmera, and that the following requirements are met in accordance with ILO Convention No. 169 on Indigenous and Tribal Peoples: 1. To guarantee a good and proper administration where decisions are made wisely and with anticipation. 2. To plan schedules in advance and to respect them. 3. To guarantee a daily lunch for each student, tailored to their nutritional needs, and taking into account the mental and physical efforts they undertake. 4. To guarantee transparency in both the budget and its allocation. In addition, the budget must be allocated as far in advance as possible. We cannot emphasize enough the importance of this requirement. 5. To convene bimonthly meetings in which the parents and students are informed about the budget and partake in other decisions that affect them. 6. To directly involve parents and adult students in the appointment of teachers and principals. We also suggest the inclusion of students in the rating of teachers. Finally, we request an internal auditing by the Ministry of Public Education in both the Liceo Rural Palmera and the Palmera Elementary School, the two public educational institutions in Bajo Chirrip. We also suggest that this letter serve as an example so that the administration is reviewed in the various public educational institutions of the indigenous territories of Costa Rica. The authors hope that the present letter conveys the urgency of the problem and the need for immediate action to achieve a permanent solution. Thank you for your attention and cooperation.

Al respetado Ministerio de Educacin Pblica, Por medio de la presente, reciba un cordial saludo de parte de Julia Loraque y Diego Beamonte, voluntarios de nacionalidad Espaola quienes colaboraron con la Comunidad de Palmera en la Reserva Indgena Cabecar de Bajo Chirrip en los meses desde el 21 de Octubre al 29 de Noviembre del 2012. La presente carta constituye un gran intento de solucionar uno de los problemas ms graves y pertinentes que afecta a la comunidad indgena Cabecar de Bajo Chirrip y sus alrededores. Las siguientes declaraciones estn basadas en informacin obtenida durante nuestra estancia en Palmera mediante observacin, y conversaciones con miembros de la comunidad, alumnos, profesores, trabajadores de las instituciones educativas y padres y madres de alumnos. Nos dirigimos a ustedes puesto que el asunto en cuestin es la administracin del Liceo Rural Palmera, cuya responsabilidad (en el momento de nuestra estancia) recae sobre el director Jonathan Ros y el presidente de la Junta Educativa. Preocupantemente, es imposible resumir este conflicto en un solo incidente, puesto que se trata de una red de presuntas negligencias y fraudes unidos estrechamente. En primer lugar, existen razones que apuntan a una constante malversacin de fondos pertenecientes al Liceo. Dichos fondos parecen ser en parte aprovechados para el uso personal de la direccin. Estos gastos incluyen alimentos tales como galletas, refrescos, carne, etc. y diversos productos de higiene personal, que nunca llegan a las manos de los alumnos o del profesorado. Sin embargo, lo mas perturbante es la supuesta compra de bebidas alcohlicas a cuenta del Liceo, as como su consumo despreocupado delante del alumnado y su almacenamiento en la cocina del Liceo. Adems existen indicios de falsificacin de facturas para material didctico. Dichas facturas indican la compra de material escolar que nunca ha sido entregado a los profesores para su utilizacin. Es ms, hay profesores que se han visto obligados a comprar material didctico con su propio dinero. En segundo lugar, y a raz de lo antedicho, la cocinera del Liceo sufre constantes apuros para alimentar al cuerpo estudiantil debido a la frecuente falta de alimentos. El terrible resultado es la prdida de das lectivos cada semana. Adems, en mltiples y repetidas ocasiones la cancelacin de clases ocurre en el ltimo minuto, despus de que los alumnos hayan recorrido a pie las largas distancias que separan sus casas del Liceo. En una ocasin, un profesor se quej de que el almuerzo era demasiado repetitivo (arroz y atn prcticamente todos los das) y el director, provocantemente, respondi: Pues si no quieren comer arroz y atn, que coman aire. Este problema parece tener una doble causa; la malversacin de fondos y la negligencia administrativa. El director no cumple con sus deberes como director. Muchas de sus funciones terminan siendo llevadas a cabo por profesores u otras personas ajenas. Prueba de ello es que despus de varios meses en el cargo de director, a finales de

Octubre del 2012, todava no tena una direccin de correo electrnico donde recibir informacin pertinente a su puesto. Asimismo, es importante recalcar que el director ha nombrado a personas analfabetas como miembros propietarios de la Junta de Educacin y de la Junta Administrativa, en desacuerdo con el Apartado C, Articulo 10, del Captulo II del Reglamento General de Juntas de Educacin y Juntas Administrativas. Tambin, hay razones de peso para creer que el director ha consumido en ms de una ocasin, marihuana antes de y durante sus horas de trabajo. La falta de avisos previos y de planificacin de horarios crea un ambiente donde es difcil educar y ser educado, ya que refleja pobremente en la imagen de los profesores, los cuales se ven obligados a soportar la situacin y callar frustrados para no perder su puesto y salario. Los alumnos, en vez de laborar y ganar dinero como sus padres, sienten que a menudo su tiempo es desperdiciado, lo que les lleva a asociar conceptos negativos con la educacin. Los autores de la presente, consideramos de extrema y transcendental importancia profundizar en este asunto con diligencia, por lo que solicitamos su ayuda para lograr una solucin rpida que favorezca a los afectados. Como primer paso, y de acuerdo con las peticiones de la Comunidad de Palmera y sus alrededores, pedimos la contratacin de un nuevo director para el Liceo Rural Palmera, a fin de que se cumplan los siguientes requisitos en acuerdo con el Convenio de la OIT n 169 sobre Pueblos Indgenas y Tribales en Pases Independientes: 1. Que se garantice una buena y adecuada administracin donde las decisiones sean tomadas con buen criterio y anticipacin. 2. Que los horarios sean planeados con antelacin y se respeten una vez establecidos. 3. Que se garantice un almuerzo diario para cada estudiante y que sea ajustado a las necesidades nutritivas de los alumnos; teniendo en cuenta el esfuerzo mental y fsico que realizan. 4. Que haya transparencia tanto en el presupuesto como en la alocacin del mismo. Adems, el presupuesto debe ser alocado con la mxima antelacin posible. NO podemos enfatizar suficientemente la importancia de este requisito. 5. Que se convoquen reuniones bimensuales en las que los padres y madres de familia, as como los alumnos, sean informados sobre el presupuesto y otras decisiones que les afecten. 6. Que los padres y madres de familia y los alumnos mayores de edad participen directamente en el nombramiento de profesores y directores. Finalmente, solicitamos una auditora interna por parte del Ministerio de Educacin Publica tanto en el Liceo Rural Palmera como en la Escuela Palmera, las dos instituciones educativas pblicas de Bajo Chirrip. Tambin sugerimos que esta carta sirva de ejemplo para que se revise el estado de la administracin en los distintos colegios y escuelas pblicas de los territorios indgenas

de Costa Rica. Asimismo, sugerimos la inclusin de los estudiantes en la calificacin de los profesores.
